In addition, authorization is concurrently granted for the operation of the existing dewatering remediation system (which currently discharges to the CMUD wastewater treatment system), following construction of a new effluent pipeline to a surface water discharge point. Specific conditions and limitations are listed below. NPDES Permit Issuance This NPDES permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. Authorization to Construct A letter of request for an Authorization to Construct was received by the Division on February 11, 1999, and final plans and specifications for the subject project have been reviewed and found to be satisfactory. Authorization is hereby granted for the construction of an effluent pipeline from the existing 0.050 MGD dewatering remediation system at the NationsBank Operations Center, Gateway Village Phase 1, with discharge of treated groundwater into Irwin Creek (via a storm sewer system) in the Catawba River Basin. NPDES No. NC0086517 ATC No. 086517ACA March 29, 1999 Page 2 of 4 Specifically, this authorization is for the following construction and operation activities: • Construction of a new effluent pipeline from the existing dewatering remediation system, to a storm sewer system discharging into Irwin Creek. • Installation of a continuous flow recording unit. • Following construction activities, operate the dewatering remediation system consisting of the following treatment components: surge/transfer tank; dual bag filters; dual liquid -phase granular activated carbon vessels; flow metering devise; control panel; transfer/sump pumps; and associated piping/appurtenances. This Authorization to Construct is issued in accordance with Part III.A. of NPDES Permit No. NC0086517 issued March 29, 1999, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NC0086517. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G.S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this permit. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The ORC must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. In the event that the facility fails to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Mooresville Regional Office, telephone number (704) 663-1699, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an on -site inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct, and the approved plans and specifications. Mail -the completed certification to: North Carolina DENR-DWQ, NPDES Unit, P.O Box 29535, Raleigh, NC 27626-0535. One (1). set of approved plans and specifications is being forwarded to you. Permit No. NCO086517 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 90% (defined as treatment two in the procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of January, April, July, October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. The subject site, located in downtown Charlotte, is the proposed location for a multi -story commercial, retail, and residential complex, with construction scheduled to begin September 1998. Due to previous activities at the site (including a gas station), groundwater has been impacted by dissolved -phase petroleum and chlorinated solvent constituents. Proposed discharge to surface water will include construction dewatering, followed by long- termpermanent building dewatering. Since the collected groundwater maybe contaminated, the applicant plans to install a groundwater remediation treatment system to treat aworst-case flow of 0.05 MGD. A bentonite slurry wall is proposed to be installed around the planned construction excavation area. The applicant has received a temporary 6-month discharge permit from the local POTW (CMUD), on the condition that they secure an NPDES permit for the long-term operation. Receiving Stream. The proposed discharge is to a storm sewer, with indirect discharge to Irwin Creek, located 1700 feet northwest of the site. NPDES policy is to treat storm sewers as a zero -flow discharge. Irwin Creek is classified C water in the Catawba River Basin. Irwin Creek is not listed in the 1998 303(d) list. However, Irwin Creek is listed as impaired (PS) in the 1995 Basm Plan. The Basin Plan reports that Subbasin 34 is impacted by urban stormwater from the Charlotte area, as well as wastewater inputs from three major municipal dischargers. The Regional staff report noted the presence of several fish (>50) at the storm sewer discharge point, and a public park with limited access to Irwin Creek located directly downstream of the proposed discharge point. Irwin Creek flows to Sugar Creek, then across NC/SC border. Engineering Alternatives Analysis (EAA). As part of the NPDES application for a new discharge (received 9/9/98), LAW Engineering briefly evaluated other discharge alternatives. Due to site location in downtown Charlotte, nondischarge options are not feasible. CMUD is allowing discharge to their POTW on an interim basis only. Therefore, surface water discharge appears to be the only discharge option. Waste Load Allocation (WLA). Evaluate as discharge to zero -flow stream; therefore, no WLA is necessary. Permit limits will be same as applicable WQStd/criteria (see Table 1 below). Max GW concentrations based on single sampling round at several monitoring wells. Detections of BTEX were from well located outside of proposed construction slurry wall. Although consultant claims slurry wall will retard BTEX migration to site, I have included BTEX in permit as a conservative approach. Current permitted capacity: An NPDES permit has not been issued for this facility. This Office submitted a staff report to Charles H. Weaver, Jr. of the Permits and Engineering Unit regarding the NPDES permit application on October 19, 1998. b. Date(s) and construction activities allowed by previous ATCs issued in the previous two years: This is a new facility. c. Actual treatment capacity of the current facility (design volume): 72,000 GPD (based on treatment rate through the activated carbon canisters) d. Description of existing or substantially constructed WWT facilities: The system described in the NPDES and ATC application has been constructed and began operation in December 1998. The system currently discharges into the sanitary sewer system operated by the Charlotte Mecklenberg Utilities Department (CMUD). Actual flow through the treatment system has averaged between 35,000 and 50,000 gpd. 2. Type of Proposed Treatment Facility: The system will be used for dewatering the basement of a building and will consist of one 700 gallon transfer tank, one dual bag filter for sediment filtration, and two 1,000 pound activated carbon canisters connected in series. 3. Residuals Handling and Utilization/Disposal Scheme: Management of the spent carbon has been contracted to Tetrasolv, Inc. Tetrasolv will collect the spent carbon and take it to Calgon where it will be analyzed for hazardous materials. If the carbon is determined hazardous, it will be disposed of at one of Calgon's hazardous waste facilities. Important SOC/JOC or Compliance Schedule Dates: N/A Gateway Village ATC - MRO Staff Report Page 3 PART III - EVALUATION AND RECOMMENDATIONS The system described in the ATC application has been constructed and in operation for three months (discharging to CMUD's sanitary sewer). Mr. Michael Armour stated that contaminant breakthrough did occur for tetrachloroethene during the beginning of February 1999. The cause of the breakthrough was identified as increased levels of sediment from construction activities which spent the carbon canisters more quickly than anticipated. Mr. Armour stated that finer mesh bag filters were installed to further limit the amount of sediment reaching and depleting the carbon. Increased sediment loading should not continue to be an issue upon completion of foundation construction activities at the site. While the system appears to be handling the current groundwater contaminant concentrations adequately, the effluent should continue to be monitored for toxicity. Due to the limited amount of groundwater assessment data, it is difficult to predict when and if slugs of groundwater with higher contaminant concentrations may reach the system and cause breakthrough. Therefore, toxicity monitoring should be required until such time that there does not appear to be a threat to the receiving stream by way of exposure to fish and/or people visiting the downstream public park. CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 90% (defined as treatment two in the procedure document). The permit holder shall perform quarteft monitoring using this procedure to establish compliance with the permit condition.
