SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
Sawmill Point marina / OTH Realty LLC / Cape Fear Marina Association, in New
Hanover County

This letter is in response to the above referenced CAMA Major Permit application, which was
accepted as complete by the division's Wilmington office on April 2, 2023. The division is
currently reviewing your permit application to connect Sawmill Point Marina, LLC's
existing docking facility to Cape Fear Marina Association's existing docking facility by
installing a new fixed pier and two (2) new floating platforms underneath the existing
Isabel Holmes Bridge, adjacent to the NECFR. However, it has been determined that additional
information will be required prior to the division taking final action on your application.
See below for Additional Information Requested
1. Please provide the total depths pilings will be driven below the surface of the bottom
substrate.
2. Due to the high probability that there are various public/private utility and transmission
lines located beneath the bridge and within the alignment of the proposed structure,
please provide an additional figure or update an existing one to indicate where all
possible risks are located. Please also include the resources or contact information used to
determine these risks.
3. Please provide alternative analysis that considers the minimization of public trust
usurpation.
4. The Division asks that the applicant consider increasing the navigability of the elevated
bridge sections to allow maximum vessel travel underneath the structures. Additionally,
the division requests that the applicant provide signage at these elevated bridge sections
notifying the public that they are allowed to travel beneath them.

5. Both the fixed and floating structures cross an easement between the two properties.
Please provide a copy of the deed indicating ownership of the parcel located underneath
the bridge. Also, please provide a copy of the DOT easement, or at minimum the book
and page where it has been recorded.
At this time, it is necessary that processing of your permit application be placed in abeyance until
such time as the required information is accepted by the resource agencies and final comments
have been provided.
