Permanent fill impacts to 404 wetlands total approximately 0.48 acres. New dredging proposes the removal of 21,650 cubic yards of material. Coordinates in Decimal Degrees are: 35.80149 N, - 76.68352 W. _Type of Permit Applied For (check one): IP ( ) NWP ( ) GP (X) Applicable law: Section 404 of the Clean Water Act (X); Section 10, Rivers and Harbor Act (X) YOUR APPLICATION/PRECONSTRUCTION NOTIFICATION IS INCOMPLETE AND CANNOT BE EVALUATED UNTIL THE FOLLOWING INFORMATION IS RECEIVED (CHECK ALL THAT APPLY): Your application/pre- construction notification form has not been completed and /or signed. (see remarks) X Under the conditions of the 404 regulatory program, you are required to submit an aquatic resource mitigation plan. The required plan is either insufficient or has not been included with your notification (see remarks). X Your application /pre - construction notification did not include information describing measures you have implemented to avoid and minimize losses of Waters of the United States. Your submitted project plans or maps were insufficient, too large, or not legible (see remarks) -2- Your application/pre- construction notification did not include a delineation of affected special aquatic sites, including wetlands, vegetated shallows, and riffle and pool complexes as required. You must submit a copy of your application to the NC Wildlife Resources Commission (WRC) since your proposed work is in a designated trout water county (see remarks section below for the address of your WRC representative) Other (see remarks below) REMARKS: Please address the following items: 1. In order for your permit application to be considered complete, at mitigation statement and /or a compensatory mitigation plan for unavoidable impacts to waters of the U.S. is required. Neither a statement nor a plan was included in the application, the project design plans, or in the field investigation report dated April 14, 2015. 2. Compensatory mitigation is required for unavoidable impacts to waters of the U.S. The proposed project not only did not include a compensatory mitigation plan, there was no discussion regarding the applicant's attempt to avoid and minimize permanent or temporary impacts to waters of the U.S. onsite. 3. Additionally, a search of our records verifies that this project was permitted previously under the GP 291 process on February 5, 2008, modified on August 22, 2008 and again on February 2, 2009, and renewed on March 22, 2011. This permit authorized construction of a 10 -slip dock, a rail and lift system for a 268 dry slip storage facility, a sewer pump out facility at one staging platform, fuel pumps at a second staging platform, new dredging of an access channel, access boardwalks, clubhouse and pool, office building, parking lot and bulkheads adjacent to Core Creek. No fill impacts to waters of the U.S. were authorized. This existing permit expires on December 31, 2015. 4. This project is on hold until such time that we receive the required information to continue processing your application. 5. A meeting to discuss the project, along with avoidance and minimization measures along with compensatory mitigation requirements for unavoidable impacts to waters of the U.S. is required.
