The proposed project seeks to construct single-family residences, totaling 184 units, with associated parking lots, sidewalks, utilities, and stormwater drainage infrastructure. The site is located at the intersection of Rocky River Road and Weddington Road (Hwy 84) in Monroe, Union County, North Carolina. The site is comprised of two parcels and consists of undeveloped forested land. The site is bound by Weddington Road to the south, N Rocky River Road to the west, undeveloped forested land and agricultural land to the east, and Rocky River Elementary School to the north. The center of the project area is located at 34.990095°, - 80.610982°. The following information is included as part of this application submittal: ⚫ Permit Drawings ⚫ Agency Correspondence An Approved Jurisdictional Determination (AJD) was obtained on October 28, 2020; however, the AJD decision was based on the Navigable Waters Protection Rule (NWPR). Since the USACE no longer relies upon AJDs issued under NWPR, and based on the recent Sackett v. EPA decision and the resulting 2023 Waters of the US Conforming Rule, two of the three wetlands on-site now appear to be non-jurisdictional due to a lack of continuous surface connection to downstream Traditionally Navigable Waters. Modifications to the permit are a result of a reduction in wetland impacts from 0.27-acre to 0.12-acre due to regulatory regime changes and increasing the length of the culvert to 92 LF and 60- inches in diameter. The resizing of the culvert will not result in increased impacts to the stream due to the removal of rip rap aprons. The proposed project will result in 178 LF/0.008-acre of permanent impacts and 30 LF/0.001-acre of temporary impacts due to a pump-around operation to Stream 1. • Stream 1 – Impacts 2, 3, and 4 o Impact 2: 92 LF 60-inch reinforced concrete pipe (RCP) will be installed at the crossing of Stream 1. The culvert results in 128 LF/0.006-acre of permanent impacts to Stream 1. The culvert will be buried 12-inches to promote the passage of aquatic organisms. o Impact 3: 30 LF/0.001-acre of temporary impacts associated with the crossing of Stream 1 are necessary to install an impervious dike and pumped diversion to perform the construction activity in dry conditions. o Impact 4: An additional 50 LF/.002-acre of permanent stream impacts, including 12 LF of riprap inlet protection, for the extension of an existing 48-inch RCP box culvert associated with a proposed right-hand turn lane, shoulder, and 5-foot wide sidewalk crossing of Stream 1 will be installed along Weddington Road.
