The application states that "the maintenance project is located within the Cape Fear River Basin which is not a
Riparian Buffer Rule Area". This project is located within the Jordan Lake Watershed (part of the Cape Fear River
watershed) and is subject to the Jordan Lake Riparian Buffer Rules. This area falls under the delegated authority
of Chatham County. Can you please specify if you meant the buffer impacts would be authorized under the local
authority or if this is considered an exempt activity under the Rule? [15A NCAC 02H .0502(c) & 15 NCAC 02B
.0267]
You are correct the project is located within the Cape Fear River basin, and I missed that the project fell also
within the Jordan Lake Watershed. This project is listed as exempt 15A NCAC 02B .0267 6(a) EXEMPTION WHEN
EXISTING USES ARE PRESENT AND ONGOING as the pipeline was in place well before the Rule's effective date of
August 11, 2009.
While your application states that "no monofilament erosion control matting will be used", it is unclear if the
geotextile matting used for the riprap areas will contain plastics. Matting that incorporates plastic mesh and/or
plastic twine should not be used along streambanks. [15A NCAC 02H .0502(c)]. Please confirm the matting used
under the keyed in riprap will be of natural and non -plastic materials.
This issue has been brought up before about this regulation. Geotextile fabric is a tight woven synthetic that will
be underlain and buried. Geotextile fabrics do not mee the definition of a plastic mesh or twine. It is our
understanding that the purpose of this stipulation is for the safety of wildlife. Specifically, amphibians, reptiles,
and birds become entangled in this plastic mesh materials resulting in mortality. Submar and CPC utilize a coir
fabric mesh to stabilize surface areas where necessary. The buried geotextile fabric poses no wildlife risk and is a
commonly used material in stream projects to prevent subgrade erosion.
• It appears that there are no detailed design plans for the "submar matting" included with your application. It
appears that a location type map was uploaded in error instead of the intended design plan. Please provide a
detailed design for review that depicts all proposed impact totals (temporary and permanent) for the S1 impact
area.
I the uploaded pdf the design plans were in Appendix C. I am unsure why the plans did not show up on your end
of the pdf package upload, but I have attached the plan set for you.
• Please be aware that DWR will include a special condition that will require post -construction documentation/a
potential site visit in any potentially issued approval letter. This has been done for projects similar to this in the
past.
We are aware of this requirement. In the past we have been asked to inspect the site post construction and
produce an internal document that we can furnish if requested. We can provide you a post construction
monitoring compliance report if requested and coordinated a site visit if you would like.
