Dunn, Coastal Coordinator Habitat Conservation Division DATE: April 3, 2023 SUBJECT: CAMA Dredge/Fill Permit Application for Granata Living Trust, Brunswick County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 152 Oceangreens Lane adjacent to Piney Point Creek in Caswell Beach, NC_ Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.,S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U. S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to remove an existing docking facility and construct a new private docking facility to accommodate two vessels. A 4.5' by 586' pier with a bridge over a navigable slough at the 200' distance from shore will end at a 13' by 13' lift. Approximately 60' landward from the terminus would be a 4' by 6' axed platform with ramp to a 14' by 8' floating platform. A 5.5' by 10.5' kayak launch would be landward the platform. Water depths in the area range from 4' to -5.8' NLW. Piney Point Creek at this location is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and does not object to permit issuance. To minimize impacts to PNA resources during important biological periods, an April 1 — September 30 moratorium should be included as a permit condition.
