Adam,
On February 7, 2022, the Division of Water Resources (DWR) issued the City of Hendersonville an approval of a 401
Water Quality Certification under Water Quality General Certification 4132 (GC 4132) for the subject project. Condition
11.1. of GC 4132 states "When written authorization is required, the plans and specifications for the project are
incorporated into the authorization by reference and are an enforceable part of the Certification. Any modifications to
the project require notification to DWR and may require an application submittal to DWR with the appropriate fee."
Based on a site meeting conducted September 26, 2023, and a monitoring report received October 4, 2023, the plans
and specifications for the project are not being followed. The variations from the plans, of which I am aware, are as
follows:
• The approved plans call for remote instrumentation, including a rain gauge, flow measurement, and valve
control at the bottom -release discharge pipe. DWR understands there is no remote -controlled instrumentation,
no automated method of measuring flow, and the valve is adjusted manually. Please be aware DWR specifically
asked about this topic during application review in a request for additional information on December 9, 2021,
and received responses on December 14, 2021, and January 20, 2022, indicating remote controlled
instrumentation would be used.
• The City of Hendersonville North Fork Reservoir Sediment Release Downstream Monitoring Report dated
October 4, 2023, states "Future monitoring through 2026 will consist of quarterly visual observations and annual
cross-section surveys...". The approved plans, as proposed by the City of Hendersonville, call for quarterly cross-
section surveys for three years.
DWR will consider a revision of the approved plans without a request for a modification of the 401 Water Quality
Certification under the following conditions:
• In lieu of the automated remote -controlled instrumentation for the bottom -release discharge pipe, provide
DWR an SOP developed for City of Hendersonville Water Treatment Plant staff that specifically describes when
and how the bottom -release discharge pipe will be manually adjusted. The SOP should include specific
precipitation, flow monitoring, or visual thresholds to be used in determining how the valve will be adjusted and
information on how the valve will be adjusted to target the desired outflow, including ensuring the minimum
required outflow of 8 cfs, or inflow, whichever is less, is maintained.
If you propose to reduce the frequency of approved monitoring, provide a request to DWR that specifies why a
reduced monitoring protocol is requested and why any revisions will be adequate to confirm a de minimis
sediment release.
If you do not wish to provide this information, the plans and specifications provided with the application and approved within the
authorization should be followed or a request for a 401 Water Quality Certification modification should be submitted.
