Doug,
It has been a while and hope this finds you well. So nothing that I am aware of would change the
previously discussed permit strategy. That said you will be working with new regulatory contacts;
Hannah Sprinkle with DWR and Tom Steffens with the Corps. I have had to give up NCDOT projects.
Both are copied here and I have had brief conversations with them both to provide some
background.

Hi Brad,
It’s been a while – I hope you are doing OK.
I am working with DOT rail on the permitting for 2 CSX crossings along Burnt Mill Creek, as well as
the work on Eagle Island that John Dorney referenced in the email chain below (John has moved on
from M&N, so they brought me into this one). Before I get working on the permitting, I wanted to
make sure that a RGP 50 would still be appropriate for this work.
I am still coming up to speed on the project, but if you have any questions on this that would help
with you answer, please let me know.
Hopefully we can meet each other on site somewhere down the line.

John,
As with other linear transportation projects involving impacts to wetlands and perennial channels
the ratios would be 2:1 for both and yes the wetland mitigation type would need to be riparian.

Subject: [Non-DoD Source] CSX rail realignment project in Wilmington
Brad – hope you are doing well. Plans are a little clearer now for the CSX rail realignment project in
Wilmington. We intend to follow your earlier guidance and apply for RGP 50 for the work now that
we know a CAMA Permit will not be required for the wetland impact. It looks like there will be 0.52
acres of wetland impact (404 wetlands from the recent site visit) and 91 linear feet of impact to
what was determined in the field to be a perennial stream. It appears to be a weakly perennial
stream since it scores 32.5 points on the DWQ Stream Identification Form and the numerical cutoff
for perennial is 30 points.
The RGP says that compensatory mitigation will be required but that the type and amount of
mitigation is up to the Corps Project Manager. Can you provided guidance to us as to the type (we
assume riparian wetland and maybe stream or would you just add the stream area to the wetland
area?) and amount (ratio) of mitigation that will be required so we can contact DMS and have their
form in our future application? If a phone call would help, we’d be glad to set up a call this week or
next to get your thoughts on these issues.
