State of North Carolina DWR Department of Environmental Quality Division of Water Resources FAST TRACK SEWER SYSTEM EXTENSION APPLICATION Division of Water Resources INSTRUCTIONS FOR FORM: FTA 06-21 & SUPPORTING DOCUMENTATION This application is for sewer extensions involving gravity sewers, pump stations and force mains, or any combination that has been certified by a professional engineer and the applicant that the project meets the requirements of 15A NCAC 02T and the Division's Minimum Design Criteria (Gravity Scwcr & Pump $1a6on5 Ftxce gins) and that plans, specifications and supporting documents have been prepared in accordance with 15A NCAC 02T. I SA NCAC 02T:0300, Division policies, and Pood enginearing practiret. While no upfront engineering design documents are required for submittal, to accordance with 15A NCAC 02T .0305(b), design documents must be prepared prior to submittal of a fast track permit application to the Division. This would include plans, design calculations, and project specifications referenced in 15A NCAC 02T _0-105 and the applicable minimum design criteria. These documents shall be Immediately available upon request by the Division. Projects that are deemed permitted (do not require a permit From the Division) are explained in 1.5A NCAG 0ZXpD3.. nvirorirWltcal Qtaitlit, Projects not eligible for review via the fast track process (must be submitted for full technical review): ➢ Projects that do not meet any part of the minimum design criteria (MDC) documents; ➢ Projects that involve more than one variance from [lie requirements of I5A NCAC 02T; ➢ Pressure sewer systems utilizing simplex septic tank -effluent pumps (STEPS) or simplex grinder pumps; ➢ Simplex STEP or simplex grinder pumps connecting to pressurized systems (e.g. force mains); Raleigh ReIC}t1�ii Office Vacuum sewer systems. General — When submitting an application, please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of requested additional information. Failure to submit all required Items will necessitate additional processing and review time, and may result In return of the application_ Unless otherwise noted, the Applicant shall submit one original and one copy of the application and supporting documentation. A. One Original and One Copy (second copy may be digital) of Application and Supporting Documents ® Required unless otherwise noted. Signatures on original must be "wet ink" or secure digital signatures Please do not submit engineering design plans with the application unless specifically requested B. Cover Letter/Narrative Description (Required for All Application Packages): ® List all items included in the application package, as well as a brief description of the requested permitting action. ➢ Be specific as to the system type, number of homes served, flow allocation required, etc. ➢ Include the permit numberistatus of any other required sewer permits (downstream/upstream) fl If necessary for clarity, include attachments to the application form. C. Application Fee (All New and Modification Application Packages): ® Submit a check or money order in the amount of S480.00, dated no more than 90 days prior to application submittal. y Payable to North Carolina Department of Environmental Quality (NCDEQ) D. Fast Track Application (Required for All Application Packages, Form FTA 05-21): ® Submit the completed and appropriately executed application. ➢ If necessary for clarity or due to space restrictions, attachments to the application may be made. ❑ If the Applicant Type in Item 1.2 is a corporation or company, provide documentation it is registered for business with the Forth Carolina 5ccxiary of, trite. ❑ if the Applicant Type in Item 12 is a partnership or d/b/a, enclose a copy of the certificate filed with the Register of Deeds in the county of business ® The Project Name in Item IL I shall be consistent with the project name on the flow acceptance letters, agreements, etc. ® The Professional Engineer's Certification on Page 5 of the application shall be signed, sealed and dated by a N=h_C:aralina censed Professional Engineer. ® The Applicant's Certification on Page 5 of the application shall be signed in accordance with _15A NCAC02T .0106fbl. Per 15A NCAC 02T _0106(c), an alternate person may be designated as the signing official if a delegation letter is provided from a person who meets the criteria in 15A NCAC 02T .0106(b). Flow Tracking/Acceptance Form (Form: FTSE 04-16) (If Applicable): ® Submit the completed and executed FTSE form from the owners of the downstream sewers and treatment facility. ➢ Multiple forms maybe required where the downstream sewer owner and wastewater treatment facility are different. Y The flow acceptance indicated in form FTSE must not expire prior to permit issuance and must be dated less than one year prior to the application date. Y Submittal of this application and form FTSE indicates that owner has adequate capacity and will not violate G.S_ 143-213ANml. ➢ Intergovernmental agreements or other contracts will not be accepted in lieu of a project -specific FTSE. F. Site Maps (All Application Packages): ® Submit an 8.5-inch x I 1-inch color copy of a USGS Topographic Map of sufficient scale to identify the entire project area, including the closest surface waters. ➢ General location of the project components (gravity sewer, pump stations, & force main) ➢ Downstream connection points and permit number (if known) for the receiving sewer ® Include an aerial location map showing general project area (such as street names or latitudcAongitude) so that Division staff can easily locate it in the field. G. Existing Permit (Application Packages for Modifications to an Existing Permit): ❑ Submit a copy of the most recently issued existing permit_ ❑ Include a descriptive and clear narrative identifying the previously permitted items to remain in the permit, items to be added, and/or items to be modified (the application form itself should include only include items to be added/modified). The narrative should also include whether any previously permitted items have been certified. ❑ The narrative should clearly identify the requested permitting action and accurately describe the sewers to be listed in the final permit. H. Power Reliability Plan (Required if portable reliability option utilized for Pump Station): ❑ Per 11A NCACO2T.0305(h)(I , submit documentation of power reliability for pumping stations. ➢ This alternative is only available for average daily flows less than 15,000 gallons per day ➢ it shall be demonstrated to the Division that the portable source is owned or contracted by the applicant and is compatible with the station. The Division will accept a letter signed by the applicant (see I SA NCAC 02T .0106(b)) or proposed contractor, stating that "the portable power generation unit or portable, independently -powered pumping units, associated appurtenances and personnel are available for distribution and operation of this pump station." ➢ If the portable power source or pump Is dedicated to multiple pump stations, an evaluation of all the pump stations' storage capacities and the rotation schedule of the portable power source or pump, including travel timefromes, shall be provided in the case of a multiple station power outage. The sewer improvements addressed in this application include the construction quantities for the public gravity sewer line shown on an attached exhibit reaching from a connection at the private sewer main in the Wolfspeed project, at Carolina Core Parkway, flowing approximately 2,600 feet westerly to the proposed new Slier City Pump Station (WO 0037114), all to be constructed in accordance with North Carolina minimum design criteria. We have titled these sewer improvements the "CAM Outfall No.1" for ease in identification. As you are aware a separate Fast Track Sewer System Extension Application has been filed for the private onsite Wolfspeed sewer system, titled "Wolfspeed HIBS Private Sewer", The public CAM Outfall No,1 sewer pipeline will be constructed by Wolfspeed and will be transferred to Slier City upon its completion. The sewer pipeline size will range from is -inches, at the easterly connection to the Wolfspeed private sewer and crossing Carolina Core Parkway, up to 30-inches at the westerly termination at the Slier City pump station. The variation in size is necessitated due to the changes in pipe slope at accommodate the existing terrain. The sewer pipe is intended at this time to only convey sewage from the Wolfspeed Facility and is sized for an initial average flow up to approximately 1.0 MGD, with an upper design flow capacity of 4.5 MGD. The makeup of the sewage emanating from the Wolfspeed facility is estimated to be 5% domestic sewage and 95% process waste water from the manufacturing process. The Flow Tracking form being submitted indicates a "Zero" flow because the downstream connection at the Slier City Pump station has not been constructed, we are requesting that the CAM Outfall No.1 public sewer system extension be approved for "Zero" flow at this time with the ability to revise the request and approval determination later when sewer allocation is available from Slier City pursuant per their SOC compliance. Permitting requirements for this public sewer include the state's approval of Erosion and Sedimentation Control plans for sewer installation, submitted Initially 8-3-23, which are currently and concurrently awaiting approval by Slier City as part of their Site Plan and Zoning Permit process of Site Plan-07 (SP-07) for the CAM Outfall No. sewer project. Once SP-07 is approved, the Erosion and Sedimentation Control plans will be returned to 140%The Slier City approval will include acceptance of their riparian buffer requirements. Related 401 and 404 permits covering the CAM Outfall No.1 project area have been included as indicted above. As relates to the downstream Siler City pump station, the downstream receiving connection for CAM Outfall No.1, a nationwide 404 permit approval through the USACE was granted for the Slier City pump station on 7-17-23 and the 401 Water Quality coverage was approved on 6-15-23 (DWR NCDEQ permit No. WQ0037114). While PCN is commonly associated with Nationwide Permit (NWP) verification requests, this document uses the term PCN for notification sent to the Corps for all GP verifications (i.e., NWPs, Regional GPs, Programmatic GPs). 1.1 Applicant name: Wolfspeed, Inc., Chris McCann 1.2 Activity location: Latitude: 35.745872 Longitude:-79.528179 Location description: Project is located north of U.S. Highway 64 West and east of J.C. Teague Road Extension, west of Slier City, near the border of Randolph and Chatham Counties, North Carolina. The Chatham -Slier City Advanced Manufacturing Site (CAM) is bordered to the northeast by Old US421 N. near the Randolph, Chatham County border near Slier City, North Carolina. 1.3 Description of activity requiring verification:Thls verification would authorize the discharge of fill material into 0.070 acre of wetland for a 122' long by 24" culvert to maintain hydrologic connectivity under a driveway and an 8' riprap pad for velocity dissipation. An additional 0.040 acre of wetlands and 88 linear feet of stream will be temporarily impacted from open cut trenching for sewer installation and access. 1.4 Existing conditions and any applicable project history: After -the -fact: No. 1.4.1 Jurisdictional Determination: Is this project supported by a Jurisdictional Determination? Additionally, indirect effects would be further reduced through the Implementation of BMPs required by state, local, and Federal ordinances and regulations. 2.2 Site specific factors: The project area is part of the 19,511-acre Upper Brush Creek watershed that Is primarily composed of farmland and rural development. This project site will further be expanded into a mega manufacturing site In the growing Slier City area. This area has a long history of Intensive farming practices which has resulted in long term degradation to aquatic resources. Given the urbanizing nature of the watershed, the waters within the project area provide important aquatic resource functions to downstream waters. 2.3 Coordination 2.3.1 Interagency Coordination Was the PCN coordinated with other agencies? Based on this information, the Corps believes the applicant has avoid and minimized impacts to waters of the United State to the maximum extent practicable. The applicant has adjusted the discharge from their stormwater outfall ponds to ensure there will not be indirect Impacts from construction of road crossings. Describe other mitigative actions including project modifications implemented to minimize adverse project impacts? (see 33 CFR 320.4(r)(1)(i)) Applicant looked into constructing bridge to avoid all wetland/stream impacts; however, construction would be cost prohibitive. Applicant avoided 92% of the onsite wetlands 3.2 Compensatory mitigation requirement Is compensatory mitigation required for unavoidable impacts to jurisdictional aquatic resources to reduce the individual and cumulative adverse environmental effects to a minimal level? As such, the ESA action area for this project is: within the footprint of the regulated activities In waters of the U.S., uplands immediately adjacent to those waters that would be affected by the regulated activities In waters of the U.S., the portions of the existing interchange which are constrained by the location of the impact areas, and waters downstream that would be expected to be Impacted by the proposed activities; these areas comprise the Interchange and downstream waters that would be affected by project construction. 4.1.2 Lead federal agency for Section 7 of the ESA Has another federal agency taken steps to document compliance with Section 7 of the ESA and completed consultation(s) as required? IPAC Species in Chatham County: Tricolored bat (Perlmyotis subflavus) - Proposed Endangered - Proposed for Listing Red -cockaded woodpecker (Picoides borealis) - Endangered - Listed Cape Fear shiner (Notropis mekistocholas) - Endangered - Listed Harperella (Ptilimnium nodosum) - Endangered - Listed Atlantic pigtoe (Fusconaia masoni) - Threatened - Listed Effect determination(s), including no effect, for all known species/habitat, and basis for determination(s): Based on the latest version of the Natural Heritage Program's NHEO data and a site visit, there are listed species located within or in the vicinity of the action area and this activity Is one that may affect those listed species. The Corps has determined that the activity may affect, but Is not likely to adversely affect species subject to the ESA. Applicant submitted Endangered Species the following effect determinations: Red -cockaded woodpecker -no effect Cape Fear shiner -no effect Atlantic Pigtoe- no effect Harparella-no effect Habitat Assessment to FWS June 15, 2022, making USFWS responded via email June 21, 2022, concurring with these determinations noting that there is an occurrence of Atlantic Pigtoe roughly 1.5 miles downstream of the property and to ensure extreme vigilance of erosion and sedimentation measures to prevent offsite Impacts to listed species. The Corps followed up with an email to USFWS about the potential Tricolored Bat listing and USFWS stated that the applicant can clear trees prior to the listing of the species, but once listed any further tree clearing may need additional review from USFWS. 4.1.4 Section 7 ESA consultation Consultation with either the National Marine Fisheries Service and/or the U.S. Fish and Wildlife Service was initiated and completed as required, for any determinations other than "no effect' (see the attached "Summary" sheet for begin date, end date and closure method of the consultation). Activities undertaken outside WOUS are included In the permit area because those activities are directly associated and Integrally related with the authorized work and those activities would not occur but for the authorization of the work within the WOOS. 4.3.2 Lead federal agency for Section 106 of the National Historic Preservation Act Has another federal agency been identified as the lead federal agency for complying with Section 106 of the National Historic Preservation Act with the Corps designated as a cooperating agency and has that consultation been completed? No. 4.3.3 Historic properties Known historic properties? No. Based on the NCDCR "HPOWEB" service and aerial photographs, there are no known historic properties located in the permit area or in close proximity to the permit area. Effect determination and basis for that determination: The Corps has determined the proposed activity has no potential to cause effects to properties fisted or eligible for listing in the National Register of Historic Places, because the activitiy is limited in nature and scope. This activity is so limited in nature and scope that there is little likelihood of impinging upon a historic property even If such properties were present within the affected area's). Based on previous surveys and a letter from NC SHPO 16 potential sites were surveyed on the Megasite (365 acres of the Slier City Factory (SCF) site), but "were determined not to be eligible for listing on the NRHP due to a lack of Integrity and Inability to contribute further to an understanding of the area's prehistory or history." The onsite graveyard, the Marley Cemetery, should be avoided with a 30 foot buffer surrounding it. However, the Impacts for this NWP do not include these areas and the permit area is limited to the impacts to waters and immediately adjacent uplands. A subsequent archeological report was submitted February 2023 on the 80-acre tract added to the SCF along US 64 and the report concluded the two potential sites were not eligible for listing and SHPO concurred with a no effect determination In their letter dated March 10, 2023. 4.3.4 Consultation with the appropriate agencies, tribes and/or other parties for effect determinations Consultation was initiated and completed with the appropriate agencies, tribes and/or other parties for any determinations other than "no potential to cause effects." Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. If the width of the culvert is wider than the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only flows above bankfull. Placement of culverts and other structures In streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches, to allow low flow passage of water and aquatic life. If the culvert outlet is submerged within a pool or scour hole and designed to provide for aquatic passage, then culvert burial into the streambed is not required.
