The purpose of this project is to generate Falls Lake riparian buffer restoration and nutrient offset credits. The Site is included in the Banished Bull Mitigation Banking Instrument (MBI) for Riparian Buffer Mitigation and Nutrient Offset Credits between Watershed Investments NC, LLC and the NC Division of Water Resources (DWR) approved on November 17th, 2020. The MBI is in accordance with 15A NCAC 02B .0295 (Temporary Consolidated Buffer Mitigation Rule, effective October 24, 2014) and 15A NCAC 02B .0240 (Nutrient Offset Payments Rule). The Site is located approximately 6 miles northeast of Hillsborough, NC (Figure 1, Appendix A) along Schley Road. Surface water drainage features at the Site are part of the Upper Falls Lake Watershed. The Site is in the Neuse River Basin 14-digit United States Geological Survey (USGS) Cataloging Unit 03020201020020 of the South Atlantic/Gulf Region (North Carolina Division of Water Quality [NCDWQ] Sub -basin Number 03-04-01). Project restoration activities and planting were completed in October -December 2020. Completed project activities, reporting history, completion dates, project contacts, and project attributes are summarized in Tables 1-4 (Appendix A). The Site encompasses 8.72 acres of land along unnamed tributaries to South Fork Little River and is located in Orange County. Tract Acreage Location Banished Bull 8.72 acres 4321 Schley Road, Hillsborough, NC 27278 This project is restoring buffers adjacent to surface water features in the Upper Falls Lake Watershed (WS- M in order to reduce nutrients that flow into the South Fork of the Little River and ultimately into Falls Lake. This project has ancillary benefits that include reducing sediment runoff, reducing nutrients to streams through agricultural runoff, improving aquatic, and terrestrial habitat. Any nutrient offset or riparian buffer mitigation generated from this Bank Parcel may offset impacts from development, both existing and proposed, within the Upper Falls Lake watershed. SITE MAINTENANCE Banished Bull Year 3 (2023) Annual Monitoring Report Wlatershed Investments NC 2 1.0 PROJECT MONITORING AND PERFORMANCE STANDARDS 1.1 Project Monitoring Plan Riparian vegetation monitoring for the site will be based on the CVS Level 1-2 Protocol for Recording Vegetation, Version 4.2 (Lee et al. 2008). Annual vegetation monitoring will occur each year during the fall season with the first year of data collection occurring at least 6 months after initial planting of the Site. Vegetation monitoring plots measure 0.0247 acre in size and cover 2% of the planted area. Accordingly, eight (8) permanent vegetation plots will be used to monitor the Site vegetation. At the request of NC DWR, additional data was collected after the as -built was submitted to supplement the permanent plots. Ten (10) vegetation transects (.0247ac) were conducted throughout the site. These plots were remeasured during MY3 (2023); the data is summarized in Appendix B and transect locations are depicted on Figure 2 (Appendix A). Temporary plot data will continue to be collected on an as -needed basis. A reference photo will be taken at each plot origin. All planted stems in the plots are marked with flagging tape and/or a pin flag and are recorded. Data collected will include species, height, planting type (planted stem or volunteer), vigor, and grid location. Year 3 (2023) CVS data was collected on October 4, 2023 by Axiom Environmental and derived an average density of 430 planted stems per acre for permanent plots (excluding live stakes) (Table 7, Appendix B) with an average plant height of 3.52 feet. The average density for the temporary transects was 498 stems per acre with an average height of 4.55 feet. Planted and temporary plots had a combined average density of 464 stems per acre and combined average height of 4.03 feet. Additionally, permanent plots contained an average of 5.8 species per plot. Deer browse was observed throughout the site, but generally, tree mortality was low. In several plots resprouts of previously dead or missing stems were located. Live stakes along the mainstem were vigorous. The Sponsor shall submit to DWR an annual monitoring report for each phase, no later than December 31 of each year for five consecutive years. Reports will document the success of the vegetation and any maintenance, supplemental planting, or encroachment within the easement areas. Monitoring bonds shall be renewed with confirmation of renewal provided to DWR with each annual monitoring report. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals. Invasive and noxious species will be monitored annually and controlled as needed so that none become dominant or alter the desired community structure of the site. 1.2 Success Criteria Pursuant to criteria found in the Temporary Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 and Banished Bull BPDP, vegetative success for the Site will require the survival of at least 260 planted trees per acre at the end of Year 5. Natural recruits will not count towards annual achievement of performance standards; however, they may be considered during review by the DWR. Recruitment of volunteer trees throughout the site is anticipated due to forests upstream of the site. Banished Bull Year 3 (2023) Annual Monitoring Report Wlatershed Investments NC 2.0 MITIGATION POTENTIAL As noted in the Banished Bull BPDP, buffer credit determination is subject to the Temporary Buffer Rule 15A NCAC 02B .0295(h) and (i). Figure 3 (Appendix A) identifies the riparian areas and credit types for the Site. An area of 8.156 acres at the site is being restored with credits being divided between Buffer Mitigation (212,901 ft2 or 4.8884.933 acres) and Nutrient Offset (142,384 ft2 or 3.269 acres). Applying DWR' s credit generation for calculating nutrient reduction for riparian restoration of agricultural land detailed in the Site' s MBI, the proposed nutrient offset area would generate reductions of 7,429.793 lbs nitrogen and 478.536 lbs phosphorus. Detailed credit calculations are included in Table 1 (Appendix A). 3.0 SITE MAINTENANCE Based on observations during MY2 monitoring, the Sponsor elected to supplementally plant an area in the central portion of the site with 300 1-gallon potted trees detailed in Table 5. Planting was completed on January 10, 2023. The area subject to the replant was targeted due to low stem densities in adjacent plots (Plots 2 and 6). This area is depicted on Figure 2 (Appendix A). No invasive treatments or spraying to control herbaceous vegetation was performed during Year 3 (2023). Invasive species at the site were minimal and will continue to be monitored and treated if necessary. Based on Year 3 data, some targeted planting activities are planned during the winter of 2023/2024. Details on planned adaptive management activities are included in Appendix C of this report. Banished Bull Adaptive Management Plan 10/17/22 DWR #2020-0047 Site Overview and History This Adaptive Management Plan is provided to address concerns over year 2 monitoring of planted stem success at the Banished Bull Mitigation Bank Parcel (Site). Watershed Investments NC (WINC), the sponsor, originally planted the site in December 2020. The site encompasses 8.72 acres of land along an unnamed tributary to the South Fork of the Little River and ultimately into Falls Lake (See Figure 1 for a map of the site). Year 2 (2022) monitoring data was collected on September 22, 2022 by Axiom Environmental (See Year 2 Monitoring Report). Results showed that two of the eight fixed monitoring areas, (plots 2 and 6), had planted stem counts that averaged 202 and 243 stems per acre, below project success criteria of 260 planted stems. As a result, adaptive management activities are planned around these monitoring areas in the winter of (2022/2023). Overall, average planted stem density for all plots at the site was 384/acre. Stressors observed at the site include deer browse, competition from herbaceous species, and mortality attributed to drought conditions over the 2022 summer. Adpative Management Plan The following adaptive management activities are proposed to boost low planted stem counts in portions of the project area. Herbaceous competition has been observed from Johnson grass (Sorghum halepense). An initial herbicide application of this invasive plant was conducted on 7/27/22 by Ripple EcoSolutions. Follow-up treatment will be conducted as needed to prevent its re-establishment using chemicals labeled safe for use in riparian zones and applied at rates labeled for treatment of fescue. Precautions will be taken to avoid collateral damage to desirable vegetation (both planted and volunteer). Pesticide application will be conducted by a licensed application specialist and logs will be available upon request. To increase planted stem density, a total of approximately 300 one -gallon trees will be planted during the winter of 2022-2023. The container plants will have a more mature root system that will better enable them to overcome herbivory. Areas in and around plots 2 and 6 will be the focus replanting with supplemental planting density of 150 plants per acre. Figure 1 identifies the planting area to be targeted. A mix of native hardwood species will be planted at 16 x 16 foot spacing to yield 150 plants/acre to fill in areas with low planted stem growth or stunted growth. This density when combined with existing successful plants, should meet the criteria for site success defined in the site's Mitigation Banking Instrument. Planting will occur in the Fall/Winter of 2022/2023 and observed over the remainder of the monitoring period. Table 1 lists the species being considered for the site however species availability may result in the substitution of other regionally appropriate native species. 23 Appendix C. Banished Bull Adaptive Management Plan 10/27/23 DWR #2020-0047v2 Site Overview and History The following adaptive management plan is provided to address Year 3 observations of planted stem success and vigor at the Banished Bull Mitigation Bank Parcel (Site). Watershed Investments NC (WINC), the sponsor, originally planted the site in December 2020. The site encompasses 8.72 acres of land along an unnamed tributary to the South Fork of the Little River and ultimately into Falls Lake. Year 2 adaptive activities of adding 300 one -gallon plants helped to boost planted stem averages in targeted areas around permanent plot numbers 2 and 6 that averaged 202 and 243 stems per acre, to 364 and 445 stems, respectively. Year 3 (2023) monitoring data was collected on October 41h, 2023 by Axiom Environmental (See Year 3 Monitoring Report). Monitoring at both permanent and temporary plots exceeded project success criteria of 260 planted stems acre. While meeting criteria, some targeted adaptive planting measures are proposed for the site based on the following observations during site visits and from monitoring data: • Data from Temporary Plot 2 and Permanent Plot 5 showed lower plant vigor with stem height averages of 2.64' and 1.8', respectively. • Observation of the area surrounding those plots showed adjacent areas would benefit from increased planting of more mature plants from the approved BPDP plant list. • Stressors observed at the site include deer browse and competition from herbaceous species. AdPative Management Plan The following adaptive management activities are proposed for the site: To increase planted stem density and vigor in areas surrounding Permanent Plot 5 and Temporary Plot 2, a total of approximately 80 one -gallon trees will be planted during the winter of 2023-2024. The boundary of the targeted planting area was identified in a field visit to the site and is shown on the accompanying Year 3 Adaptive Management Figure C-1. Targeted planting areas total approximately a half -acre with supplemental at 16 x 16 foot spacing. This density when combined with existing successful plants, should improve vigor and continue to meet the criteria for site success defined in the site's Mitigation Banking Instrument The container plant list is contained in the Year 3 Adaptive Management Table C-1. One -gallon plants have a more mature root system and those selected species include species at the site shown to be vigorous and resistant to herbivory (e.g., Diospyros virginiana, Platanus occidentalis). Limited species availability may result in the substitution using other plants from the approved plant list found in the project's BPDP. Planting will occur in the Fall/Winter of 2023/2024 and observed over the remainder of the monitoring period.
