The Division of Water Resources (DWR or the Division) hereby issues the attached NPDES permit for
the subject facility. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
DWR understands that you have purchased the subject site since last renewal, and wish to pursue the
active request to renew the permit (received September 25, 2012), submitted by previous owner BP.
Changes to the Previous Permit rsee Fact Sheet — Renewal Summary]. Based on revised EPA surface
water -quality standards, DWR has replaced monitoring for Phenol [single compound] with Total
Recoverable Phenolics [32730]. This is required of all discharges to Water Supply (WS) waters. We
have also added monitoring for Naphthalene [code 34696] to detect the presence of diesel fuel.
Based on revised EPA standards for Human Health of 1500 µg/L, and for Water Supply (WS) at
19µg/L, the Division has deleted quarterly monitoring for Methyl Tertiary Butyl Either (MTBE)
and its associated Special Condition. Blanchard requested verbally that DWR reduce the sampling
frequency from Monthly to Quarterly [meeting on August 8.2013 with Brad Lambert, Steve
Chalupa, John Hennessy, and Joe Corporon]. This has been granted except for the parameters
Turbidity and Total Suspended Solids (TSS), based on analytical data received over the last permit
cycle. Please note that Quarterly samples shall be collected concurrently with WET -test samples
[see Section A. (1)].

DWR has removed the table footnote [Section A. (1.)] suggesting a "quiescent zone" for sampling
Oil and Grease (O&G). This suggested sampling has been questioned as "non -operational"
considering the. mandate to sample during discharge. Finally, we have updated your facility
description and site map, and add parameter codes to permit Section A. (L) for your convenience.
If any parts, measurement frequencies, or sampling.requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.
This pemmt is not transferable except after notifying the Division of Water Resources. The Division
may require permit modification, or revocation and re -issuance. Please note that this permit does not
affect your legal obligation to obtain other permits required by the Division of Water Resources, the
Division of Land Resources, the Coastal Area Management Act, or other federal or local governments.

accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
11,111 and IV hereof.
This permit shall become effective November 1, 2013.
This permit and authorization to discharge shall expire at midnight on March. 31, 2018.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Blanchard Terminal Company, LLC
is hereby authorized to:
1. continue to operate a Surface -Water Pollution Control System to manage stormwater and
related petroleum -contact water held in proximity to above -ground storage tanks (ASTs) and
appurtenant piping for the distribution of hydrocarbon fuels [surface bulk -storage exceeding
one (1) million gallons], the system. consisting of:
• earthen berms [dikes] surrounding ASTs [secondary -containment area(s)]
• gravity drain piping with discharge gate valve and outfall sample
point; hand -operated, normally closed
located at the Blanchard Terminal, 2026. West Oak Street, Selma; and therefrom
2. discharge from said treatment works via Outfall 001, located on the attached map, to an unnamed
tributary (UT) to Mill Creek [Stream Segment 27-40], a waterbody currently classified WS-1V
NSW within Subbasin 03-04-02 of the Neuse River Basin.

A. (L) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
Beginning upon the effective date and lasting until permit expiration, the Permittee is authorized to
discharge treated wastewater/stormwater from Outfall 001. Such discharges shall be limited and
monitored by the Permittee as specified below:

Footnotes:
1. Flow Flow shall be monitored with each discharge event and may be monitored in one of
four ways:
a. measure flow continuously;
b. Rational Method -- calculate flow based on total rainfall per unit area,
including built -on area draining to the outfall;
c. estimate flow at 20-minute intervals during the entire discharge event; or
d. report flow based on discharge pump logs.
2. Samples to be collected concurrently with WET Test sampling.
3. Whole Effluent Toxicity (WET) Testing — Acute WET testing has been relaxed from Quarterly to
Annually based on past compliance. Testing will continue Annually provided that the Permittee
maintains WET -test results showing "pass" [LC50 > 100] for each annual event. If WET -test
results show "fail," the sampling frequency shall immediately increase to Quarterly in accord with
Section A. (2.), and the Permittee shall not regain eligibility for annual testing until five (5)
consecutive calendar quarters show "Pass."
Conditions:
1. The Permittee shall discharge no floating solids or foam.
2. The Permittee shall discharge no tank solids, tank bottom water, or tank rag layer.
3. Following hydrostatic tank testing, the Permittee shall discharge no tank (or pipe) contents with
concentrations of benzene exceeding 1.19 µg/L or toluene greater than 11 jig/L.

A. (2.) ACUTE TOXICITY MONITORING -LIMITED (ANNUAL)
ACUTE TOXICITY MONITORING (EPISODIC)
Petroleum Bulk Storage
-The Permittee shall conduct quarterly acute toxicity tests [except when relaxed to Annual monitoring]
using protocols defined as definitive in E.P.A. Document EPA/600/4-90/027 entitled "Methods for
Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall
be performed -as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -
monitoring purposes must be obtained below all waste treatment. The tests will be performed on a
discharge event during each quarter (January -March, April -June, July -September, October -
December), except when relaxed to Annual monitoring.
Should there be no discharge [no flow] from the facility during a quarter in which toxicity monitoring is
required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Section at the address cited below.
The parameter code for this test is TAE6C: All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWR Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

RESPONSE:
I have reviewed the draft permit and determined that the proposed discharge is not located
sufficiently close to any existing or known proposed public water supply intake so as to create an
adverse effect on water quality. The DWR concurs with the issuance of this permit provided the
Permittee properly operates and maintains the facility; the Permittee meets the stated effluent limits
prior to discharge; and the discharge does not contravene the designated water quality standards.
X I concur with issuance of the above permit provided the following conditions are met:
The point of discharge is located less than 5 miles upstream of intake for the Town of
Smithfield (PWSID No. 03-35-010). No special conditions are required as long as permit limits
are met.

Facility Summary
This facility confines stormwater and maintenance wastewater behind bermed areas [dikes]. These dikes are
equipped with drain pipes controlled by hand -operated valves, normally closed. This controlled discharge
constitutes a point source to the environment. Moreover, because this facility stores fuel hydrocarbons in
above -ground storage tanks (ASTs) and appurtenant piping, with surface storage in excess of one (1)
million gallons, the facility is specifically excluded from coverage under conventional stormwater
regulations.
Toxicity — This permit requires Acute Whole Effluent Toxicity (WET) testing Fathead Minnow
(Pimephales promelas), 24-hr definitive, LC-50 >100% [TAE6C]. Since January 2008 [eleven (11) tests],
all Quarterly TOX testing is reported as "PASS." Based on these data DWQ has relaxed the monitoring
frequency from Quarterly to Annually.
For Renewal - updated facility description and Vicinity Map; added parameter codes to Section A. (L).
The Division has removed previous Special Condition for Methyl Tertiary Butyl Either (MTBE) based on
revised EPA Standards. Future MTBE compliance will be evaluated based on Human Health Standard of
1,500µg/L and Water Supply (WS) Standard at 19µg/L. Per new EPA Standard, Phenol (single
compound) has been replaced by Total Recoverable Phenolics (32730); monitoring is relaxed from
Monthly to Quarterly based on data reported as "not detected." No other changes to permit limits or
monitoring.
RPA - Reasonable Potential Analysis (RPA) - RPA was not conducted on effluent parameters because
Discharge Monitoring Reports (DMRs) reported fuel -related parameters below the method detection levels
(MDLs) for the past five (5) years (Jan2008-Ju12013).
