Ross Jr., Secretary December 8, 2006 David Greer PO Box 15813 Wilmington, NC 28403 Dear"Mr. Greer: This letter is in response to your application request under the Coastal Area Management Act (LAMA) to modify CAMA Major Permit No. 41-05, in which the applicant is requesting to dredge within~the seven interior boat slips on the northwest side an existing dock structure, in Pender County. Processing of the permit application, which was received by the Division of Coastal Management's Wilmington office on November 3, 2006, is ongoing. However, it has been determined that additional information will be required prior to the Division taking final action on your application. These items are summarized below: 1) It has come to the attention of the N.C. Division of Coastal Management that a major discrepancy pertaining to water depths exist between what was issued on May 6, 2005 for the construction of the 20-slip docking facility, and the water depths depicted on the workplan drawings submitted for the current dredging proposal. The workplan drawings submitted for the 20-slip marina (dated 2/23/05) indicate a water depth of approximately 6 ft. normal low water (9 ft. normal high water - 3 ft. tidal amplitude) in and around the 10 landward boat slips. The workplan drawings submitted for the current modification request for dredging (dated 9/14/06) indicate the depths around the 10 landward boat slips is approximately 1.5 ft. normal low water. This discrepancy suggests a change in bottom elevation of 4.5 ft. over a little more than a year's time. Please describe in detail the explanation for this major water depth discrepancy. 'The results of this explanation will then be circulated to all review agencies for their review. 2) The submitted workplan drawing dated 9/25/06, showing a profile of the area to be dredged, suggest the proposed dredging will result in a "hole", or exceed the depth of the adjacent bottom elevation, on the landward side of the docking facility. This is a direct violation of 15A NCAC 07H.0208(b)(F), which states, "Any canal or boat basin shall be excavated no deeper than the depth of the connecting channels." If the requested water depth on the landward side of the docking facility is permitted to a final depth of 3 ft. normal low water, DCM is concerned that boats accessing the landward slips from both the north and the south will "kick" the shallow bottom during ingress and egress. Please describe in writing how you intend to address this issue. 4) On November 21, 2006, DCM issued a Notice of Violation (NOV) for non- compliance with condition #8 of the original permit (State Permit No. 41-05). It is the policy of the Division that no new permits or modification can be issued or. reviewed for projects that have active NOV's, until the restoration plan has been completed•to the satisfaction of the Division of Coastal Management. You will be given five working days from the date of this letter to respond to this request for additionalinformation: If you can provide to this office the requested information, including a statement from DC1V1 that the NOV has been .resolved, the DCM staff will continue processing of the application and the processing clock will not be suspended. If the required information is not provided to this office within the specified time frame, processing of the application will be suspended until such time as the requested information is provided. Dear committee, Morehead City DCM This is the response for the Sloop.Point dredge request for David Greer. Response to question one of your requests. The application far the 20 slips at sloop point was modified from our original request to install 10 boat lifts on the two existing 10 slip docks we had when we purchased the property from Mrs., Redwine. We were directed to modify our request by shell fish to prevent a closed to shell fish ruling. The water depths on the drawings for this proposal were taken from the drawings from Mrs., Redwines application in 1985, where Mrs., Redwine was granted two docks with 10 slips each on floating structures. We have done away with the floating structures and put the lifts on fixed structures. We were in shock that we had to combine all of our lifts on one dock, and being so I did not think to recheck our water depths, at that time. Our lifts now are workable lifts, but are hard for the home owners to get in and out at a really low tide. The area discussion, From Topsail Inlet, Banks Channel run along the backside of S. Topsail Island, heading north for about nine miles and then turns back to the west to dump into the AICW. On the far bank of the AICW directly in front of this channel is where our dock is located. This area consist of strong pushing currents which as the ability to change water depths more than normal erasion over years. In Question [3) of your letter you have indicated concerns of entry to the slips at low water from the north and south ends of the dock. Our boats aze limited to 24ft and under. A boat of this size with the motor tilted will normaly only draws 10 to 14 inches of water. How ever we would like to take the interior channel out 13 feet more on each side if we can, and this would give us enough water to come and go at any tide. So I have reworked the drawings to show this and have changed the dcm-dp2 form to reflect this change. This should solve any concerns in this matter. Question [4J asked about a violation of our permit with the size boats. I have been in direct contact with Heather Coats in this matter and have complied with every thing we need to do to correct this matter. Mr., Greer had rented the slips that were not sold to people in Pecan Grove, knowing that this was only temporary he did not think to ask about the boat sizes and have had them remove there boats from these lifts.
