The Site is located within the Hydrologic Unit Code (HUC) 03020201020010 and DWR Subbasin 03-04-01. The proposed project includes stream and wetland mitigation and is being submitted for buffer and nutrient offset mitigation in accordance with the Consolidated Buffer Mitigation Rules (15A NCAC 02B .0295) and the Nutrient Offset Rules (15A NCAC 02B .0703). In addition to North Fork Little River, the Site contains five unnamed tributaries and two ephemeral channels that, for the purpose of this project, are referred to as Rocky Creek, Lathan Branch, Kitty Branch, Spike Branch, T1, E1, and E2. Spike Branch begins as an ephemeral channel (E2), then turns into an intermittent stream. E1 is an ephemeral channel that drains to Rocky Creek. T1 is an intermittent stream that drains to North Fork Little River. Rocky Creek and Kitty Branch begin as intermittent streams, then become perennial. North Fork Little River and Lathan Branch are perennial streams throughout the Site. All project streams flow to North Fork Little River, which is classified as a Water Supply II Water (WS-II), a High -Quality Water (HQW), and a Nutrient Sensitive Water (NSW). The Site is currently an active livestock operation with sparsely wooded buffers along project streams. A review of historical aerials from 1938 to 2020 shows that land use has remained mostly consistent over time. Between 1993 and 1999, a small portion of the forested buffer was cleared along Rocky Creek. Existing riparian area conditions vary across the Site, with a feature completely surrounded by forest, features having a forested buffer extending greater than 50 feet on one side, and a narrow to non- existent forested strip on the other, and some features having no riparian buffer aside from mixed herbaceous vegetation along the banks and the occasional tree or shrub. Mitigation work will include the restoration of riparian areas that are currently occupied by pasture, enhancing existing forested areas through livestock exclusion, and the preservation of existing forests. Restoration, enhancement, and preservation of the riparian areas up to 200 feet from project streams and ephemeral channels will filter overland flow and uptake nutrients, thereby reducing sediment and nutrient inputs within the project area. Additionally, habitat will be created and preserved in the form of functional riparian forests. Shelton Sullivan and Samantha Wooten with DWR, and Kaitlyn Hogarth with Wildlands were present for the site visit. The Division of Water Resources has determined that the features listed as "subject" in the table below and identified on the attached maps are shown on either the most recently published County NRCS Soil Survey of and/or the USGS National Map at a scale that incorporates the National Hydrography Dataset High Resolution data at 1:24,000 scale. In addition, the features listed as "subject" on the below table have been located on the ground at the site and possess characteristics that qualify them to be at least intermittent streams in accordance with the NC Stream Identification Manual v.4.11 and therefore subject to the Nuese Buffer Rules. Please be aware that features identified as "not subject" may be considered jurisdictional according to the US Army Corps of Engineers and subject to the Clean Water Act.
