ICA / PCN Comments:
Please notify me when the training is completed with project personnel to assure all parties are aware of and
following proper procedures for working in permitted areas.
Remarks and Recommendations:
This ICA report is being issued for unauthorized permitted site impacts on sites 3 and 12.
Site 12 impacts occurred on Tuesday ,8/18, when the grading superintendent directed the operator to remove
silt fence and orange safety fence delineating the permitted site, and to operate the equipment in the stream
channel to clear and grub the site.
No notification of the work was given to the NCDOT personnel.
Upon discovery the work was stopped and all project work suspended by the Resident Engineer. A meeting
was held with the following:

Procedures were discussed and agreed to requiring the contractor to review his proposed work in the
permitted sites with NCDOT personnel prior to beginning work. Neither Mr Foster nor Mr McNeill were
involved in the work resulting in the impacts at site 12.
The work suspension was lifted after this meeting and completion of urgent EC repairs and maintenance from
NPDES inspections.
Site 3 impacts occurred on Friday, 8/21, when the grading superintendent directed operators to remove a
stream crossing without consultation with NCDOT personnel to review the work and appropriate BMPs.
Upon discovery, the site was stabilized and work was again suspended. The site was stabilized sufficiently per
review by Amy Euliss, Div 9 DEO.
Corrective Action:
The contractor shall hold a meet with the Resident a Engineer and NCDOT personnel and include all grading
superintendents, foremen, equipment operators as well as all sub-contractors involved in earth moving
activities and work in or around permitted sites. Grading superintendents and project managers will be
required to review procedures for working in permitted sites with all parties involved. In short, no work shall
take place in or around permitted sites without consulting appropriate NCDOT personnel and discussing work
and appropriate BMPs and communicating that plan to the operators and inspectors. Adequate notification
should be given on starting work.
This meeting should take place by Wednesday, 8/25. Further unauthorized or accidental impacts to permitted
sites and environmentally sensitive areas can result in action by the DWR and USACE for violation of permit
conditions.
