The failure to submit these monthly reports by the dates stipulated in the Special Order by Consent is a violation of the Order. The table below summarizes the pending penalties for these violations: Violation Description Due Date Received Date Stipulated Penalty Failure to meet a Scheduled Activity Obtain field lab certification from DWR July 15, 2023 Certification not obtained $ 1,000/da Missing Monthly SOC Progress Report July 15, 2023 Not Received $ 1,000 Missing Monthly SOC Progress Report August 15, 2023 Not Received $ 2,000 Based on the stipulated penalties outlined in Paragraph 3(c) of the Special Order by Consent, the penalty for not submitting a SOC Progress Report is $1,000 for the first violation and doubles with each subsequent violation. The penalty for failure to meet a Scheduled Activity is $1,000 per day. Paragraph 4 of the Consent Order states in part that Jones Estates Pace LLC may present information to the Division showing that non-compliance was caused by events or circumstances beyond their control. If you have justification that this violation was caused by events or circumstances beyond your control, you must reply in writing to the Raleigh Regional Office within ten (10) days after receipt of this Notice. Your justification will be reviewed, and a recommendation forwarded to the Director for his consideration.
