As promised enclosed you will find numerous documents that have finally brought many issues to a
favorable conclusion. I will try to summarize the last 8 months work.
During our scoping meeting with the ten organizations that needed to ok our application for a permit to
build boat slips; it was noted that Phase Two of the Beach at BrickLanding was never approved by the
NC Division of Water Quality. Phase one was approved but not Phase Two. Phase One are those houses
that front the waterway. Mr.Taylor as the developer had sold and indeed built on these said properties
in Phase Two.
Specifically the BUA had to be addressed (BUA stands for Build Upon Area)for Phase Two. Due to the
size of the lots in our development; it is considered a High density area.
Mr.Taylor is no longer involved with our POA as a result of selling off the remaining properties,he was
still considered the PERMITEE for the Development.We then had to secure a transfer of the Permitee
form to the POA from Mr.Taylor(no easy task locating him,)we did and secure the signatures needed.
Next was the directive to include the BUA limitations, INTO OUR COVENANTS AND RESTRICTION.
I was given the forms by Ms. Lewis and filled them out,as well as posted it in Bolivia as an addendum to
our current documents. I will say that Ms. Lewis has been most helpful in securing the necessary forms
and was instrumental reverting back to the 1990 permit.The basins for water runoff have all past
inspection.
What is currently needed is a 60%voted accepting the BUA into our restriction.As I explained to Ms.
Lewis,the state is mandating these terms, is it not a moot point?The architectural committee will now
have these guidelines written for future building on Phase Two(two lots are left to be built upon).

I've left several messages for Mr. Taylor with no response. I let Mr. Taylor know that I understand he is no
longer involved in the project or with the HOA, and that his signature on the transfer document would just serve
to make it official. I also indicated that if he didn't want the state to contact him each time there was a
compliance issue at the subdivision, then he should sign the transfer document.
Since our initial meeting late last October, there has been one change in the permit transfer process. I can no
longer transfer an existing permit on just your signature alone. Rather than going through the futile exercise of
waiting for Mr. Taylor to sign the transfer document, I think it will be best for the Association to apply for its own
permit, for which you only need one signature—the HOA.
However, in order to issue a permit to the HOA, the HOA must own the common areas of the project and the
project must be in compliance with the current permit.
Assuming that the site is in compliance, and that the previously permitted design parameters of the project are
not changing, the project will be eligible for a vested right to the 1988 rule, which is the rule that the existing
permit was issued under. As the owner of the common areas which have been legally conveyed to the HOA by
the developer, the HOA has the right to apply for its own permit. Upon approval of the new permit, the Division
will assign a new permit number to the project and will inactivate Mr. Taylor's existing permit number.
A complete application package includes:
1. A completed and signed permit application form SWU-101;
2. The application fee of$505.00;
3. A completed supplement form,for each of the two existing infiltration systems;
4. A signed infiltration basin O&M document.
5. A copy of the deed wherein the common areas of the project were conveyed to the HOA, including the
area behind lots 1-11 where the infiltration basins are located. (I was not able to locate one on the
Register of Deeds website.);
6. Two sets of plans. I still have copies of the October 1994 plans that were never approved. Barring any
compliance issues that result in the need to draft new plans, I should be able to use those plans to
issue the permit.
7. A compliance inspection of the project will need to be conducted to make sure that the basins are in
compliance with the approved plans, and that the lots have not exceeded their BUA allocation. If there
are any issues, you will need to include resolution of those issues as part of the application package.

I spoke with Mr. Taylor on Friday(yes I Finally reached him) and asked if the form were ready to be picked up. I
explained to him why it was imperative that these be fill out as expeditiously as possible . His response was that he has
not been involved with this POA for over ten years and does not want to be"dragged in"

Hi Mr. Gomes. It was a pleasure meeting you yesterday. I wish the circumstances had been different— I do not
like the fact that the HOA has to "clean up the mess" so to speak, left by this developer, but I don't see any
other solution. I will be sending a letter to Mr. Taylor at the address on file with the NC Secretary of State to
see if we can convince him to sign the transfer of ownership form. If he does not respond within 60 days, I can
accept your new application for a permit which will need to address the addition of those 4 lots.
If Mr. Taylor does sign the N/O transfer form, then I can transfer the existing permit, as is, to the HOA. After
that, the HOA should submit a modification to add those 4 lots to the permit. Upon receipt of the permit, the
HOA should record the new deed restrictions for every lot.
In the way of understanding what the permit covers, it is a high density permit for two infiltration basins. Both
basins are located in the common area between the homes and the waterway. Maintenance (O&M) of the
basins is required in order to keep them functioning as designed. If you can find Mr. Taylor and get him to sign
the Name/Ownership Change form (also attached), then you do not have to sign separate O&M documents as
the original ones will automatically transfer with your signature on the N/O form.
As discussed, if Mr. Taylor won't sign the N/O form, then you will need to submit a new application for your
own permit, which will require a signed O&M document, available from our website.
As promised, attached is a copy of our updated high density residential subdivision deed restriction language
which you can put into your covenants via an approved amendment inserting 2,720 into the appropriate blank.
Please note that, when I reviewed the calculations in the file, the original intent was to restrict each of the
twelve Phase I lots to a maximum of 2,720 sf, but the four Phase II lots were intended to have 2,800 sf each.
Basin #2 was designed for, but never permitted for, these four lots at 2,800 sf. You should account for this in
the application.

permit. Unfortunately, there are a few outstanding deficiencies with the permit. The stormwater permit for
Phase I of the subdivision is SW8 901018 and currently covers 12 lots and 2 infiltration basins.
➢ In September 1994, a revision to add 4 new lots, Phase II, was received, but was apparently never
approved because additional information which the Division requested on November 23, 1994, was
never submitted. A followup letter dated February 1, 1995, was sent to the applicant and copied to the
consultant, Jay Houston, P.E., Houston and Associates in Shallotte. No response was ever received,
so the 4 lot addition was never permitted.
➢ A copy of the recorded deed restrictions was never received. Most of the deeds in that subdivision were
made subject to two different recorded documents, DB 841 at Page 546 and DB 845 at Page 220.
However neither of these documents contains a statement regarding the maximum BUA per lot limit of
2,720 sf.
➢ The current permit is still in the name of the original permittee William F. Taylor, WFT Properties, Inc.
The permit will need to be transferred to the HOA. Based on a search of the NC Secretary of State
Corporations database, WFT Properties, Inc., is still an active corporation, although the mailing address
has changed. Mr. Taylor must sign a Name/Ownership Change form in order to initiate the transfer
process.
We can discuss the implications of the above-listed deficiencies on the proposed docking facilities project at
the One-Stop meeting.

I appreciated your call about the above matter on Friday, October 14.
Sorry I fussed at you about it. Unfortunately, I believed Delaney
Aycock, and thought someone with the State, if not Ed Beck, had loused
things up. I should have known I was being lied to once again by
Brunswick County employees.
After you told me that Ed Beck was not with stormwater, but with Sewer,
I began to put two and two together. It did not add up that Delaney
Aycock had received a letter clearing Taylor "3 or 4 weeks ago" when
Jerry Parker from CAMA had just advised people interested in purchasing
a lot that there were "major stormwater problems with the subdivision"
only 2 weeks ago.
I went to Bolivia Friday afternoon to get a copy of the letter, if it
existed. There is no letter from Ed Beck or anyone else. Delaney Aycock
flat out lied to me. I was, needless to say, furious I am sure Ed
Beck is not amused either at having his name used in a lie. I intend to
have a talk with Wyman Yelton, the County Manager, about this first
thing Monday.
I will also talk with Yelton about withholding permits, inspections and
C011s. Aycock has no intention of doing so and never did. As soon as
Taylor had done all he could do on the house, Aycock issued more permits
and resumed doing inspections on September 20. When I called him on it,
he lied to me about a letter from Ed Beck, thinking I would never know
the difference. At least, as of Friday afternoon, Ta*lor had not been
issued any further building permits for this subdivision.
I look forward to hearing from you at your earliest convenience about
Erma poi the other matters we discussed.

The Wilmington Regional Office received a revised Stormwater Submittal for the The Beach at
Brick Landing on October 3, 1994, in response to the Notice of Violation issued on July 5, 1994. A
preliminary review of that information has determined that the submittal for the subject project is not
complete. The following information is needed to continue the stormwater review:
1. The issue of the site grading at the corner of the Kelly property and at the end of the cul-
de-sac has not been addressed. Ms. Kelly alleges that incorrect grading of the site has
resulted in an increase in runoff onto her property. A visual inspection of the site would
seem to uphold that statement. The approved plans show that the grading was to be
accomplished so that runoff was directed away from the Kelly property. The grading of
the area around the cul-de-sac is very confusing. I am not convinced that the "as built"
grading is effective in directing the stormwater into the infiltration basin.
2. Your calculations for infiltration basin design have not been sealed.

I have attempted to piece together the events surrounding Friday, October 14, 1994, relating to
The Beach at Brick Landing. I returned a call to you around 1:30 p.m. on Friday and we discussed the
ongoing construction of Mr. Taylor's home, the start-up of another home on one of the four lots under
Notice of Violation, the status of the revised stormwater review, the status of the grading problem
affecting your property, and whether or not the State was going to fine Mr. Taylor. I responded that I
did not understand how another house could be under construction, or how Mr. Taylor's home could
continue under construction, given that the revised stormwater submittal had not been approved. I said
I would call the building inspector, Mr. Delaney Aycock, and fmd out information from him. You said
that Mr. Aycock told you that Mr. Taylor had told him that Mr. Taylor had satisified the State and had
a letter from Mr. Ed Beck of this Office indicating the compliance status of The Beach at Brick Landing.
I said that I would fmd out what was going on.
I spoke with Mr. Delaney Aycock, Brunswick County Building Inspections, later Friday
afternoon. He said Mr. Taylor had been in to see him, and had assured Mr. Aycock that he was in
compliance with the Stormwater regulations. Mr. Aycock did not request a copy of the letter for
verification, and building inspections were started up. The second home under construction that we spoke
about was issued it's permits several months before the Notice of Violation was issued. The owner
elected to delay construction until now. It only appears that a building permit was issued during the time
that no building permits were to be issued. There is nothing that this Office can do to revoke the
building permit, but Mr. Aycock will discontinue inspections of the 2 homes under construction
immediately and will not issue building permits for the two remaining lots under Notice until a copy of
the revised Certification letter has been received.

Later on Friday, I spoke with Mr. Ed Beck of this Office. He denied writing any letters to Mr.
Taylor indicating compliance with the Storwmater regulations. Mr. Beck works with the permitting of
sewer systems and various other duties, but he does not deal with the Stormwater program, and does not
issue Stormwater Certifications.
I also spoke with Mr. Don Covil, the consulting engineer for Mr. Taylor who is with Houston
and Associates, the morning of October 17, 1994. I asked for the status of the submittal, and was told
that the revised submittal had been sent to this Office on September 29, 1994. A review of my incoming
mail shows that the project was received by this Office on October 3, 1994 and is awaiting review for
compliance.
As to your other concerns, I will not issue a Stormwater Certification until all the items listed
in the Notice of Violation have been satisfactorily addressed. The issue of alleged grading so that your
property receives an increased amount of runoff may end up as a civil matter, depending on the response
to the Notice of Violation. The State does not review projects for flood control, and can place no
minimum requirements for flood control on developers. Local governments are encouraged to develop
minimum standards for the control of floodwaters.
I will be reviewing the project's revised plans shortly. Please call me at [phone] next
week if you would like an update on the status of this project.

feet equals 3,800 cubic feet. My calculation comes up to be 6,375 cubic feet. This amount
of volume is not available in the basin.
2. Basin 2 - Please explain how the runoff volume from 1-1/2" of rain over 50,000 square
feet equals 4,700 cubic feet. My calculation comes up to be 6,250 cubic feet. This amount
of volume is not available in the basin.
3. Regardless of the fact that these basins were obviously undersized, they must be sized to
handle the proposed volume. If the additional 4 lots were not proposed, then this Office
would not go back and request a change to the basins, however, you have shown through
the calculations that the volume is not adequate.

The developer of The Beach at Brick Landing has decided that the next
phase of development will entail the construction of four single-family homes
within Stormwater Basin #2 rather than eleven multifamily units for which
the stormwater system was originally designed. This will result in a
significant reduction in the amount of built-upon area when compared to
original plans.
We are pleased to submit for your review and approval three (3) copies
of the Phase 2 Plan, three copies of the executed DEM stormwater submittal
forms, three copies of supporting calculations, and a letter from the
developer requesting transfer of the Certification of Compliance to a new
owner of the property. Please note that the allowable built-upon area for all
single-family lots is set at 3,500 SF. This entails an increase (from 2,720 SF)
in the amount of built-upon area for the original twelve lots, but the net
result is still a significant reduction in the total amount of built-upon area for
the project. The calculations document the reduction in built-upon area.

On October 23, 1990, a revised Certification of Compliance with Stormwater Regulations,
Number 901018, was issued to you for The Beach at Brick Landing, located in Brick Landing Plantation,
at the intersection of NCSR 1143 and NCSR 1155. As stated in the Certification of Compliance:
Any additional construction other than what is shown on the approved plans must be
resubmitted as an additional phase. Future development of this tract must be
submitted as an additional phase and approved independently of this certification.
On July 1, 1994, Regional Office Staff conducted a compliance inspection of the project's
stormwater facilities and found additional,unapproved construction underway. Please find attached a copy
of the completed form entitled "Stormwater Compliance Inspection Report". The report summarizes the
fmdings of the inspection. Our records indicate that the required Professional Engineer's Certification
has been received. Additionally, the following conditions were observed during the inspection and are
in violation of the Certification:
1. Construction of the next phase of this development without an approved Stormwater
Management plan.
2. Grading of the site which is not in accordance with the approved plan.

Please provide the appropriate documentation requesting transfer of the Certification of
Compliance to him. You are required to notify this Office of any change in ownership
within 30 days.
Operation of the stormwater system prior to submission of revised plans, and calculations, and
the above conditions, are violations of 15A NCAC 2H.1003 and are subject to enforcement action
pursuant to NCGS 143-215.6A including the assessment of civil and criminal penalties.
Failure to provide the required "Plan of Action" which designates the date by which the above
items will be permanently resolved, prior to August 1, 1994, will result in the initiation of appropriate
enforcement action by this Office. That action may include recommendations for the assessment of
penalties and/or revocation of the Certification. Revised plans and calculations must be received in this
Office prior to August 15, 1994.

By copy of this Notice of Violation to Mr. Robert Tucker, this Office is requesting that he
consider withholding the building permits and Certificates of Occupancy for this subdivision until this
matter is resolved. Additionally, all construction currently underway and all lot transfers should cease

This letter is with reference to our recent meeting at your office in Shallotte
concerning the project known as The Beach at Brick Landing. The puapose of this
meeting was to disca'ma the current status of the project as it relates to the Chi
permit your clients received for the project. AS you are aware one of the conditions
of this permit was that all future development on this site must be approved by
modification of the existing permit.
The stormwater approval that DEM has recently received from you is only one
segment of the final material that we need to begin the final processing of the
application. As we discussed during our meeting this office needs an updated version
of the development plans for the site. It would appear that the proposed swimming
pool in the original plans should be removed from the revised set. Also, The status
of the multi-family units should be explained (i. e., how soon do your clients intern
to start these units?) . The question of the pier(s) needs to be resolved. The local
CAMA program has had several requests for piers. My review of the file information
does not indicate that this site has riparian access rights. The 'new deed calling for
a pier on Lot 8 is for a private pier. We do not consider a sub-division pier to meet
the private category. Therefore there is the need for us to meet with your clients to
try to resolve this problem.

Professional Engineers Certification for the Beach at Brick
Landing's stormwater controls. This letter is to advise you that
this Office considers the stormwater controls at The Beach at
Brick Landing to be in compliance with 15A NCAC 2H. 1003 as the
conditions listed in the Second Notice of Violation issued on
February 5, 1991, have been satisfactorily addressed.
Your cooperation in correcting the deficiencies which
previously existed in the stormwater controls is appreciated. It
is recommended that you maintain the swales and infiltration
basins in their existing condition by following the guidance
provided in the Operation and Maintenance .Plan which Houston and
Associates Consulting Engineers, have drawn up for the site.

THIS AGREEMENT, made and entered into this the 6 ill day of June,
1991, by and between the US Army Corps of Engineers, party of the first
part; and Beach at Bricklanding Associates, party of the second part; and
Beach at Bricklanding Homeowners Association, party of the third part,
WITNESSTH:
THAT WHEREAS, the party of the second part desires to encroach on
the right-of-way easement of the party of the first part, on the property
owned by the party of the second part, with the construction of a
stormwater collection and treatment facility consisting of dry infiltration
basins, piping, stone riprap, and stabilization measures consisting of turf
grass and common grass, in accordance with the State of North Carolina
Department of Environment, Health and Natural Resources, Division of
Environmental Management, Stormwater Runoff Disposal rules as specified
under Administrative Code Section: 15 NCAC 2H .1000, and as specifically
shown on engineering drawings titled "The Beach at Bricklanding",
prepared by Houston and Associates, P.A., Consulting Engineers, Post Office
Box 2927, Shallotte, North Carolina 28459.
WHEREAS, it is to the material advantage of the party of the second
part to effect this encroachment, and the party of the first part, in the
exercise of authority conferred upon it by statute, is willing to permit the
encroachment within the limits of the right-of-way as indicated, subject to
the conditions of this agreement;
NOW, THEREFORE, IT IS AGREED that the party of the first part
hereby grants to the party of the second part the right and privilege to
make this encroachment as shown on the attached plan sheet(s),
specifications, and special provisions which are made a part hereof upon
the following conditions, to wit:
1. That the installation, operation, and maintenance of the
above described facility will be accomplished between the
State of North Carolina and the party of the second part and
that the party of the first part shall be held harmless from
any responsibility associated with the proposed
encroachment.
2. That the party of the first part realizes that this is a special
situation in that .the property, of the party of the second
part which is within the easement of the party of the first
part, is limited for the intended use as a dredge spoil area
by the party of the first part; however, the party of the first
part assumes full.. and continuous authority to utilize the
easement as allowed under the existing easement
agreement.

3. That the party of the second part agrees to take whatever
measures may be prescribed by the laws in effect at the
time to allow the party of the first part full use of the

taking said measures shall be borne by the party of the
second part.
4. That the party of the first part hereby disclaims any
responsibility for the compliance of the encroachment, by
the party of the second part, with any laws, ordinances,
policies or rules of any regulatory agency.
5. That when title to the subject that constitutes the aforesaid
encroachment passes from the party of the second part and
vests in the party of the third part, the party of the third
part agrees to assume all responsibilities and rights and to
perform all obligations as agreed to herein by the party of
the second part.

On January 7, 1991, regional office staff conducted a site
inspection at The Beach at Brick Landing. The following items of
the November 29, 1990, Notice of Violation remain unresolved:
( 1) Piping has been installed to connect the slotted vain
drain to infiltration basin #1, rather than routing the
stormwater through a. swale as indicated on the approved
plans . Additionally, the infiltration basin has been
filled in with sand.
(2 ) The diversion spillway for infiltration basin #2 has
not been constructed.
( 3 ) Infiltration basin #2 has been excavated to such a
depth that no apparent separation exists between the
bottom of the infiltration basin and the groundwater
table. Please. note that the addition of sand from the
surrounding area has not resolved this item.
Regulation 15A NCAC 2H . 1003 (h) ( 7 ) provides that •
infiltration systems must not be sited on or in fill
material .

In addition, on July 11, 1990, October 25, 1990, and again on
November 29 , 1990, this Office requested documentation be
provided that the Army Corps of Engineers does not consider the
infiltration basins to be permanent structures . This would
satisfy the condition in CAMA Permit No. 49-89 that no permanent
structures are to be constructed in the Corps right-of-way. It is
my understanding this question can be addressed by Ms . Meredith
McClathey of the Corps Right-Of-Way Section.
You are requested to provide this Office with a written
response to the above concerns on or before February 28, 1991,
which includes corrective actions to be undertaken to resolve
these deficiencies . Failure to satisfactorily address the items
identified in this Notice will result in appropriate enforcement
action being initiated by this Office. The action may include a
recommendation that the Stormwater Certification be revoked
and/or a recommendation for the assessment of civil penalties .

Dear Mr. Atkins:
Your letter of December 13, 1990 indicated that item number 5 of
DEM's November 29 letter remained unresolved. This item related to the
excavation of infiltration basin #2. The basin had been excavated about two
feet below the design elevation.
It is our opinion that this problem can be corrected by refilling the
basin with native soil to the desired bottom elevation. The characteristics of
the soil are homogeneous across the entire site. Simply pushing adjacent
native soil into the excavated basin should provide a soil profile which will
function the same as the original soil. This is especially true considering the
native soil is "loose" and has a sandy texture.
We appreciated your attention to this matter. Please let us know if you
have any further concerns.

Response to DEM Letter of 11/29/90
Dear Mr. Howard:
Your letter of November 29, 1990 to Mr. William Taylor raised several
points of concern relative to the subject project. The Developer would very
much like to take care of all the points as soon as possible; however, it has
been our understanding that DEM has taken the position that no further
construction can take place within the COE right-of-way until the COE
matter is taken care of. This understanding is based on the content of
several letters from DEM as well as conversations with DEM personnel.
Please provide written authorization to proceed with items 2, 3, 4, and 5,
and we anticipate that these items can be taken care of within a 30 day
period.
Item number 1 of the November 29 letter dealt with the existence of
piping rather than an open channel to carry stormwater from the road
toward Infiltration Basin # 1. This approach was part of the revised
storinwater plan submitted to DEM on October 2, 1990. Upon review of our
revised plan you will see that there is still approximately 40' of grassed open
channel upstream of the infiltration basin even with the piped section as part
of the project. Based on our October 25, 1990 telephone conversation with
Ms. Finn, we understood that the COE matter (again) was the only thing
holding up plan approval. The Developer, therefore, decided to proceed
with pipe construction since it was largely out of the COE right-of-way.

You are undoubtedly aware that we have made numerous efforts to try to
get the COE to take a position in writing relative to this matter. Our latest
effort was to schedule a meeting on site with Ms. Meredith McClathey for
Wednesday, December 5 at 10:00. At the time of the meeting, Mr. Jay
Houston and I were at the site along with the developer and utilities
contractor. Unfortunately, Ms. McClathey did not show up. Needless to say,
all concerned (including DEM, I'm sure) have been very frustrated with this
whole affair. We are committed, however, to keep on trying, and request any
assistance DEM can provide to get the COE to take a position as soon as
possible.
Your attention to this matter is appreciated. We look forward to
receiving authority to work within the COE right-of-way.

Stormwater Regulations, Number 900224 , was issued to you for The
Beach at Brick Landing. In part, that Certification reads as
follows :
This Certification shall be effective from the date of
issuance until rescinded and the project shall be.
constructed and maintained in accordance with the plans and
specifications approved by the Wilmington Regional Office.
On November 16, 1990, regional office staff conducted a site
inspection of the subject project. The road has been constructed,
grading has taken place, and dwellings are under construction. The
following conditions observed during the inspection are contrary
to the Certification, and are considered violations of the
Certification:
( 1) Piping has been installed to connect the slotted vain

(2 ) The spillway crest (No. 2) is longer than the plans
indicate. This may result in runoff exiting the site
directly rather than being routed via the swale to
infiltration basin #2 .
(3) The diversion spillway for infiltration basin #2 has not
been constructed.
(4 ) Swale #2 has not been graded to adequately route the
stormwater to infiltration basin #2 .
(5 ) Infiltration basin #2 has been excavated to such a depth
that no apparent separation exists between the bottom of
the infiltration basin and the groundwater table.
In addition, on July 11, 1990, and again on October 25, 1990,
this Office requested documentation be provided from the Army
Corps of Engineers that the infiltration basins are not
considered to be permanent structures . This would satisfy the
condition CAMA Permit No. 49-89 that no permanent structures are
to be constructed in the Corps right-of-way. It is my
understanding this question can be addressed by Ms . Meredith
McClathey of the Corps Right-Of-Way Section.
It is requested that you provide this Office with a written
reply on or before December 21, 1990, outlining corrective
actions to be undertaken to resolve these deficiencies, and
include in the response a time schedule for completing these
actions . The actions to resolve the noncompliance must be
completed by January 31, 1990 . Failure to satisfactorily address
the items identified in this Notice may result in enforcement
action, including assessment of civil penalties, by this Office.

The Beach at Brick Landing

Dear Mr. Taylor:
The Wilmington Regional Office received the revised
Stormwater submittal for construction of 12 single family homes
at The Beach at Brick Landing on October 12, 1990.
In a telephone conversation today with Mr. Don Covil of Houston
and Associates, I explained that this Office can not approve the
revised stormwater submittal until we receive the information
requested July 11, 1990 by Mr. Dave Adkins, Water Quality
Regional Supervisor. In particular, Mr. Adkins requested the
following:
Condition Number 4 on CAMA Permit No. 49-89 states tat no
permanent structures will be constructed with the AIWW
right-of-way. Approved stormwater plans (and the revised
plans received October 12, 1990) indicate two Stormwater
Infiltration basins are to be built within the AIWW
right-of-way. Please provide this Office with documentation
from CAMA and The United States Army Corps of Engineers that
these basins are consistent with condition No. 4 ad the
above referenced permit.
