PROJECT SUMMARY: The applicant proposes to construct a new floating dock at an existing docking facility with four (4) floating finger piers that would accommodate up to ten (10) vessels. The applicant also proposes a dredging footprint, to the maximum depth of -4.5' MLW, that would include the docking facility and the existing tributary that provides access to the main channel of Bradley Creek. 9. NARRATIVE DESCRIPTION: The project site is located at 6602 Spring Garden Drive, Wilmington, adjacent to Bradley Creek, New Hanover County. The parcel located at 6602 Spring Garden Drive is approximately 10,018 sq. ft. (0.23 acres). The lot is used as a common area for the HOA and has an existing 8-slip docking facility. The upland area is currently vegetated with native trees, shrubs, and grasses. The common area provides wet slips to 8 HOA residences. The 8 parcels have single-family residences and are deed -restricted by the HOA for dock access. Along Bradley Creek, there are coastal wetlands, varying between approximately 30 — 70' in width, along the shoreline. The wetlands primarily consistent of Smooth Cordgrass (Spartina alterniflora) in the low marsh that then transition to high marsh species. The combined shoreline length for the HOA is approximately 905'. The applicant currently maintains a community docking facility with a concrete fixed pier, measuring approximately 7' wide x 40' long. The fixed pier terminates in a covered gazebo that measures approximately I F wide x 13' long. There is a ramp that leads from the covered gazebo to a floating dock section, that measures approximately 6' wide x 17' long, that is in line with the fixed pier. The 6' x 17' floating dock section connects to the main floating dock that is oriented parallel to the shoreline. The main floating dock measures approximately 6' wide x 96' long. There are four (4) floating finger piers that extend perpendicular to the main floating dock and they are approximately 22' feet apart. The four (4) floating finger piers each measure approximately 6' wide x 24' long. The configuration of the main floating dock and the four (4) floating finger piers accommodates up to eight (8) vessels (see Sheets 1-3 of 11). The existing configuration of the docking facility was authorized under CAMA Major Permit # 95-99, which was issued on October 11, 1999 to Airlie Place Development. CAMA Major Permit #95-99 makes reference to the applicant's Declaration of Covenants, which authorized the expansion of the boat docking facility but prohibits the construction of any additional boat docks or docking facilities by the applicant, homeowners association or any individual property owners in Corbett Place at Airlie. CAMA Major Permit #95-99 also has a condition that requires that the docking facility display a sign showing the location of the nearest pump out facility, including other appropriate waste disposal information, at the entrance and the exit from the main pier. The applicant has provided historical imagery and is applying for dredging under maintenance excavation. DCM was unable to find any previous permitting history for excavation activity, however, there does appear to be a historical channel. The New Hanover County and City of Wilmington Land Use Plan classifies the adjacent Field Investigation Report: Corbett Place HOA DCM Major Permit Page 13 waters as Conservation, and the adjacent high ground portion of the project area as Residential. The adjacent waters of Bradley Creek in the project area are classified as SC by the Division of Water Resources and this area is NOT designated as Primary Nursery Area (PNA) by the N.C. Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROJECT DESCRIPTION: The applicant proposes to construct a new floating dock at an existing docking facility with four (4) floating finger piers that would accommodate up to ten (10) vessels. The applicant also proposes a dredging footprint, to the maximum depth of -4.5' MLW, that would include the docking facility and the existing tributary that provides access to the main channel of Bradley Creek. Once the existing floating docks are removed, the applicant proposes to excavate an area adjacent to the docking facility measuring approximately 96' wide x 200' long (19,200 sq.ft.) area and a second area to the main channel of Bradley Creek, measuring approximately 40' wide x 475' long (19,000 sq.ft), to a maximum project depth of -4.5' MLW. The 96' x 200' footprint would incorporate the proposed floating dock and floating finger piers and would include an area that would extend approximately 40' waterward of the proposed floats (see Sheets 5 and 6 of 11). The 40' x 475' dredge footprint would maintain access from the existing tributary of Bradley Creek to the main channel of Bradley Creek (see Sheets 5 and 6 of 11). According to the application, the existing water depths of the incorporated docking facility and the area waterward, within the proposed dredge footprint, range from approximately -2' MLW to -3' MLW (see Sheet 7 of 11 and the Sealed Hydrographic Survey dated 6/12/2023). The existing water depths from the tributary of Bradley Creek to the main channel of Bradley Creek, within the proposed dredge footprint, range from -2' MLW to -4' MLW. The connecting water depth to the main channel of Bradley Creek is -5' MLW (see "Sealed Survey — Updated" dated 11/10/2023). The approximately 35,000 sq.ft. area would produce approximately 2,200 cy of material. Bucket to barge method would be used for the proposed dredge work. The applicant is proposing two possible disposal locations for the 2,200 cy of material. The primary disposal location that is proposed is a private parcel located on DA-248 owned by Ms. Agnes Beane (PID: R06300-002-001- 000), that is located at the convergence of Motts Channel and the Atlantic Intercoastal Waterway (AIWW). The spoil material would be placed within the current limits of disturbance and would not expand the existing disposal footprint parcel (see Sheet 10 of 11). Ms. Beane has granted permission to place the proposed spoil material on her parcel. The waters adjacent to Ms. Beane's parcel are closed to shell fishing. The second possible disposal location that the applicant is proposing is a private parcel located on DA-251 owned by Shore Acres Company (PID: R06300-002-003-000), that is located adjacent to Shinn Creek (see Sheet 11 of 11). The applicant has not yet obtained permission from Shore Acres Company for disposal at this location and has stated in the application that they understand that permission for disposal must be obtained prior to commencing dredging. The waters adjacent to the parcel owned by Shore Acres Company are open to shell fishing. Field Investigation Report: Corbett Place HOA DCM Major Permit Page 14 The applicant has stated that, if needed, they understand that a consent agreement must be obtained prior to crossing a USACE right-of-way for spoil disposal. The applicant proposes to construct a new floating dock with four (4) floating finger piers that would accommodate up to ten (10) vessels. The existing ramp that begins from the covered gazebo would lead to a floating dock section that measures approximately 6' wide x 10' long. The proposed floating dock section would then connect perpendicularly to the proposed main floating dock that would be oriented parallel to the shoreline. The location of the proposed main floating dock would be southeast of the location of the existing main floating dock location. The main floating dock would measure approximately 6' wide x 114' long and would have four (4) floating finger piers that would extend perpendicular to the main floating dock. The four (4) floating finger piers would be located approximately 30' apart and would each measure approximately 6' wide x 30' long. The configuration of the floating finger piers would be able to accommodate up to eight (8) vessels. There would also be two (2) temporary slips located on the landward side of the main floating dock. The configuration of the main floating dock and the four (4) floating finger piers would accommodate up to ten (10) vessels (see Sheets 6 and 7 of 11). As proposed, the proposed floating dock configuration would not encroach into either adjacent 15' riparian setback. The proposed floating dock and finger piers would not extend further waterward than the previously permitted footprint. 11. ANTICIPATED IMPACTS: The proposed dredging would disturb approximately 35,000 sq.ft. of bottom substrate and would be excavated to the connecting depth of -4.5' MLW. This area is not designated as PNA but is adjacent to PNA and the proposed excavation appears to be within a historical channel. The approximately 2,200 sq.ft. of spoil material will be placed on either PID: R063 00-002-001 - 000, owned by Agnes Beane, or PID: R06300-002-003-000, owned by Shore Acres Company (pending permission). The proposed new docking facility would result in the shading and incorporation of approximately 1,887 sq.ft. of Estuarine Waters and Public Trust Area. The proposed structures would not encroach into the 15' riparian corridor setback requirement. The proposed floating dock and finger piers would not extend further waterward than the previously permitted footprint. Minor increases in turbidity can be expected during excavation and construction. Shoreline length = — 905' x 8 sq. ft. = 2,000 sq. ft. The width of the channel waterbody is approximately 470'. Bradley Creek and the project tributary have been maintained since at least 1996. See the attached figures for detail. Waters in the project area are classified as SC and are not open to shellfishing. The area is a secondary nursery area and not classified as PNA. The applicant proposes removal of the existing floating dock and reconfiguration / installation of a new floating dock. The proposed floating dock will be placed slightly southeast of the existing floating dock and measure 114' long x 6' wide with (4) 30' long x 4' wide finger piers and seven mooring pilings. Eight proposed permanent wet slips are consistent with currently permitted dockage. There are also two temporary slips proposed on the rear of the floating dock for loading / unloading and temporary dockage for friend or family vessels. Due to shoaling and restrictive water depths in the project area, dredging to the original channel depth of -4.5' MLW is proposed around the reconfigured docking facility and access channel to Bradley Creek. The total proposed maintenance dredge boundary is approximately 35,000 square feet and is meant to be authorized providing for future maintenance dredge events. 'Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) The docking facility will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier_ NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. General 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required.
