I will try to summarize the last 8 months work. During our scoping meeting with the ten organizations that needed to ok our application for a permit to build boat slips; it was noted that Phase Two of the Beach at BrickLanding was never approved by the NC Division of Water Quality. Phase one was approved but not Phase Two. Phase One are those houses that front the waterway. Mr.Taylor as the developer had sold and indeed built on these said properties in Phase Two. Specifically the BUA had to be addressed (BUA stands for Build Upon Area)for Phase Two. Due to the size of the lots in our development; it is considered a High density area. Mr.Taylor is no longer involved with our POA as a result of selling off the remaining properties,he was still considered the PERMITEE for the Development.We then had to secure a transfer of the Permitee form to the POA from Mr.Taylor(no easy task locating him,)we did and secure the signatures needed. Next was the directive to include the BUA limitations, INTO OUR COVENANTS AND RESTRICTION. I was given the forms by Ms. Lewis and filled them out,as well as posted it in Bolivia as an addendum to our current documents. I will say that Ms. Lewis has been most helpful in securing the necessary forms and was instrumental reverting back to the 1990 permit.The basins for water runoff have all past inspection. What is currently needed is a 60%voted accepting the BUA into our restriction.As I explained to Ms. Lewis,the state is mandating these terms, is it not a moot point?The architectural committee will now have these guidelines written for future building on Phase Two(two lots are left to be built upon). I let Mr. Taylor know that I understand he is no longer involved in the project or with the HOA, and that his signature on the transfer document would just serve to make it official. I also indicated that if he didn't want the state to contact him each time there was a compliance issue at the subdivision, then he should sign the transfer document. Since our initial meeting late last October, there has been one change in the permit transfer process. I can no longer transfer an existing permit on just your signature alone. Rather than going through the futile exercise of waiting for Mr. Taylor to sign the transfer document, I think it will be best for the Association to apply for its own permit, for which you only need one signature—the HOA. However, in order to issue a permit to the HOA, the HOA must own the common areas of the project and the project must be in compliance with the current permit. Assuming that the site is in compliance, and that the previously permitted design parameters of the project are not changing, the project will be eligible for a vested right to the 1988 rule, which is the rule that the existing permit was issued under. As the owner of the common areas which have been legally conveyed to the HOA by the developer, the HOA has the right to apply for its own permit. Upon approval of the new permit, the Division will assign a new permit number to the project and will inactivate Mr. Taylor's existing permit number. A complete application package includes: 1. A completed and signed permit application form SWU-101; 2. The application fee of$505.00; 3. A completed supplement form,for each of the two existing infiltration systems; 4. A signed infiltration basin O&M document. 5. A copy of the deed wherein the common areas of the project were conveyed to the HOA, including the area behind lots 1-11 where the infiltration basins are located. (I was not able to locate one on the Register of Deeds website.); 6. Two sets of plans. I still have copies of the October 1994 plans that were never approved. Barring any compliance issues that result in the need to draft new plans, I should be able to use those plans to issue the permit. 7. A compliance inspection of the project will need to be conducted to make sure that the basins are in compliance with the approved plans, and that the lots have not exceeded their BUA allocation. It was a pleasure meeting you yesterday. I wish the circumstances had been different— I do not like the fact that the HOA has to "clean up the mess" so to speak, left by this developer, but I don't see any other solution. I will be sending a letter to Mr. Taylor at the address on file with the NC Secretary of State to see if we can convince him to sign the transfer of ownership form. If he does not respond within 60 days, I can accept your new application for a permit which will need to address the addition of those 4 lots. If Mr. Taylor does sign the N/O transfer form, then I can transfer the existing permit, as is, to the HOA. After that, the HOA should submit a modification to add those 4 lots to the permit. Upon receipt of the permit, the HOA should record the new deed restrictions for every lot. In the way of understanding what the permit covers, it is a high density permit for two infiltration basins. Both basins are located in the common area between the homes and the waterway. Maintenance (O&M) of the basins is required in order to keep them functioning as designed. If you can find Mr. Taylor and get him to sign the Name/Ownership Change form (also attached), then you do not have to sign separate O&M documents as the original ones will automatically transfer with your signature on the N/O form. As discussed, if Mr. Taylor won't sign the N/O form, then you will need to submit a new application for your own permit, which will require a signed O&M document, available from our website. As promised, attached is a copy of our updated high density residential subdivision deed restriction language which you can put into your covenants via an approved amendment inserting 2,720 into the appropriate blank. Please note that, when I reviewed the calculations in the file, the original intent was to restrict each of the twelve Phase I lots to a maximum of 2,720 sf, but the four Phase II lots were intended to have 2,800 sf each. Unfortunately, there are a few outstanding deficiencies with the permit. The stormwater permit for Phase I of the subdivision is SW8 901018 and currently covers 12 lots and 2 infiltration basins. ➢ In September 1994, a revision to add 4 new lots, Phase II, was received, but was apparently never approved because additional information which the Division requested on November 23, 1994, was never submitted. It did not add up that Delaney Aycock had received a letter clearing Taylor "3 or 4 weeks ago" when Jerry Parker from CAMA had just advised people interested in purchasing a lot that there were "major stormwater problems with the subdivision" only 2 weeks ago. I went to Bolivia Friday afternoon to get a copy of the letter, if it existed. There is no letter from Ed Beck or anyone else. Delaney Aycock flat out lied to me. I was, needless to say, furious I am sure Ed Beck is not amused either at having his name used in a lie. I intend to have a talk with Wyman Yelton, the County Manager, about this first thing Monday. I will also talk with Yelton about withholding permits, inspections and C011s. Aycock has no intention of doing so and never did. As soon as Taylor had done all he could do on the house, Aycock issued more permits and resumed doing inspections on September 20. When I called him on it, he lied to me about a letter from Ed Beck, thinking I would never know the difference. At least, as of Friday afternoon, Ta*lor had not been issued any further building permits for this subdivision. I returned a call to you around 1:30 p.m. on Friday and we discussed the ongoing construction of Mr. Taylor's home, the start-up of another home on one of the four lots under Notice of Violation, the status of the revised stormwater review, the status of the grading problem affecting your property, and whether or not the State was going to fine Mr. Taylor. I responded that I did not understand how another house could be under construction, or how Mr. Taylor's home could continue under construction, given that the revised stormwater submittal had not been approved. I said I would call the building inspector, Mr. Delaney Aycock, and fmd out information from him. You said that Mr. Aycock told you that Mr. Taylor had told him that Mr. Taylor had satisified the State and had a letter from Mr. Ed Beck of this Office indicating the compliance status of The Beach at Brick Landing. I said that I would fmd out what was going on. I spoke with Mr. Delaney Aycock, Brunswick County Building Inspections, later Friday afternoon. He said Mr. Taylor had been in to see him, and had assured Mr. Aycock that he was in compliance with the Stormwater regulations. Mr. Aycock did not request a copy of the letter for verification, and building inspections were started up. The second home under construction that we spoke about was issued it's permits several months before the Notice of Violation was issued. The owner elected to delay construction until now. It only appears that a building permit was issued during the time that no building permits were to be issued. I also spoke with Mr. Don Covil, the consulting engineer for Mr. Taylor who is with Houston and Associates, the morning of October 17, 1994. I asked for the status of the submittal, and was told that the revised submittal had been sent to this Office on September 29, 1994. A review of my incoming mail shows that the project was received by this Office on October 3, 1994 and is awaiting review for compliance. As to your other concerns, I will not issue a Stormwater Certification until all the items listed in the Notice of Violation have been satisfactorily addressed. The issue of alleged grading so that your property receives an increased amount of runoff may end up as a civil matter, depending on the response to the Notice of Violation. The State does not review projects for flood control, and can place no minimum requirements for flood control on developers. Local governments are encouraged to develop minimum standards for the control of floodwaters. I will be reviewing the project's revised plans shortly. The stormwater approval that DEM has recently received from you is only one segment of the final material that we need to begin the final processing of the application. As we discussed during our meeting this office needs an updated version of the development plans for the site. It would appear that the proposed swimming pool in the original plans should be removed from the revised set. Also, The status of the multi-family units should be explained (i. e., how soon do your clients intern to start these units?) . The question of the pier(s) needs to be resolved. The local CAMA program has had several requests for piers. My review of the file information does not indicate that this site has riparian access rights. The 'new deed calling for a pier on Lot 8 is for a private pier. We do not consider a sub-division pier to meet the private category. It is our opinion that this problem can be corrected by refilling the basin with native soil to the desired bottom elevation. The characteristics of the soil are homogeneous across the entire site. Simply pushing adjacent native soil into the excavated basin should provide a soil profile which will function the same as the original soil. The Developer would very much like to take care of all the points as soon as possible; however, it has been our understanding that DEM has taken the position that no further construction can take place within the COE right-of-way until the COE matter is taken care of. This understanding is based on the content of several letters from DEM as well as conversations with DEM personnel. Please provide written authorization to proceed with items 2, 3, 4, and 5, and we anticipate that these items can be taken care of within a 30 day period. Item number 1 of the November 29 letter dealt with the existence of piping rather than an open channel to carry stormwater from the road toward Infiltration Basin # 1. This approach was part of the revised storinwater plan submitted to DEM on October 2, 1990. Upon review of our revised plan you will see that there is still approximately 40' of grassed open channel upstream of the infiltration basin even with the piped section as part of the project. Based on our October 25, 1990 telephone conversation with Ms. Finn, we understood that the COE matter (again) was the only thing holding up plan approval. In a telephone conversation today with Mr. Don Covil of Houston and Associates, I explained that this Office can not approve the revised stormwater submittal until we receive the information requested July 11, 1990 by Mr. Dave Adkins, Water Quality Regional Supervisor. In particular, Mr. Adkins requested the following: Condition Number 4 on CAMA Permit No. 49-89 states tat no permanent structures will be constructed with the AIWW right-of-way. Approved stormwater plans (and the revised plans received October 12, 1990) indicate two Stormwater Infiltration basins are to be built within the AIWW right-of-way. Please provide this Office with documentation from CAMA and The United States Army Corps of Engineers that these basins are consistent with condition No. 4 ad the above referenced permit.
