This final permit contains no significant changes from the draft you were sent on February 16, 2005. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. ACUTE TOXICITY PASS/FAIL MONITORING (Quarterly) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity En A Single Effluent Concentration" (Revised July,1992 or subsequent versions). The monitoring shall be performed as a Mysid shrimp (Mysidopsis Bahia) 24-hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July & October. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE3E. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which tonicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Add monthly effluent monitoring requirements for temperature, salinity, conductivity, DO, TDS, chloride, NH3, and TN based on new permitting strategy for membrane water treatment plants. 2.0 Summary This is a renewal for an existing membrane filtration water plant for the Town of Belhaven. This permit was first issued in 1999 and a number of limits and monitoring requirements were included based on expected effluent characteristics. For this renewal the permit will be further tailored based on the results of those tests, as well as to align with the current membrane WTP strategy. 3.0 Compliance Summary DMR Data Review DMRs were reviewed for the period of January 2003 through November 2004. It appears that data was only submitted for the limited parameters. Therefore there is no information on parameters with only monitoring requirements (beryllium, copper, salinity, silver, zinc, fluoride, iron, TRC and instream dissolved oxygen). Limited data is available for pH monitoring. No violations were ever issued for these omissions. NPDES Permit Fact Sheet — 2/9/2005 Page 2 Town of Belhaven WTP NCO086584 Reported values for arsenic, cadmium, cyanide, lead, settleable solids, and selenium were all below their respective detection levels; therefore the limits and monitoring requirements for those parameters will be removed. RPA Analysis RPAs were performed for chromium, mercury and nickel. The limit and monitoring requirements for mercury will be removed, as there is no reasonable potential for the facility's discharge to cause a water quality violation for this parameter. The limit and monitoring requirement for chromium will be removed. An initial RPA performed for this parameter using 16 data points and only 3 detects yielded a maximum predicted value of 25.8 µg/L. This is above the allowable limit of 20 µg/L. However, it appears that the actual maximum reported value is only 10 µg/L and in this case the high number of values below the detection level had an effect on the dataset. Rather than taking these values as 1h BDL (2.5 µg/L), the DL was used (5 µg/L). This yielded a maximum predicted concentration of 14.6 µg/L, which is below the allowable concentration. Additionally, according to the new permitting strategy for membrane water treatment plants, chromium is not a parameter of concern. Three of the 16 nickel measurements showed values at or above the detection level. Two were at 10 µg/L, once was at 12 jig/L. Although nickel is not listed as a parameter of concern in the current permitting strategy, it appears that it may be an issue at this facility. Therefore the limit and monitoring requirement will remain in this permit. WET Test Results The Belhaven WTP has a quarterly acute monitoring requirement using an effluent concentration of 90% and mysid shrimp. The first tests were taken in 2004. The WTP passed 3 of the first 4 tests conducted. Although they failed in October 2004, they passed the test taken the following month. Correspondence File Review/Compliance History Correspondence files were reviewed for the period of 2002-2004. Although it appears that the facility did not monitor for parameters no limited in the permit, they did not receive violations for this. There was one WET failure in October 2004, however the test is monitoring only so it does not constitute a permit violation. Wilkerson The Town of Belhaven operates a membrane filtration groundwater Treatment facility in beaufort county. There are three wells that supply Raw water to our plant. Well 92 is out of service for repairs. Each well draws water from the Yorktown Aquifer. Groundwater enters the plant where it is treated with 93% sulfuric acid to lower pH to 6.5-SU. This converts the sulfides to carbonates. Scale inhibitor is also injected it helps keep scale and silica from building on the membrane surfaces. The name of this chemical is Hypersperse MDC 700. A total of two skids treat the in coming feed water. Each skid will produce 150 gpm. of Permeate and 50 gpm, of Concentrate (wastewater). The total wastewater produced from both skids is 1.00 gpm. A pH of 7.0 standard units is the average of the Concentrate going to waste. The Permeate leaves the skids at a rate of 150 gpm. per skid and enters a aerator where the converted sulfides are vented to the atmosphere. Leaving the aerator the Permeate enters a final treatment stage where Sodium Hydroxide 25% and Sodium Hypochlorite 12.5% are injected. In respective order pH is raised to 7.6 to7.8 standard units and a disinfectant is added to a total of 1.5 ppm. This drinking water then enters a 300,000 gallon holding tank to meet the chlorine demand then is pumped to the Town of Belhaven for consumption. No facility changes are seen in the next five years. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy this requirement, your renewal package should have been sent to the Division postmarked no later than June 3, 2004. The Division has not received a renewal request for the subject permit. This is a violation of your permit at Part It. B. 10., which states "Any permittee that has not requested renewal at least 180 days prior to expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33 USC 1251 et. seq.". In order to prevent an assessment of civil penalties you must submit a completed permit application (see enclosed forms). Submit the completed application package to the address listed at the bottom of this page. If the Division receives no response by November 22, 2004, enforcement action will proceed against the Town of Belhaven. Use the enclosed checklist to complete your renewal package.
