NORTH CAROL-INA Interim Director Environmental Quality October 26, 2023 CERTIFIED MAIL: 7022 0410 0000 7789 3813 RETURN RECEIPT REQUESTED SDC 26 WWTP, LLC Attention: Leah Weiss 7401 Statesville Boulevard Salisbury,North Carolina 28145 Subject: NOTICE OF DEFICIENCY (NOD-2023-PC-0256) NPDES Stormwater Permit Number NCS000591 SDC 26 WWTP, LLC Facility- Salisbury Rowan Dear Ms. Weiss: On October 4, 2023, Jerry Eplin and Kathryn Peterson from the Mooresville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the SDC26 WWTP, LLC facility located at 7401 Statesville Boulevard, Salisbury, Rowan County,North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Daniel Maiden, Chris Santoro, and Kelly Hedrick were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Permit NCS000591. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as North Second Creek and Withrow Creek, both class C waters in the Yadkin-PeeDee River Basin. As a result of the site inspection, the following deficiencies are noted: 1) The Stormwater Pollution Prevention Plan(SPPP)has not been reviewed within the last year. The must be updated to accurately represent current site conditions, including bulk chemical storage. After updating,the SPPP should be reviewed on an annual basis. Employee training has reportedly been conducted verbally but has not been documented. There have reportedly been no spills within the last three years, but this is not documented in the SPPP. The SPPP should list a Responsible Party for stormwater compliance. 2) Analytical monitoring has not occurred. The facility qualitative monitoring indicates "no flow"; however, the monitoring personnel are only on site for approximately 1 hour per day. A one-hour window is not sufficient time to document whether a"measurable event"has occurred. Facility is not submitting discharge monitoring reports (DMRs) indicating"no flow". 3) Non-stormwater discharge evaluation has not been documented. Action Items 1) Immediately review and update the facility's SPPP as needed to represent current site conditions and storage practices. By January 1, 2024, submit a copy of the updated SPPP to the DEQ DEMLR Mooresville Regional Office. 2) Conduct and record analytical monitoring of all outfalls associated with industrial activity as per permit requirements. 3) Submit DMRs as required per the permit, even when a no flow condition exists. 4) Train applicable employees on the SPPP and document the training. 5) Conduct and document non-stormwater discharge monitoring at the next available opportunity. Thank you for your attention to this matter. This office requires that the deficiencies, as noted above and detailed in the enclosed inspection report, be properly resolved. Failure to address the deficiencies could result in the issuance of a Notice of Violation, which is subject to a civil penalty assessment of up to $25,000 per day for each violation.
