The Town also visited the site and inspected the SCM(s)for completeness with the approved plan. As such, the following items have been provided to the Stormwater Division. • Executed deed where the SCM(s) is/are located; • Survey Plat with access and drainage easements related to the SCM(s) prepared and recorded at the County Register of Deeds office; • Operations and Maintenance Manual for the SCM(s); • Stormwater Control Measure Maintenance Agreement signed and notarized; • Stormwater Control Structure &Access Easement and Agreement recorded at the County Register of Deeds office; • Sealed certification by a licensed North Carolina Professional stating that the structure is complete and complies fully with approved plans and specifications; • Reproducible record drawings; • Maintenance Security. Owner Obligations Upon receipt of this certificate please provide the following information as soon as possible (but within 30-days) to: Emily.Cochran@CaryNC.gov 1) Owner contact information a) Name of legal owner of record; b) Mailing address of legal owner of record c) Contact name, tel. #, and email address of owner d) If maintenance responsibility is managed through a third party, please provide their company name, mailing address, contact name, contact tel. #, and contact email address. 2) One year from the date of this letter, you are required to submit a SCM inspection report certified by a licensed North Carolina professional engineer(PE), registered 919.469.4000 I carync.gov I PO Box 8005 Cary, NC 27512 landscape architect (RLA) or registered Professional Land Surveyor (PLS) with expertise in storm drainage that verifies that the SCM has been maintained and is currently in good working (functional) order per the requirements stipulated in the Maintenance Agreement and Operation and Maintenance Manual for this site. This certification shall be submitted electronically via email as a pdf file on the Town standard post-construction maintenance form entitles "Stormwater (SCM) Annual Maintenance Inspection Report". 3) You are required to comply in perpetuity with the monthly, quarterly, semi-annual, and general requirements outlined in the Stormwater Control Structure Maintenance Agreement for the SCM(s) at this site. 4) You are required to comply in perpetuity with the monthly, quarterly, semi-annual, annual, and 'as needed'frequency schedule as well as complying with the general requirements and record keeping outlined in the Operations and Maintenance Manual for the SCM(s) at this site. 5) It is highly recommended that you establish a funding mechanism, such as an escrow account, maintained at an adequate level to pay for the maintenance expenses over the lifetime of the SCM. Routine and proactive maintenance costs are required to ensure the continued functioning of the SCM, but will be much less than the cost of significant, restorative repairs resulting from lack of routine maintenance. NCSU has estimated average maintenance costs by SCM type, summarized below — refer to the 2021 study for additional information. These estimates are provided for illustrative purposes only; cost will vary based on contributing drainage area, design, location and other factors. Any failure to execute the provisions of the Land Development Ordinance, Chapter 4, Overlay District, Part 4.4.6 (G), Engineered Stormwater Control Structure, shall result in legal action by the Town to the limits prescribed by the Ordinance.
