Dear Mr. Sparks:
Division personnel have reviewed and approved the modification of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
This final permit includes no changes from the draft permit sent to you on July 7, 2010.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this
decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local
governmental permit that may be required. If you have any questions concerning this permit, please

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.

On the behalf of Sparks Oil Company, Pyramid Environmental & Engineering, PC
(Pyramid) has prepared this letter to request a permit modification to the existing
Individual NPDES Permit for the referenced site. As discussed with the Division of
Water Quality (DWQ), this letter is the request for a permit modification to remove the
provision requiring toxicity testing.
In discussions during the permit process, Pyramid was guided by the DWQ during the
NPDES permitting process. The permit is for a groundwater remediation system which is
needed to cleanup petroleum (gasoline) contaminated groundwater in this area. Normally
these type of groundwater remediation systems completed for the NC UST Program are
granted a general NPDES permit under the UST program to clean-up groundwater and
soil. The permit process resulted in an individual NPDES permit for the site.
In 2009, the individual NPDES permit was approved for the site after many conversations
and submittals. The groundwater remediation system was installed and completed in
December 2009. The initial operation began on December 16, 2010. The initial discharge
analyses showed that the acute toxicity testing passes, and that the chronic toxicity was
within 15% of passing. Due to the failure of this test, the permit required re -analysis. In
the second test, all organisms died, and the chronic test failed. In the third test, the
organisms survived, but reproduction was very poor and the chronic test failed. After the
three failing toxicity tests, the discussion was again opened up that toxicity testing may
not be appropriate for this groundwater system. The laboratory personnel indicated that
naturally occurring metals in groundwater appeared to be the reason for the toxicity test
failures, not the contaminants of concern (petroleum hydrocarbons).

After reviewing the individual permit for the site, the Winston-Salem Regional Office
(WSRO) personnel discussed the project with the central office. Central Office agreed
that toxicity testing is not appropriate for the JW Smith / Camp Springs groundwater
remediation system. The permit modification will be to remove the requirement for acute
and chronic toxicity from the permit. The remaining permit conditions will remain the
same and quarterly testing and reporting of the discharge will be required. This
modification is considered a minor modification and will not require a fee payment,
however, public notification will be required as well as concurrence from the Division of
Environmental Health.
This letter is an official request to modify NPDES Permit # NC-0088692 to remove the
acute and chronic toxicity testing requirement, and maintain all other permit conditions.

Steve- Cindy indicated several factors why the toxicity testing may not be valid for this site. Please tell facility to submit
a letter request to NPDES requesting a permit mod to remove acute/chronic aquatic toxicity testing/limits. No fee
applies for minor mod, but mod would need to be public noticed and receive DEH concurrence. I will retain other
permit limits as is, since this is a discharge of toxicants to HQW waters, with specific permitting requirements. Whether
or not it should be HQW is a Planning question.

It's a "technical bulletin" not a rule. It can be changed as often as we do our stormwater manuel (weekly). If because it a
WSIII thus HQW by definition (not science), then just do an individual permit but write the permit exactly as if it were
the GP. This is Not real difficult in my opinion and if it has to be noticed, so be it.

Steve- our Technical Bulletin for petroleum remediation GPs excludes coverage to HWQ/ORW designations- that's what
was proposed and approved back in 2006. Since this facility discharges to HQW, I'm assuming that's why we went with
individual, and why the permit limits for toxicants were halved. I see potential problems trying to convert to GP
coverage at this time. The NCG51 GW remediation GP expires 9/2011, and we can take another look at exclusions next
year.
I'd definitely be ok with removing the acute tox test, and leave the decision on chronic tox test to Matt/Cindy (leave in
as limit, leave in as monitor -only, or remove). I know Cindy had concerns about the test conditions and reliability of tox
test results for this facility. To remove a limit will require public notice. This permit expires May 2012.

Suggestion:
Recently you told Tom and Cindy to meet and have new strategy for tox and GW remediation's by end of May. So far
don't think they have talked. Actually not real sure a strategy is necessary. I think that I'm correct in that this is the
ONLY petroleum remediation that even has a tox limit (much less two species). All others are GPs and have NO tox limit.
I don't think the tox folks have a clue as to why the fails but in this particular situation it really does not matter. Bottom
line the limit should never have gone into the permit. Just because it's a WSII (by definition only) was not reason to
deviate from the GP scenario.
Plus, in this situation the discharge is 1000' feet from a dry ditch and a mile to nearest stream. Bottom line there is no
environmental concerns here. Not really a reason to spend lots of time on a strategy. This one could be handled by
reissuing their permit as a GP as it should have been originally and rescinding the current individual permit and move on
to bigger and better issues.

In the WSRO region we only have two facilities that have Chronic and Acute limits and two species. All other GW
remediations (not petroleum) that have limits are passing the test. The two with the double species are not passing. I
guess the thing with this one is that it IS a petroleum GW remediation that would normally not have a tox limit at all.
Sergei decided to put one in just because its WSIL. But in this case there really are no waters being impacted. Like
many, water not even close and doubt the effluent ever reached a stream.
The cease enforcement is good but these folks will still be paying for tox testing. Do they have to stay with monthly
since they failed or can they go with the straight quarterly as is in the permit till we either change the permit (my
recommendation) or solve by committee ??? Do they continue with two species or just cerio?

Where do you think this is heading? The facility has ceased remediation and discharge at this time to avoid more
violations of Tox requirement. If there is not going to be any movement on the permit conditions in CO, then I need to
know so I can advise the permittee that they will have to get into a full blown and expensive THE to attempt to find the
reason of tax failures even though they are meeting all other permit requirements .

Plus......... the discharge itself is over 1000' from the intermittent stream (dry ditch).
Time to do the right thing folks. I'll take the hit. It's all my fault. I should have caught this when the draft permit was
issued and raised Holly (cane) then. My bad. Would have been a lot better and less expensive on the permittee had
we had these discussions then rather than now.
Since I obviously screwed up by not raising the issue then, and getting a reasonable resolution, I'm now requesting the
permit be re -issued.

Regional recommendation is that this permit be reissued without any tox limits. Has this been any other GW
remediation they could have received a GP and the GP does not have tox requirements. Just because this waterbody is
HWQ by definition because it's an WSII does not mean the WQ is excellent. It means there was low density and no
dischargers at the time of reclassification back in the early 90's. Had nothing to do with benthos or WQ.
This facility basically discharges to a dry ditch for a mile before it hits waters of the state.
I would also suggest that no CPAs be issued relating to tox failures as long as all other parameters compliant.
The permitting decision to include not one but two species for tox limits was flawed in my opinion and we need to clean
this up.

I called Mike Jones & Mika Tri funovic of Pyramid Environmental this afternoon. They have shut down the
remediation system while they await word irons DWQ on what steps to take next. Their March DMR is
attached.
According to my staff report from 007, the system discharges into an intermittent stream. that is l mile from
Country Line Creek (Class WS-Il, 1-IQW). Because ofthe (automatic) I-1QW chissification, their previous
request for a General Permit was denied by the NPDES Unit. Thus, the individual permit with the tox limit. I
wish I had gotten more involved at that point. Hopefully Matt will approve a permit modification.
