Karina, As noted in your email of November 3, 2023 (below), NCDOT requests authorization to install two temporary pipes on the HE-0001 to aid in construction of the project. The first temporary pipe would be located in the footprint of an already authorized, permanent impact and the other temporary pipe would be located in the footprint of the clean water diversion that is shown in the EC plans. I coordinated this request with DWR, USFWS, and WRC on November 6, 2023. All three agencies responded with no objections. NCDWR noted the following: "I do not see any issues with what they are proposing as long as the footprint of the approved impacts don't change and they follow the conditions of the 401 Water Quality Certification." The USACE does not object to this modification if the work is conducted in accordance with (1) the description of work in your email of November 3, 2023, to include the attached plans, and (2) all general and special of the Section 404 permit for this project. As such, by this email NCDOT is authorized to conduct work in waters of the U.S. as proposed. Please let me know if you have any questions. Previously at the environmental preconstruction meeting, details of the proposed temporary stream crossing to support the clearing/grubbing operation was discussed. Attached is a redlined plan sheet that shows the approximate location and the standard drawing for the crossing. The proposed location is within the limits of the permanently impacted jurisdictional stream for the HE-0001 construction work. Special Condition 20 of the permit describes the use of a temporary crossing during the clearing operation. The reason for this request is due to the need to reach the east side of the stream for clearing/grubbing operations. It is also proposed to allow the installation of a temporary pipe in lieu of the clean water diversion that is shown in the EC plans, please see the attached PNG file. The reason for this request is due to the contractor stating that a clean water diversion would most likely not be sufficient to appropriately divert the JS. The footprint of this proposed temporary pipe is within that of the diversion. Thank you for your attention to this matter.
