Director Division of Water Quality January 16, 2007 CERTIFIED MAIL: 7005 0390 0001 3200 5502 RETURN RECEIPT REQUESTED David Greer 136 Skystasail Drive Wilmington, NC 28409 Subject Property: Dear Mr. Greer: DWQ Project # 050046 Ver 2 Pender County REQUEST FOR MORE INFORMATION Sloop Point Plantation Modification of boat slips On November 27, 2006, the Division of Water Quality (DWQ) in the Wilmington Regional Office (WiRO) received your LAMA application dated November 27, 2006 and additional information received on January 8, 2007 to dredge 9 boat slips at an existing dock structure. The proposal includes new dredging around the 9 existing slips. The Division of Marine Fisheries (DMF) has determined that a portion of the new dredging contains Submerged Aquatic Vegetation (SAVs). Because dredging in this area would result in significant adverse impacts to SAVs, this Office has determined that significant uses could be removed or degraded by this project. Therefore, unless modifications of the proposal are made, we will recommend moving towards denial of the 401 Water Quality Certification as required in 15A NCAC 2H.0507. We strongly encourage you to revise your project to remove the portion of the new dredging that impacts the SAVs. If the project is modified to address dredging only in areas outside the SAV habitat, DWQ will have no objection to the project. Please respond within three weeks of the date of this letter by sending this information to me in writing and 5 copies of the information to Ian McMillian of the DWQ Oversight Unit Office. You will also need to send copies of the changes to the Division of Coastal Management (DCM) and Dave Timpy of the Wilmington Corps of Engineers. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
