Thank you for your notification for 401 Water Quality Certification #6386 dated November 1,
2023, issued by the North Carolina Division of Water Resources. This notification is
associated with the Dudley Mill Pond Mitigation Site project in Cumberland County, NC
for Clean Water Act Section 404 Permit Application SAW-2018-02160. The EPA Region 4
Oceans, Wetlands and Streams Protection Branch considered the potential for water quality
impacts to a neighboring jurisdiction from the project as certified. EPA will not issue a “may
affect” determination for this project pursuant to CWA Section 401(a)(2).

Thank you for the opportunity to provide analysis and feedback on the aforementioned Section
401(a)(2) notification.

ALCON,

Please find the attached 401 certification for your review. This certification was issued for repairs at
the Wildlands Cape Fear 05 UMB- Dudley Mill Pond Mitigation Site. Wildlands plans to complete
repairs under a non-notifying NWP-3 and will therefore not require a 404 permit from the Corps of
Engineers, Wilmington District.

The Dudley Mill Pond Mitigation Site is a 45.9-acre stream and wetland mitigation site. The Site is
located in the township of Cedar Creek in Cumberland County, North Carolina (34.957194,
-78.751694). Please note this certification (WQC006386) is to authorize repairs associated with the
previously constructed stream and wetland mitigation site.
