JAY ZIMMERMAN I) i, ecto, The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Upcoming NPDES Permit Reissuance The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersedes the paper reporting process outlined in your existing permit. According to our records, you have submitted an application for a NPDES permit renewal. If you are still awaiting your reissued NPDES permit, this letter serves to notify you that your reissued permit will include the new electronic reporting requirements. The reissued permit will require electronic reporting in place of paper -based reporting. Regardless of when you receive your reissued NPDES permit, electronic reporting will be required beginning as indicated above for Phases 1 and 2 reporting. As stated, I'll have a staff person physically view the disconnect. The remaining portion of the system is under a road, the discharge pipe has long been severed, etc. He has a current legal contract with the County to have his facility connected to sewer which runs along the back of his property (hence the contract). He has no real ability to rent the store and will not use the store again until it is connected to County sewer. have to communicate with Mr. Young in hardcopy mail so this will take a bit longer but he seems to be serious about addressing the issue and says he honestly didn't realize he was incurring a debt. since he wasn't discharging. He actually told me he talked to "someone" in Raleigh about a month ago and thought all this was taken care of ... not sure what that means but.. Thanks and let me know if you have any questions. Additionally the permittee has agreed to incorporate UV disinfection and effluent filters, should funding become available for this alternative prior to plant construction." ") Site description: Standing at the front of the bldg, the left side (upstairs) is the deli and the right side is the convenience store / service station. The realty office is located in the trailer to the left of the deli. It is NOT connected to the WWTP. They use the restrooms inside the store. The grease trap (only used for the deli) is located to the left of the building. The grease trap is checked every 6 months for pumping. Only deli sandwiches are prepared / served; there is NOT a full kitchen, due to the size and type of the WWTP. The bathrooms are gravity flow to back parking lot. The wastewater flows by gravity flow to a small (2' x 2' x 2') distribution box, then to the septic tank and dosing tank. The flow then goes through 3 distribution laterals and onto the lined subsurface sand filter. There is a Pet Grooming business located around back, in the downstairs area. The wastewater from this business is pumped to the same 2' x 2' x 2' distribution box. Note: No discharge has been observed since 3 laterals were dug up and cleaned / repaired and reburied during the winter of 2009-2010. The grass hill area is where the subsurface sand filter system is located. There is only one subsurface sand filter. This facility would discharge treated wastewater into Little Crabtree Creek, a tributary to the South Toe River. Comments from the Commission on this proposal are provided under provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113-131 et seq.), and the North Carolina Administrative Code 15A NCAC 10I.0102. Little Crabtree Creek supports wild rainbow trout. The South Toe River is designated an Aquatic Significant Natural Heritage Area of national significance because of numerous rare aquatic species. It supports the federally endangered Appalachian elktoe mussel (Alasmidonta raveneliana) and is designated as critical habitat for this species by the U.S. Fish and Wildlife Service. Other rare species found in the river include blotchside logperch (Percia burtoni, NC endangered), hellbender (NC Special Concern, US Species of Concern, Cryptobranchus alleganiensis), and the olive darter (Percina squamata, NC Special Concern and US Species of Concern). The logperch population in the South Toe River is the only known population in the state and one of only a few remaining across its entire range. The loss of the South Toe River population could significantly imperil the species. Water Quality impacts in Little Crabtree Creek affect habitat in the South Toe River. The most recent biologic integrity surveys in the 2005 Basinwide Report rated Little Crabtree Creek as Good -Fair whereas the river was rated Excellent. Mussel population declines have occurred downstream of the Franklin waste water treatment plant (WWTP) on the Little Tennessee River in Macon County and more recently below the Burnsville WWTP on the Cane River in Yancey County. Chlorine is acutely toxic to aquatic life and freshwater mussels are extremely sensitive to ammonia. Therefore, ultraviolet light or ozone systems are recommended instead of chlorine and de -chlorination systems. Ambient concentrations in the range of 0.3 to 1.0 mg/L total ammonia as N at pH 8 do not appear toxic to freshwater mussels (Augspurger et al. 2003). New WWTPs and facility improvements should employ technology that achieves these low ammonia concentrations. If permitted, the proposed discharge should incorporate the following stringent measures and conditions to protect the important resources in the South Toe River: 1. Ultaviolet disinfection will be used instead of chlorine -based methods. 2. Emergency power sources must be incorporated to provide continuous treatment. 3. The discharge will be eliminated once the East Yancey or other municipal sewer system becomes accessible. 4. The permit will be re-evaluated once site=specific management strategies are developed for the watershed under T15A NCAC 2130.0110. The Commission also requests that Mr. Young be required to contact Commission staff and the U.S. Fish and Wildlife Service in Asheville immediately if treatment problems arise. This would facilitate our c; assessment of any aquatic resource damages, assist the Division of Water Quality with remedial actions, and help assure the safety of field staff who routinely surveys the South Toe River. The flow that was permitted originally was 0.0015 MGD or 1500 gallons per day. This is the flow that the wastewater facility is designed to accommodate and I believe, from all accounts will sufficiently handle the flow from the entire establishment. I have found that the dog groomers should, on their busiest day, should dispense about 150 gallons of flow to include the bathrooms. The realty office should use around 25 gallons of flow. This leaves 1325 gallons of flow for the restaurant. By all accounts from other similar restaurants, it is customary to produce between 800 —1000 gallons of flow per day. This would fall within the design permitted flow. As was indicated in the letter from Corey Morris, Toe River Health District, the flow that is currently going into the septic tank drain field already on site is in need of being diverted to the requested permit discharge. At this time the 150 and 25 gallon estimated flow should easily be handled by the discharge permit. I would like to state, however, that if it is determined that the system cannot accommodate the flow from the offices in this septic tank drain field, these offices will be closed and the flow will be non -influential. February, 2009 this alternative was once again re -visited with the Yancey County Health Department and the requested Mr. Joe Lynn, Regional Soil Scientist with NC Department of Environment and Natural Resources to visit the site. He determined that the soil was still not suitable to accommodate the restaurant and bathrooms. He also found that a tank with an alarm system should be installed to accept the overflow from this septic tank nitrification field. This was installed late March, 2009 by permit. 2) Prefabricated Package Plant -- In March, 1988, this alternative was explored by Dobson Engineering and found to be less economical to pursue than the Septic Tank Sand Filtration Trench. The cost of this venture for a 1500 gpd system would run around $50,000 plus engineering. Once again, this is not economically sound. 1 SILVER BULLET FOOD MART - EAA 3) Permitted Sand Filter with Dosing Tank — This was suggested by Mr. Joe Lynn, DENR as an alternative to the potential expansion of the existing facility. While this could be an option at a cost range of $35,000 plus engineering, this would not be the most economical option. 4) Septic Tank Sand Filtration Trench — This is the existing treatment facility. In March, 1988 it was suggested that in dry conditions this system would, in all likelihood, riot discharge. This was proved to be an accurate assessment of this facility. Even in wet conditions, this system did not discharge. We affirm that this would continue to be the system of choice to be used at this current time. Or a 1.04 GPD/sq. ft. Application Rate. SUMMARY_ OF WASTEWATER TREATMENT ALTERNATIVES Several disposal options were considered prior to selecting the proposed alternative. The following treatment alternatives were considered: 1) Septic Tank Nitrification Field - The existing septic tank system is functioning satisfac- torily, However; because of it's capacity it is limited to serving the existing bathrooms installed for employees only. Insufficient suitable soil is available for the expansion of the existing septic tank. This alternative was explored with the Yancey County Health Department and determined to be impractical. 2) Prefabricated Package Plant - This alternative was considered, but is more costly than the selected alternative in terms of capitol cost and operating expenses. It may still be necessary, if during design phase of the project soil depth for proposed Sand Filtration Trenches is less than 48". A "Package Type" Treatment Plant" is not economically practical for a 1500 GPD system. The cost for construction of a secondary plant this size is approximately $ 15,000.00. 3) Septic Tank Sand Filtration Trench - This alternative was selected because it is the most environmentally sound and economically feasible alter- native and from an engineering stand point makes best use of the existing septic tank on the property and replaces the existing drainfield with a sand filtration trench system. A properly designed sand filtration trench system makes maximum use of the soil on the property and would not discharge during dry weather in all likelihood. During wet weather, underdrains would pipe treated effluent to Little Crabtree Creek, which is classified for this purpose. During wet weather, the stream has a higher assimilative capacity and the effect of the discharge from sand filtration trench during these periods would be neg- ligible. There is documented evidence that after the effluent from a septic tank is filtered through _12" of soil it has no effect upon ground water resources. PROJECT EFFECT OF THE DISCHARGE_UPON THE RECEIVING WATERS: The proposed treatment system will discharge treated wastewater to Little Crabtree Creek, a class "C Trout" stream in the French Broad River Basin. The treatment system will be maintained and operated by a licensed wastewater treatment plant operator. The discharge will comply with the limits contained in the N.P.D.E.S. Permit when issued and will protect water quality standards in the receiving stream. On your first consultative contact with me, which occurred at the Yancey County Health Department in late December/early January, I gave you a food service review application and we discussed at length the wastewater disposal at the Silver Bullet. At that time, I informed you that all food service wastewater at the Silver Bullet goes into the existing sand -filter discharge system. This system falls under the authority of NC DENR Division of Water Quality. The permit for this system expired in July 2001 and was not renewed. I informed you that the result of the expiration of this permit is that the Silver Bullet can not engage in any food service preparation. I also informed you at that time that it would be in your best interest to secure that permit or some other means of wastewater disposal as the first step in reopening the Silver Bullet as a food service establishment. Subsequently, you and I met with Roy Allen Hughes R.S., Environmental Health Supervisor for the Toe River Health District, on 6 March 2009. During that meeting, Allen and I again stated that the issuance of any food service permit by the Toe River Health District depends on the food service wastewater at the Silver Bullet being disposed of in an approved manner. The three of us again met on 12 March 2009 to examine the possibility of using the existing conventional septic system that serves the wastewater from Soak & Shine Pet Grooming, Foxfire Realty, and the non- food service wastewater from the Silver Bullet. Upon removing the lid of the existing septic tank, it was noted that the water level in the tank was above the level of the outlet. This is indicative of a failing septic system. This observation led to our emphasis on the importance of getting the existing sand -filter discharge system reapproved by Division of Water Quality and the necessity of correcting the failure of the existing system. The most recent meeting on this matter occurred on 23 March 2009. This meeting was attended by myself and Amy Herron of the Toe River Health District, yourself, Joe Lynn, Regional Soil Scientist for NC DENR Division of Environmental Health, Bill and Bonnie Young, and Juanita James, Environmental Consultant for James and James Environmental Management, Incorporated. Joe Lynn determined at that meeting that it would not be possible for the Silver Bullet to resume any food service activity without the reissuance of a sand -filter discharge permit by Division of Water Quality. Joe Lynn also stated that he was willing to allow the Silver Bullet to temporarily dispose of the wastewater (non-food service) that enters the existing conventional septic system by the pump and haul method. Based on these findings, it is the position of the Toe River Health District that the Silver Bullet can not currently serve any food that would require a food service permit. In response to my conversations with Don Price, he was able to locate a file in his office from our initial permitting. On the phone, we discovered that I have in my possession the documents which he believes will qualify as an EAA. He suggested that I send them on to you along with my application and fee and see if that will get the repermitting process moving. We are very anxious to be repermitted as soon as possible. We finally have a potential lessee who is going to work out. Because of the recent economy, this has been a difficult quest; the re -opening of the convenience store will be a boon to the local community both in providing a place to purchase gasoline and groceries without traveling long distances and in providing some workers with jobs.
