However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on December 4, 2023. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items in Sections A through O, or failure to provide the additional information on or before the above -requested date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(c)(2). Please reference the subject application number when providing the requested information. However, review of the facilities on the Duplin County GIS website indicates irrigation area on parcel numbers 12-909 and 12-121 owned by Johnson Breeders, Inc. The response to Attachment G states that the Permittee owns all land associated with the wastewater system, including the wastewater treatment system. Review of the facilities on the Duplin County GIS website indicates that parcel number 12-1942, which contains the 7.755 million gallon (MG) and 8.175 MG facultative lagoons, is owned by Rose Hill Poultry Corporation. In accordance with NCAC 02T .0116(c), provide a copy of any easements, lease agreements, or encroachment agreements for installation, operation and maintenance of the wastewater collection and treatment facilities on land not owned by the Permittee. This property ownership documentation shall meet the requirements of 15A NCAC 02T .0504(f), and shall consist of one of the following: 1) legal documentation of ownership, such as a contract, deed, or article of incorporation; 2) an agreement of an intent to purchase the property that is written, notarized, and signed by both parties, accompanied by a plat or survey map; or 3) an agreement to lease the property that is written, notarized, and signed by both parties, indicating the intended use of the property, accompanied by a plat or survey map. Lease agreements shall adhere to the requirements of 15A NCAC 02L .0107. 2. The response to Attachment G states that the Permittee owns all land associated with the wastewater system, including the wastewater irrigation system. Review of the facilities on the Duplin County GIS website indicates that irrigation area is located on parcels 12-909 and 12-121 owned by Johnson Breeders, Inc. and parcels 12-1887, 12-1888, 12-1934, and 12-1954 owned by Nash Johnson & Sons' Farms, Inc. In accordance with NCAC 02T .0116(c), provide a copy of any easements, lease agreements, or encroachment agreements from both landowners for installation, operation, and maintenance of the wastewater irrigation facilities on land not owned by the Permittee. This property ownership documentation shall meet the requirements of 15A NCAC 02T .0504(f), and shall consist of one of the following: 1) legal documentation of ownership, such as a contract, deed, or article of incorporation; 2) an agreement of an intent to purchase the property that is written, notarized, and signed by both parties, accompanied by a plat or survey map; or 3) an agreement to lease the property that is written, notarized, and signed by both parties, indicating the intended use of the property, accompanied by a plat or survey map. Please note that this irrigation area is considered a part of the compliance zone of this facility, and any lease shall adhere to the requirements of 15A NCAC 02L .0107. The requirements of 15A NCAC 02L .0107(k) state that the landowner of the land within the compliance zone, if other than the permittee, shall: "execute and file in the Register of Deeds in the county in which the land is located, an [compliance boundary] easement running with the land that contains either a notice of the permit, including the permit number, a description of the type ofpermit, and the name, address and telephone number of the permitting agency" Ms. Nicole Reynolds November 3, 2023 Page 4 of 4 J.
