Mr. Hyde:
Division staff has confirmed that the subject permit is no longer required. Therefore, in accordance with
your request, NPDES Permit NCO073962 is rescinded, effective immediately.
If in the future Mayland Community College wishes to discharge wastewater to the State's surface
waters, they must first apply for and receive a new NPDES permit. Discharge of wastewater without a
valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.
If you have questions about this matter, simply reply to this message.

Yes, go ahead and rescind permit NC0073962.
I spoke with Mr. Hyde to make sure he understands what rescission means if he has any future plans for this facility. He
understands and wants to rescind.
I also spoke with Wanda Frazier. She was last person to inspect this facility. She said the facility has been inactive for
many years and rescission is acceptable.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
The Mayland Community College is hereby authorized to:
1. Continue to operate an existing 0.007 MGD extended aeration package wastewater
treatment facility with the following components:

♦ Communitor
♦ 7363-gallon aeration basin with dual 35-cfm blowers providing diffused air
♦ 1217-gallon clarifier with skimmer and sludge return
♦ 1071-gallon aerobic sludge digester
♦ Ultraviolet disinfection
♦ Portable standby power generator
The facility is located at the Blue Ridge Youth Center, on Prison Camp Rd
southwest of Altamont in Avery County.
2. Discharge from said treatment works at the location specified on the attached map
into Threemile Creek, currently classified WS-IV-Trout waters in hydrologic unit
06010108 of the French Broad River Basin.

then all interests granted herein shall automatically revert to Grantor, without any further action
by Grantor or Grantee, restoring fee simple absolute title in the Property to Grantor. In such
event, Grantee shall have the right to remove all of its personal property from the Property at its

Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
This final permit includes the following changes from the draft permit sent to you on

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)

issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended). The following changes have been incorporated into this final
permit:

I called Bill Stovall, Director of Engineering for DOC. That
facility is NOT connected to sewer, but is currently inactive;
its prisoner population was removed. DOC wants to maintain the
permit, as they have plans for a training center at that site.
There's no sewer available [according to Stovall], so DOC wants
to keep the permit.
I'll set the outfall to inactive on BIMS. Hopefully that will
keep it from hunting for DMRs.

I recieved the NPDES permits to review on October 12, 2001. One was reviewed
in September 2001, I don't know what happened there, but I just redated it
with an old date.
I have forwarded those back to Raeigh on Monday 15 October, But the Secretary
did not send them out until the 17th. I hope that helps everyone.

A letter of request for an Authorization to Construct was received June 2, 1997 by the Division.
Final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of a grease trap, an aerated flow equalization basin,
duplex grinder pumps, a blower and all associated controls, piping and appurtenances for the above
referenced project with discharge of treated wastewater into Threemile Creek in the French Broad River
Basin. This Authorization to Construct is contingent on the installation of a one inch (1 ") drain in the
equalization basin.
This Authorization to Construct is issued in accordance with Part III, Paragraph A. of NPDES
Permit No. NCO073962 issued November 25, 1996, and shall be subject to revocation unless the
wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in
Permit No. NC0073962.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Water Quality.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Asheville Regional Office, telephone number (704) 251-6208, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional office shall be made during the normal office hours from 8:00 a.m.
until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and

Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The
Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit Class I facilities at least
weekly and Class II, III and IV facilities daily, excluding weekends and holidays, and must properly
manage and document operation and maintenance of the facility and must comply with all other conditions
of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Permittee must submit a letter to the
Certification Commission which designates the operator in responsible charge within thirty days after the
wastewater treatment facilities are 50% complete.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The Operational Agreement between the Permittee and the Environmental Management
Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the
terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-
215.E for violation of or failure to act in accordance with the terms and conditions of this Permit.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

for the construction of a 7,000 gallon "extended aeration" wastewater treatment
facility consisting of a bar screen, comminuter, 7,363 gallon aeration tank, 1,217
gallon clarifier, 1,071 gallon sludge holding tank, (2) two 35 cfm blowers,
ultraviolet disinfection system and all related pipes, valves and appurtenances to
serve the B.R.I.D.G.E Camp.
This Authorization to Construct is issued in accordance with Part III paragraph
B of the NPDES Permit No. NCO073962 issued August 1, 1988, and shall be subject
to revocation unless the wastewater treatment facilities are constructed in
accordance with the conditions and limitations specified in Permit No. NC0073962.
The Permittee must employ a certified wastewater operator in accordance with
Part III paragraph C of the referenced permit.
The sludge generated from these treatment facilities must be disposed of in
accordance with G.S. 143-215.1 and in a manner approvable by the North Carolina
Division of Environmental Management.

notified at least twenty-four (24) hours in advance of operation of these
facilities. Such notification to the Regional Supervisor shall be made during the

Please take notice that this permit is not transferable except after notice to the Division of Water Quality.
Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this
discharge. The Division of Water Quality may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management
