Stephanie, On behalf of Akron Properties, I would like to appeal the City of Durham decision regarding the blue line stream designation on 1121 W. Cornwallis Road. By reading the email trail you will discover that the site was approved for a larger project in 2005 than what I am now planning and that apparently the property is now less usable for development purposes. Miscommunication from the City of Durham to Tony Whitaker, our Engineer has caused some delays. I will have a crew clear a path from Cornwallis Road to the drainage ditch so your staff can safely make an onsite visit to the site. I look forward to your response. The site plan was approved in 2005 along with a development plan that permitted the drainage creek to be piped to accommodate two industrial buildings totaling 33,000 SF. I now want to build less but the City of Durham now has a blue line stream designation that I do not agree with. I have requested Civil Consultants to obtain a grading permit so the lot can be cleared. Akron Properties will appeal to the State of North Carolina to review the new Durham opinion of the drainage ditch. I am requesting you to provide me with the contact person at the State of North Carolina to begin the appeal. Once the lot is clear of trees and underbrush it will be apparent to all that the lot does not have a blue line stream. The State DOT has a drainage easement now that was not present in 2005 but this should have no impact on the property. I look forward to your response. Leaving you off the original response was not intentional. In most cases, the determination letter is sent directly to the consultant who was hired to perform the work (Kate Sevick in this case). However, in cases when the contractor/owner is known, our group always tries to include the interested parties so that all are informed. Again, apologies for the miscommunication. If an updated determination letter, that has a current date is desired, please advise and I will expedite this document. To clarify one item, in your report you stated, "SB is not shown on the Topographic or Soils Maps and therefore does not require a buffer." However, this is not accurate. According to Section 8.5.6 - B4 of the Durham UDO (https://durham.municipal.codes/UDO/8.5.6) even if a feature is not map depicted, it is still subject to the Riparian Buffer Protection Standards if the feature scores a 19 or greater on the NC DWQ Stream Identification Form. The City agreed with your determination that Feature SB was intermittent, therefore the buffer rules also apply to this feature. If you have any questions, please contact me directly. The site plan was approved in 2005 along with a development plan that permitted the drainage creek to be piped to accommodate two industrial buildings totaling 33,000 SF. I now want to build less but the City of Durham now has a blue line stream designation that I do not agree with. I have requested Civil Consultants to obtain a grading permit so the lot can be cleared. Akron Properties will appeal to the State of North Carolina to review the new Durham opinion of the drainage ditch. I am requesting you to provide me with the contact person at the State of North Carolina to begin the appeal. Once the lot is clear of trees and underbrush it will be apparent to all that the lot does not have a blue line stream. The parcel, now referred to as the "Study Area", is located within the Jordan Lake Watershed, which is part of the Cape Fear River Basin (Appendix A, Figure 1). Therefore, any ponds and intermittent or perennial streams mapped approximately on either the USGS topographic map (Southwest Durham Quadrangle, 1981) or the USDA-NRCS Durham County Soil Survey (page 26) are subject to Jordan Lake Watershed Riparian Buffer Rules and City of Durham Buffer Rules, unless a site evaluation results in either a non jurisdictional stream determination or confirms that no feature is present. Upon examination of the above two maps there is one potential stream shown on the Soil Survey map whose buffers could impact the subject property. As such, the purpose of this stream identification is to determine if this feature is present and jurisdictional. 2.0 METHODOLOGY Three Oaks Engineering (Three Oaks) conducted the field investigation of the Study Area on March 14, 2023. Drainage features were assessed according to the NC Division of Water Resources (NCDWR) Methodology for Identification of Intermittent and Perennial Streams and Their Origins and the NCDWR Stream Identification Form (Version 4.11). A review for evidence of the three stream characteristics outlined in the Methodology (Geomorphology, Hydrology, and Biology) was performed. Typically, if a channel is present, streams are determined to be either ephemeral, intermittent, or perennial based on 26 different attributes within these three characteristics by assigning a numeric score for each attribute. A stream reach with a score of < 19 is ephemeral, > 19 and < 30 is intermittent, and > 30 is perennial (Appendix B). Three Oaks investigated the Study Area for signs of these stream characteristics/attributes using the NCDWR stream evaluation techniques. Representative photographs were taken within the potential drainage in question (Appendix A, Figures 2 and 3 and Appendix C). 3.0 QUALIFICATION OF INVESTIGATORS Kate Sevick of Three Oaks conducted the investigation. SB is not shown on the Topographic or Soils Maps and therefore does not require a buffer. It is Three Oaks' opinion that SA is ephemeral until its confluence with SB off the Study Area.
