Buffer Mitigation &/or Nutrient Offset Site Viability Assessment Request

Site Description:

The Pancake Mitigation Bank project consist of approximately 24 acres of privately held land,
which will be placed in a conservation easement. The Mitigation Bank includes wetlands,
forested, and agricultural lands. The site consists of three ditches and one stream reach. The
site will be planned and designed according to the Consolidated Buffer Mitigation Rule 15A
NCAC 02B .0295, which became effective on November 1, 2015.

Restoration Systems, LLC previously submitted and received a stream determination (dated
February 5, 2016) and site viability request (dated February 18, 2016 & August 18, 2016) for
this site. All existing documentation was reviewed by Water & Land Solutions (WLS) prior to this
current submittal.

Attached are three Google Earth photos of the project site from the years 1993, 2006 and 2016.
Also included are maps with the latest imagery showing the site parcel, proposed conservation
easement, and existing aquatic resources.

Location: Lat., Long: 35.388009, -78.148077 Dear Ms. Roland: On September 14, 2023, Shelton Sullivan of the Division of Water Resources (DWR) conducted an on-site review of feature(s) located on the Pancake Mitigation Bank Site at the request of Water & Land Solutions to determine the presence of streams and the applicability of features on the site to the Neuse River Riparian Area Protection Rules, Title 15A North Carolina Administrative Code 02B .0714. Blake Hartshorn with DWR, Daniel Ingram and Kyle Obermiller with Water & Land Solutions were present for the site visit. The Division of Water Resources has determined that the features listed as “subject” in the table below and identified on the attached maps are shown on either the most recently
published County NRCS Soil Survey of and/or the USGS National Map at a scale that incorporates the National Hydrography Dataset High Resolution data at 1:24,000 scale. In addition, the features in the below table were evaluated in accordance with the NC Stream Identification Manual v.4.11. Please be aware that features identified as “not subject” may
be considered jurisdictional according to the US Army Corps of Engineers and subject to

This on-site determination shall expire five (5) years from the date of this letter. The owner (or future owners) should notify the Division (and other relevant agencies) of this decision in any future correspondence concerning this property. Landowners or affected parties that dispute this determination made by the Division may request a determination by the Director of Water Resources. This determination is final and binding unless an appeal
request is made within sixty (60) calendar days of the date of this letter to the Director
in writing.
