The Division of Water Quality (the Division) has noted several errors in your permit, recently effective
January 1, 2008. Attached, please find change pages to correct these errors.
We have revised texts describing the receiving stream on both the permit Cover Page and Supplement
to Cover Page. Your facility map has been edited to include the correct facility to'bation. Lastly, we
have edited text in permit Section A. (L) and added a footnote to the effluent -monitoring table
providing for "Grab" sample collecting in lieu of "Composite" sampling. This option is afforded you
under state regulations [15A NCAC 2B.0505 (C)] because your permitted flow does not exceed 0.03
MGD.
Please discard the old pages of your existing permit and include these new pages. These changes are
effective immediately.
If any requirements addressed in this permit modification are unacceptable, you have the right to
adjudicate them by requesting a hearing within thirty (30) days after receiving this letter. Your request
must take the form of a written petition conforming to Chapter 150B of the North Carolina General
Statutes, and must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may
require modification, or revocation and re -issuance of this permit. Please notice that this permit does not
affect your legal obligation to obtain other permits required by the Division of Water Quality, the Division
of Land Resources, the Coastal Area Management Act, or other federal or local governments.

to receiving waters designated as Filbert Creek (Pembroke Creek) in the Chowan River Basin in
accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III, and IV hereof.
This permit shall become effective January 1, 2008.
This permit and authorization to discharge shall expire at midnight on November 30, 2012.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this pernut issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.
The Town of Edenton
is hereby authorized to:
1. continue to operate an ion -exchange potable water treatment system with discharge of filter
backwash, located at the Beaver Hill Water Treatment Plant, Dr. Martin Luther King, Jr.
Avenue, Edenton, in Chowan County, and
2. discharge from said treatment works, at the locations specified on the attached map, into Filbert
Creek (Pembroke Creek), a waterbody classified B-NSW within the Chowan River Basin.

discharge.

5 Grab Samples -- because flow is limited at <0.030 MGD, this facility may substitute Sample Type
"Grab" for "Composite," in accordance with 15A NCAC 2B.0505 (C).
6 WET Monitoring: P/F Ceriodaphnia Chronic @ 90 % - monitor only during the months of
January, April, July, and October [See Section A. (2.)].

The Permittee shall discharge no floating solids or foam visible in other than trace amounts.

A. (2). CHRONIC TOXICITY (QUARTERLY) - MONITORING ONLY
The Permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 90 %. The permit
holder shall perform quarterly monitoring using this procedure to establish compliance .�A the permit
condition. The tests will be performed during the months of January, April, July, and 6 ber.
Effluent sampling for this testing shall be performed at the NPDES permitted final effluent scharge
below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted
to the Environmental Sciences Section at the address cited above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

Dear Mr. Corporon:
On behalf of the Town of Edenton, we thank you for the NPDES Draft Permit for the Beaver Hill WTP
dated October 24, 2007. We have reviewed the draft permit and offer the following comments:
1. On the permit page titled "Supplement to Permit Cover Sheet" and on the Facility Location Map, the
name of the receiving stream is listed as "Filbert Creek". On previous permits and in the application,
this stream is referred to as "Filbert Creek (Pembroke Creek)".
2. On the table titled "A. (1). EFFLUENT LIMITATIONS AND MONITORING REQUIREMENT'S",
the following effluent characteristics are listed without a measurement frequency: Total Dissolved
Solids, Temperature, Salinity, Conductivity, and Dissolved Oxygen. From a reading of Table 5.1 of
the NPDES Permitting Strategies for Potable Water Treatment Plants referenced in your cover letter,
it appears these effluent characteristics should be monitored once monthly since our permitted flow is
less than 0.5 MGD and since these parameters are not limited in by the permit. Please confirm.
3. On the same table titled "A. (1). EFFLUENT LIMITATIONS AND MONITORING
REQUIREMENTS", several parameters require sampling 50 feet upstream (U) of the outfall and 100
feet downstream (D) of the outfall. Access to these locations is limited by woods and standing water
and is frequently not practical for our operators. We request that the upstream sampling location be
listed as the intersection of the creek with West Hicks Street. Similarly, we request the downstream
location be listed as the intersection of the creek with Dr. Martin Luther King, Jr. Avenue.
4. On the same table titled "A. (1). EFFLUENT LIMITATIONS AND MONITORING
REQUIREMENTS", three effluent characteristics — Total Nitrogen, Total Phosphorus, and Whole
Effluent Toxicity — are required to be sampled by composite. Note I from Table 2.2 from the
referenced NPDES Permitting Strategies for Potable Water Treatment Plants states the following:
"An exception to the composite sampling is provided by 15A NCAC 213.0505 (C), which states that
facilities with design flows under 30,000 gallons per day may use grab samples to characterize their
effluent." Since the permitted flow at the treatment plant is 10,000 gallons per day, the town intends
to use grab samples to characterize the plant's effluent where "Composite" samples are required in
the permit.
