Class 11 Facility
Dear Mr. Lashua:
Division of Water Quality (Division) personnel have reviewed and approved your application for the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. It is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated
October 15, 2007, or as subsequently amended.
This final permit contains no significant changes since the draft permit which was sent to you on
May 23, 2012. Since this facility was previously included on the permit for Connestee Falls WWTP
#1, this is a new permit. It authorizes an expansion of the existing facilities to 0.066 MGD after
obtaining required approvals from the Division.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30)
days after receiving this letter. Your request must take the form of a written petition conforming to
Chapter 150B of the North Carolina General Statutes, and must be filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless
such demand is made, this permit remains final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division
may modify and re -issue, or revoke this permit. Please note that this permit does not affect your
legal obligation to obtain other permits required by the Division of Water Quality, the Division of
Land Resources, or other federal or local governmental agencies.

Alternative methods of disinfection to chlorination shall be required. See condition A (3) should
the facility's primary disinfection system fail. Total residual chlorine monitoring requirements and
limits are applicable if chlorine compounds are used for disinfection. -
There shall be no discharge of solids or foam visible in other than trace amounts.

A (3) TEMPORARY MEANS OF DISINFECTION
In the event that the wastewater treatment plant's disinfection system should fail or be removed from
effective service, the permittee must immediately notify the Surface Water Protection staff of the
Asheville Regional Office and discuss temporary, alternate means for disinfection of the effluent.
If chlorine compounds are used as a temporary means of disinfection, the total residual chlorine
(TRC) concentration of the effluent must be monitored on a daily basis and values reported on the
discharge monitoring report. TRC in the effluent may not exceed 28 pg/L; therefore, dechlorination
methods may also be necessary.
Use of a disinfection system other than that approved by this Division during circumstances not
deemed as emergency and/or temporary (e.g., replacement of UV lamps, cleaning and maintenance,
etc.) may be considered a violation of the terms of this permit.

Summary
• Transylvania Utilities, Inc owns and operates two separate wastewater treatment facilities
serving the Connestee Falls development in Transylvania County. Until 2011, both plants
had been included in the same NPDES permit. The Division has decided to separate the
two, and a new permit number has been assigned to this facility, WWTP #2.
• This "new' permit application was combined with a request to expand its outfall from a
design flow of 0.02 MGD to 0.066 MGD. Connestee Falls WWTP # 1 (NC0024295) will
remain at 0.3 MGD.
• A new value of 0.75 cfs was used for the summer 7Q10. This is new data from USGS, as
included on the permit application. Previously, this figure had been 1.0 cfs.
• The proposed expansion is not subject to review under the North Carolina Environmental
Policy Act (SEPA), because the expansion amount is well under the threshold.
• Per the NC antidegredation policy at NCAC 2B.0201, applicants for an NPDES permit
expansion must document the consideration of non -discharge alternatives. After review of
the submitted EAA, the Division requested more information. Satisfactory responses were
received on April 24, 2012. The EAA is deemed acceptable for an expanded design flow of
66,000 GPD.
• A compliance summary of the past three years was extracted from BIMS. The data showed
no limits violations during this period for either plant.
Discharge Monitoring Report Data Review
Flows averaged 8790 gallons per day, or 44% capacity. Data shows that recent BOD sampling
results averaged 5.15 mg/L and ammonia -nitrogen 1.89 mg/L. The great majority of TSS
sampling results was non -detect, with a maximum of 7.4 mg/L.
Fact Sheet Permit No. NC0088943
Transylvania Utilities, Inc. Connestee Falls WWTPs
Permit Limits Development
As an expansion, this facility is subject to the requirements for expanded facilities in a HQW-
classified receiving stream at 15A NCAC 02B .0224. In addition, specific temperature
requirements for Class C-Trout waters apply [15A NCAC 02B .0211 (3) 0)]. These include:
• Summer BOD monthly average limits of 5 mg/L
• Summer Ammonia -Nitrogen monthly average limits of 2 mg/L
• 'Dissolved Oxygen equal to or greater than 6.0 mg/L
• The total volume of the treated wastewater for all dischargers combined shall not exceed
50% of the total instream flow under 7Q10 conditions. As the only discharger in Lower
Creek, and with an IWC well under 50%, this restriction does not impact this expansion.
However, any future expansions or new discharges into Lower Creek may have to be
modeled in order to judge compliance with this requirement.
• Total Residual Chlorine: Since alternative methods to chlorination shall be required for the
expanded flow, UV disinfection is planned. However, the TRC limit will remain as a special
condition, since a backup chlorination system remains in place for emergency use only.
• This expanded discharge reduces the allowable BOD and ammonia -nitrogen from the
existing permit. At 20,000 GPD, the limits presently permitted for this outfall in NCO024295
were 30 mg/L BOD and 26 mg/L ammonia. In comparison, the expanded plant will have a
discharge of 66,000 GPD and 5/2 limits. Calculating pounds of BOD discharged, the load
will actually decrease by about half. Therefore, no modeling was deemed necessary for this
expansion.
Proposed Changes (from Permit No. NC0024295):
• Separated this WWTP into a new permit, NC0088943.
• Added an effluent page for the expanded 0.066 MGD flow.
• Added a special condition regarding disinfection in situations where the UV system may
be off line and backup chlorination must be used.

Re: Request for Information
Transylvania Utilities, Inc. Application
Connestee Falls WWTP #2
NPDES Permit Application No. NCO024295 (Revised to NC0088943)
Dear Mr. Vinzani:
Attached for your convenience is a copy of your February 11, 2011 letter regarding this application.
Please accept our apology for the lengthy delay in this response. While it is unclear how we have
failed to respond to your comments, we appreciate your patience and hope the following will
adequately respond to your questions and comments. I am addressing in the same order as provided
in your letter. Also for your convenience I have enclosed another copy of our original PER.
1. Our PER dated 2/18110 included in Section IV "Table 4.1 Wastewater Flow Projections".
Information from Transylvania Utilities indicates 64 existing lots and 118 proposed lots for a total
of 182 and based on 360 gpd/connection would yield a projected flow of 65,520 gpd. We would
respectfully request consideration of this permitted capacity rounded to 66,000 gpd in lieu of the
originally proposed rounding of 70,000 gpd.
2. Again referencing the PER Section VI, 6.01 - 4 "Direct Discharge - Plant Expansion" and Figure
13 depicting the Expansion Plan for a direct discharge, the process treatment components reflect
the addition of flow equalization, dualized aeration basins/dual clarifiers, effluent filtration, UV
disinfection and post aeration. Transylvania Utilities has indicated, based on their operating
experience with similar component processes a comfort level that the expanded/upgraded plant
could meet the 5/2/6 standard referenced in your letter.
3. The "dedicated site" Alternative 2 with secondary treatment has greater land requirements due to
the difference in buffers (i.e. 400' buffer), which translates into higher land costs.
4. Our understanding is that the new NPDES # assigned to Connestee Falls WWTP #2 is
NC0088943.
Enclosed are two copies of our revised PER, noting the change in proposed capacity to 66,000 gpd
and the associated changes in the text, cost estimates and figures.
We res ctfully requ t your continued review of this application.

Dear Mr. Vinzani,
We are in receipt of your March 30, 2011 letter and draft permit for the above referenced facility.
I felt it best to clarify that the previous decision to put both discharges under one NPDES permit was not ours. There are two
distinctly separate treatment facilities some distance apart and not just one plant with two discharges so that being said, we
do agree that a separate permit for each is prudent and have no objection to this approach.
Should you have any questions or if I can be of any further assistance please do not hesitate to contact me at 704-319-0523.

NPDES Permit Application No. NCO024295
Dear Mr. Stewart:
A preliminary review of your submitted application request for an NPDES Permit renewal and
expansion has been made. We have the following comments and questions:
1. You requested a 50,000 GPD expansion. The actual additional number of units,118, multiplied
by the 360 GPD factor results in an additional 42,480 GPD. Our intent, therefore, is to allow a
maximum increase of 43,000 GPD, or a total of 63,000 GPD.
2. Please be aware that this discharge is to a receiving stream, Little Creek, which is designated
as high quality waters (HQW). As such, an expansion must, by regulation, receive limits of 5 mg/I
BOD and 2 mg/L ammonia. The trout waters standard of 6.0 mg/L must be protected in the
receiving stream, so the adequacy of these limits will be modeled against this standard. Please
recalculate design costs alternatives based upon this requirement.
3. Regarding the reuse option, it is unclear why this would be less expensive than land application
of secondary effluent. Both would need the same land area hydraulically. Please explain.
4. Each discharging wastewater treatment facility in North Carolina must have its own NPDES
permit. After discussion, it was decided to issue separate permits for this facility and for
Connestee Falls WWTP #1. There is no need for you to submit a separate application; we will use
your existing application for this request and to renew the permit for WWTP #1.

Renewal Request
Dear Mrs. Sprinkle,
March 24, 2010
Please find enclosed Application and attachments and consider this letter as our official request to renew the NPDES permit for
the facility referenced above.
This permit is a bit unusual as it has two separate discharges from two physically separated treatment facilities under one
permit. We have tried to provide the data required in the application for both discharges as clearly as possible.
With this application, we are hereby requesting expansion of permitted flow for discharge No. 2. The Engineering Alternatives
Analysis in triplicate is enclosed along with the required fee. It is our intention to ensure that the permitted capacity of this
discharge is large enough to handle the presently permitted eventual build out of the service area to this plant but we do not
anticipate the need for physical plant expansion for quite some time.
We hope you find this information complete. However, if you should have any questions or need any additional information,
please do not hesitate to call me at 704-319-0517 or by email at milashua@uiwater.com
Thank you in advance for your attention.

Sludge Management Plan
Dear Mrs. Sprinkle,
As sludge and other solids are generated at plant No. 1 (discharge No. 1), they are dewatered using a dewatering box
and hauled by a contractor, Republic Waste, to an approved landfill. As solids are generated by plant No. 2 (discharge No. 2)
the solids are disposed of using a local hauling contractor, Mikes Septic.
Other local contractors are available should Republic Waste or Mikes Septic be unable to meet a schedule or our needs.
If you should have any questions or need any additional information, please do not hesitate to call me at 704-319-0517 or by
