On August 12, 2015, the Division of Water Resources (Division) received your application dated
August 7, 2015 requesting a 401 Water Quality Certification and Riparian Buffer Authorization
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until the following
information is received:
1. The impervious surface of the project should include proposed houses, driveways, and
sidewalks in addition to the road network. The application states that the percent
imperviousness is 12.66 %, and that does not appear to reflect the total project area and
all proposed impervious surfaces. Water Quality Certification #3890 requires a
stormwater management plan if the overall imperviousness of the project is greater
than 24% (high density). [15A NCAC 02H .0506(b)(5) and (c)(5)]
2. If the overall percent imperviousness of the project is less than 24% (low density), then
a diffuse flow plan is necessary. The application states that "No man -made ditches or
conveyances will be constructed ", but that seems unlikely if all of the impervious

3. The site plan needs to depict topographic contours for the entire project, not just the
road system. The stream is currently depicted as a line, but it should be shown as
having dimension with the buffers measured from each streambank. In addition, the
site plan should be;dated and stamped by a professional engineer. An "existing
conditions" plan sheet should accompany the site plan. [15A NCAC 02H .0502(b)]
4. Per the conditions of Water Quality Certification #3890, culverts must be buried to allow
aquatic life passage. Provide cross section details showing the provisions for aquatic life
passage. [15A NCAC 02H .0502(g)]
Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B.0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699 -1617.
Please be aware that you have no authorization under the Water Quality Certification Rules or
the Neuse Riparian Buffer Rules for this activity.
