The contractor removed a temporary pipe crossing without the appropriate BMPs in place. Immediately downstream of the pipe a small check was installed; however the appropriate dikes and a pump around were not in place. This is the second instance this week of permit violations. The earlier violation was reviewed by Dave Wanucha and John Thomas yesterday. I've included the email to Dave and John documenting the first violation. As done early this week, our Resident Engineer has shut down all work except for erosion control maintenance. The first shutdown was lifted this morning following the site visit by the agencies. Yesterday, the contractor sent us an email stating the DOT and the contractor would meet on-site prior to any work in permit areas. I've included a copy of that email for your records. Today that meeting did not happen. Our inspector wasn't notified of the work in the permit site, but instead arrived at the site immediately following the work, and promptly reported the violation. We will be conducting training next week for the contractor. Please give us your recommendations on how to proceed. This effective immediately. This is the same reason I shut the job down two days ago. The crew excavated in a live channel without the proper BMPs being used. The project will be stopped through this weekend until NCDENR can review the site and give their recommendations. The head wall pour on Y1 can finish today since it has begun however all other operations including structures shall cease immediately. You may continue to perform maintenance on erosion control. We need to have a serious conversation about this continuing issue. Let me know if you have any questions.
