Please note that a copy of this PCN has been provided directly to Joanne Steenhuis in the Wilmington Office. The proposed modification consists of o.66 acres of permanent wetland impacts associated with the Parallel Taxiway project, located south of Runway 8 -26 (Lat: 34.735589 °N; Long: - 76.660577 °W)• The proposed project areas is ±25 acres, and is located in the White Oak River basin (HUC 0302o1o6), and the site drains to the Newport River /Gable Creek: {(Stream Index: 21417); Surface Water Classification: SA;HQW }. Proposed Project The proposed project consists of the construction of a parallel taxiway along Runway 8 -26 in order to improve aircraft safety when taxiing to the hangers. Currently, Runway 14 -32 is being used for both a runway and taxiway to reach the hangers. The construction of the parallel taxiway will result in o.66 acres of unavoidable permanent impacts to herbaceous wetlands. The wetlands proposed to be impacted consists of emergent herbaceous wetlands within the airfield, which are regularly mowed as part of the routine maintenance of the airport grounds. Project History Onsite wetlands were delineated by Withers and Ravenel, and the Corps of Engineers issued a Jurisdictional Determination on December 18, 2014 (SAW - 2014 - 01859)• Through pre- application consultation with Josh Mitchell with the Corps of Engineers, it was determined that the proposed o.66 acres of permanent wetland impacts were eligible for approval under a GP291. A copy of the email correspondence with Josh Mitchell has been provided as an Appendix. 1410 Commonwealth Drive I Suite 1011 Wilmington, NC 28403 1 tel: 910.256.9277 1 fax: 910.256.2584 www.withersravenet.com I License No. C -0832 Michael J Smith Airport — CAMA Major Modification — Parallel Taxiway The NC State Historic Preservation Office issued a comment letter on December 9, 2014 documenting that there are no known historic resources that would be affected by the proposed project. The SHPO letter has been provided as an Appendix. W &R conducted a survey for federally listed threatened and endangered species known to occur in Carteret County, and submitted the results to the USFWS for concurrence. In a letter dated December 31, 2014, the USFWS stated that the project is not likely to adversely affect any federally - listed species, their critical habitat, or species currently proposed for listing, and that requirements under section 7(a)(2) of the Endangered Species Act have been satisfied for this project. A copy of the USFWS letter has been provided as an Appendix. Proposed Impacts The proposed impacts consist of o.66 acres of permanent wetland impacts for construction of the proposed parallel taxiway. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Due to the linear nature of the project, and setback distances between the taxiway and runway, the proposed o.66 acres of wetland impacts could not be avoided. The wetlands proposed for impact consist of small, depressional, herbaceous wetlands that are heavily managed as part of the regular maintenance of the airfield. The NCWAM evaluation determined that the functional value of these wetlands were LOW. A copy of the NCWAM form has been provided as an Appendix. Mitigation Due to the LOW functional value of these wetlands, the applicant proposes to mitigate for the o.66 acres of permanent wetland impact at a 1:1 ratio, through the purchase of offsite mitigation credits. There are no private mitigation banks that currently service the 0302o1o6 basin. Therefore, the applicant will purchase o.66 acres of non - riparian wetland mitigation from the NC Division of Mitigation Services. A copy of the Letter of Acceptance has been provided as an Appendix. The current request is for o.66 acres of permanent wetland impacts (see the attached maps and PCN for details). However, the project will not result in adverse impacts to Essential Fish Habitat within the Newport River. During construction, silt fencing will be installed around all disturbed areas to prevent sediment from escaping into the Newport River. Additionally, runoff from the proposed taxiway will be treated for water quality by the stormwater management system before prior to being discharged. 7. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation program will be approved b� the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, re"ulations or authorizations associated with the proposed activity including G.S. S 143 -214.1 1. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit /401 Certification /CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized �Nork. The amount of the in -lieu fee to be paid by an applicant is calculated based upon the Fee Schedule and policies fisted at www.nceep.net. Based on the information supplied by you in your request to use the DMS, the impacts that may require compensatory mitigation are summarized in the following table. The amount of mitigation required and assigned to DMS for this impact is determined by permitting agencies and may exceed the impact amounts shown below.
