Martin, Regulatory Specialist Re: Action ID SAW-2017-00326 Dear Matthew: The Eastfield team is submitting this letter in response to the RFIA requested your letter dated September 16, 2023 to Mr. Kevin Dougherty of Eastfield Associates, LCC. Our team consists of the developer, Eastfield Associates, The project Civil Engineer, Gateway Engineers, Terracon as the lead environmental consultant and Modulus the supporting environmental consultant. The purpose of this correspondence is to provide a r esponse for each comment and provide supporting documentation. The comments from your letter have been reiterated below in italics, immediately followed by the team’s response. A. Permits for work within wetlands or other special aquatic sites are avail able only if the proposed work is the least environmentally damaging, practicable alternative (LEDPA). Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. The Eastfield Project has been the subject to ongoing planning and site design since 2007 and has been reviewed by USACE and NCDWR under several permit action submittals, including issuance of JD documents and Section 404/401 approval to construct a portion of Providence Boulevard as well as approval to install water and sewer infrastructure to serve Block M. Most of the work applied for in this current application is associated with roadway infrastructure, much of which is being required by NCDOT to improve the intersection at US 70A and US 70. The roadways have been designed to avoid and minimize impacts as demonstrated on the site plans currently under review. The overall siting of mixed-use facilities has been carefully planned within the Eastfield site to avoid impacts to aquatic resources. The impacts proposed are not designed to create more developable space but are dictated by transportation and utility connectivity of the site as required by NCDOT and local jurisdictions. B. It is necessary for you to have taken all appropriate and practicable steps to minimize losses of Waters of the U.S., including wetlands. Please indicate all that you have done, 2 especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. Please see responses in items 3 -8 below C. The MOA requires that appropriate and practicable mitigation will be required for all unavoidable adverse impacts remaining after the applicant has employed all appropriate and practicable minimization. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such a ppropriate and practicable measures. Please see response in item 2 below 1.) It is unclear, based on the information provided, that the Preferred Alternative is the LEDPA when compared to the other alternatives. a.) Siting Criteria- Please provide more defined siting criteria for the project. Currently the siting criteria does not indicate a required lot size or location. For example, were locations adjacent to major transportation corridors the siting criteria for the preferred alternative or was siting focused on the general Selma area. The idea for Eastfield included a 3.0 million sq. ft. master planned, mixed -use development comprising a business park, retail, medical, professional space, hospitality, entertainment, senior living as well as single- and multi-family residences, ideally situated on 400 +/- acres of contiguous land. As reported by the Johnston County Economic Development Board, Johnston County is the fastest growing county in NC, with over 205,000 current residents and is growing at a pace of 10,000 residents per year. This growth has created a need for this type of facility in Johnston County. Unlike many small towns in North Carolina, Selma is in a growing and relatively prosperous county and is connected to the economic opportunity of the Research Triangle Region. However, the same transportation infrastructure t hat benefits the town also means that residents have choices and can travel outside Selma for shopping and services. Selma has often seen itself as the outlier of Johnston County. Therefore, the Selma area was chosen for the siting for Eastfield to meet th e needs of the local community and economic development goals of Johnston County. Considering the planned mixed -use development of Eastfield, the ideal siting required nearby connections to both major transportation corridors and rail access. Based on these acreage and transportation requirements, the current location became the Preferred Alternative. 3 b.) Onsite Alternative – Please provide an onsite alternative for the project. Currently, the applicant has chosen not to provide an onsite alternative, sta ting it would not meet the stated purpose and need. Onsite alternatives are required under 404(b)(1); 40 CFR 230.94(c)(3). If cost is the basis for this alternative not being practicable, please provide the cost -benefit analysis to support the Corps decisi on. The entirety of the Eastfield Development has been designed to avoid impacts to the extent possible, while also balancing the connectivity of the developable space of the project. The proposed development in Block O has been redesigned as an on -site alternative to minimize impacts to jurisdictional features in this area. The impacts proposed are not designed to create more developable space but are dictated by transportation and utility connectivity of the site as required by NCDOT and local jurisdictions. c.) Offsite Alternative “Selma Site” –- Please provide additional information to support the decision that this alternative is not practicable or more environmentally damaging. It is stated in your application that this alternative does not meet the basic purpose and need of the proposed project, therefore it is not a practicable alternative. In order to be practicable, an alternative must be available, achieve the overall project purpose (as defined by the Corps) and be feasible when considering cost, logistics and existing technology. Additionally, for proposed alternatives a description of the proposed actions impacts on wetlands and waters in a manner that is comparable to the preferred alternative. The Selma Site was evaluated as a potentia l alternative; however, the overall size and configuration of the site does not lend itself to be a potential LEDPA based on the extent of the potential wetlands on the site. Limited road frontage, compared to the preferred site, limits the area that would be utilized for retail uses. To utilize the site fully, potential wetland impacts could exceed 20 acres based on presence of the large wetland system crossing the middle of the site. Avoiding this large wetland area would result in insufficient area to develop that would not meet the applicant’s purpose and need for a mixed-use development. Additionally, ingress and egress points would be severely limited as the main road frontage is against I -95 causing severe limitations to provide adequate access to the site through areas are not available to the applicant. d.) Offsite Alternative “RRT Investment Site" – Please provide additional information to support the decision that this alternative is not practicable or more environmentally damaging. It is stated in your application that this alternative does not meet the basic purpose and need of the proposed project, therefore it is not a practicable alternative. In order to be practicable, an alternative must be available, achieve the overall project purpos e (as defined by the Corps) and be feasible when considering cost, logistics and existing technology. Additionally, for proposed alternatives a description of the proposed actions impacts on wetlands and waters in a manner that is comparable to the preferr ed alternative. The RRT Site comprises 110-acres and is in Pine Level. The site is located adjacent primarily to secondary roads which would not provide for the type of access that a 4 large mixed-use site, as proposed by the applicant, would require. T he site is approximately 2 miles from I -95, which is one of the main criteria used to select the Eastfield site. Although our assessment does suggest than the RRT Site does not appear to contain significant amounts of wetlands and streams and impacts may b e less than the preferred site, the overall size of the site does not meet the applicant’s purpose and need. The surrounding land use is primarily agriculture and single -family homes and the RRT site does not currently have the type of zoning necessary for a mixed-use development as being proposed at the Eastfield site. 2.) It is unclear, based on the information provided, what mitigation is provided. Please include a mitigation statement, and compensatory mitigation plan that identifies intended mitigation mechanism and proposed mitigation ratios. The applicant has secured Statements of Availability from a private mitigation bank as well as from NCDMS. Currently these SOAs suggest that wetland mitigation credits to cover up to 3.56 acres of wetland impact can be secured. This 3.56-acre amount of impact was presented in initial application prior to the impact reductions detailed in this submittal. Additional avoidance and minimization measures have been taken by the project team and total wetland impact s proposed are now 3.031 acres. The applicant is assuming the standard 2:1 wetland mitigation ratio for the remaining project impacts. Stream impacts in Block E have been added to the proposed action and total 0.123 acre of stream bed disturbance. Terrac on will secure an SOA to address the required stream mitigation and will forward that to you under separate cover. Please refer to the overall impact drawing for total site impacts. 3.) During a site visit on September 12, 2023, changes occurred to the ex tent of aquatic resources present at the preferred alternative site. Specifically, a feature in Block O was removed and a potential stream feature in Block E was added. Please revise plans and impact quantities to reflect the changes during the site visit. The feature in Block O that was originally deemed a tributary was determined to be a non-JD ditch during this site visit and it has been removed from the plans. The feature identified in Block E has been added to the plans and the site design has been reconfigured to take this feature into account as a jurisdictional tributary with a 50 - foot buffer. This tributary is proposed to be impacted with two necessary road crossings to allow for adequate access throughout Block E. These proposed impacts are defined as follows:0.123 acres (5,458 SF) of stream impacts for the two proposed road crossings and stormwater pond outfalls. Stream Impact G (0.078 acres total) includes 0.062 acres of impacts from the construction of West Providence Boulevard. These impacts occurred prior to the September 12, 2023 site meeting where the feature was determined to be jurisdictional. The proposed stream crossing at the southern entrance (Impact G) will re -establish the original stream alignment. Please refer to the Block E Stre am Impact Exhibit for additional information and the table below for Block E. 5 4). It appears proposed impact 4 could result in an additional 2.32 acres of indirect impacts to a wetland at parcel K by a loss of hydrologic connection to downgradient water s. Please further detail if/how a hydrologic connection will remain to aquatic resources upgradient of impact 4. The applicant is proposing to install piping to allow for continued hydrologic connection to the wetland located at the Impact 4 site. Refer to sheet C821 from the highway improvement plans which shows the proposed 18” RCP near the intersection of Providence Boulevard and West Blanche Road. 5.) It appears proposed impact 8A appears to have less impactful alternatives to the east and west. Please elaborate on why the road must enter at the proposed location resulting in impact 8A or if plans could be modified to further avoid and minimize impacts. Impact 8A is required to mitigate existing traffic issues per the Traffic Assessment Letter (TAL) dated 9-23-20 prepared by Ramey Kemp and approved by NCDOT. Impact 8A is associated with the reconfiguration of the connection of US70 and U70A. and the location was strategically selected to provide the required capacity improve a falling intersection to adequacy based upon required Highway design standards and it represented the minimum impact to environmental resources. The traffic study referenced above was provided in the previous submittal. 6.) It is unclear, based on the information provided, the purpose of proposed impact 15. Please elaborate on the intended use and necessity of impact 15. The layout of Project Clear has been revised to minimize the impacts of the linear wetland. The original 0.567 acre of impact (Impact 15) has been eliminated after the re-design. A road crossing that will utilize and existing culverted crossing originating from past agricultural activities will be utilized to cross the wetland. The existing culvert will be extended to maintain connectiv ity between east and west below the 6 widened road. This road crossing (Impact 15) will incur 0.027 acre of impact to the wet ditch. Please refer to the Impact 15 drawing. 7.) It is unclear based on the provided “Eastfield Masterplan” the intent of the stu b road south of proposed impact 15. Please elaborate if this proposed stub road would result in future impacts. The plans have been revised to extend the stub road and account for future impacts. The stub road will be used for future access to the 14 -acre parcel to the north. 8.) In a previous application, submitted on November 4, 2022, impacts related to several residential developments were presented in Blocks I and J. Is it correct that these developments have been removed from the proposed projec t? The residential portion of the Eastfield project has been removed from the project. 9.) In order to verify compliance with Endangered Species Act of 1973 and 40 CFR 230.10(b)(3), the Corps has initiated informal consultation with The US Fish and Wi ldlife Service and will not be able to render a decision until ESA Section 7 consultation is Complete. Understood 10.) It appears that an Individual 401 Water Quality Certification (WQC) is required from the North Carolina Division of Water Resources (NC DWR) for this project. Per the 2020 CWA Section 401 Rule, the application must contain the 9 elements listed in Section 121.5(b) of the Rule. According to the 9/16/2022, Programmatic Agreement (PA) between the USACE, Wilmington District, and the NCDWR, the Reasonable Period of Time (RPOT) for NCDWR to act on a Section 401 certification request is 120 days after receipt of a certification request containing the 9 required elements. However, it appears that element 4 is not met; as such, NCDWR’s RPOT has not started yet. See item 3 above. Understood 11.) Please note that additional comments and questions may be required after review of the responses to the comments above. The project is located within the Neuse River Basin of the service area (HUC 03020201) of the Bank. This letter is simply a statement of availability of credits as of the date written. It is neither a guarantee of future credit availability, nor a guarantee of credit pricing. Credits are sold on a first come, first serve basis at the Bank’s price at the time an invoice is requested. Invoices reserve both the credits and the price for a period of 30 days. Credits and associated pricing may be reserved for up to 6 months with a signed reservation agreement and a 10% deposit. Final transfer of the credits will be made upon receipt of a copy of the US Army Corps of Engineers Compensatory Mitigation Responsibility Transfer Form approving the Stream and/or wetland mitigation purchase from the Bank and upon receipt of your payment to Wildlands Holdings III, LLC. Raiford St Selma, NC 27576 Expiration of Acceptance: 2/28/2024 Project: Eastfield County: Johnston The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the DMS in- lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant’s responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website. Based on the information supplied by you in your request to use the DMS, the impacts for which you are requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation required and assigned to DMS for this impact is determined by permitting agencies, dependent on bank credit availability and may exceed the impact amounts shown below.
