Dear Mr. Taylor:
The Wilmington Regional Office received the revised
Stormwater submittal for construction of 12 single family homes
at The Beach at Brick Landing on October 12, 1990. Based on our
review of the project plans and specifications, we have
determined that the infiltration systems comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1003 (h) .
This certification shall be effective from the date of issuance
until rescinded and the project shall be constructed and
maintained in accordance with the plans and specifications
approved by the Wilmington Regional Office. Any additional
construction other than what is shown on the approved plans must
be resubmitted as an additional phase.
Upon completion of construction and prior to operation of
the infiltration systems, an engineer's certification must be
received from a professional engineer certifying that the
infiltration system has been installed in accordance with the
approved plans and specifications. The attached certification
should be received by this office within 30 days of completion of
construction.

Brief Explanation: This Certification of Approval applies to the
revised plans submitted on October 12, 1990 which include the
development of 12 lots with single family homes. The first 1.5
inches of runoff from impervious surfaces will be infiltrated in one
of two infiltration basins. Future development of this tract must be
submitted as an additional phase and approved independently of this
certification.
Revisions to previous plans consist of the elimination of the
pool and clubhouse. Also, the location and shape of infiltration
basin #1 was changed.

Engineer's Certification of Completion of Construction
Dear Mr. Howard:
Pursuant to the rules and regulations of the Stormwater Management
Act governing the subject project, and in response to the comments received
from DEM and CAMA, we hereby certify that the stormwater control devices
have been installed substantially in accordance with the approved plans and
specifications.
Attached is a copy of a Three Party Agreement which has been
executed by the US Army Corps of Engineers, the Beach at Bricklanding
Associates, and the Beach at Bricklanding Homeowners Association. This
agreement is the vehicle which allows Corps approval for the encroachment
of the stormwater dry infiltration basins and related appurtenances into the
Corps right-of-way. Also attached is a copy of a deed, which clears up the
ownership of the stormwater system property, from one of the property
owners to the homeowners association.
By copy of this letter, we are advising CAMA, the Land Quality Section
of DEM, and the Brunswick County Building Inspections Department that the
stormwater issue is resolved and that all outstanding comments and
conditions have been met.

Dear Ms. Finn:
The developer of The Beach at Brick Landing has decided not to
construct the swimming pool as shown on plans submitted to your office to
date. Because of this, we have been able to move Infiltration Basin # 1 to a
more suitable location. The new location and configuration are illustrated on
Plan Sheet # 4. You will note, in your review, that the new basin has a surface
area and capacity which exceeds that of the ori,rinal basin. You will also note
that the bottom elevation of the basin has been lowered from 9' MSL to 8'
MSL. (Our field investigation indicates that the ground water elevation is
lower than 6' MSL at the new location.) It is our understanding that your
office will perform it's own field investigation to help evaluate these
proposed revisions.
In addition to moving the basin, we have also converted approximately
90 feet of the 140 feet of open channel upstream of the basin, to a piped
section. This change was made at the Developer's request due to the
proximity of the 90-foot section to a residential structure.
Enclosed are two copies each of the following documents which present
and/or address the proposed revisions:
1. Plan Sheet # 4
2. Plan Sheet # 10
3. Calculations of basin capacity and diversion spillway hydraulics
4. Calculations of new pipe section hydraulics

We have received a request from the NC Department of Environment,
Health, and Natural Resources, Division of Environmental Management, to
provide documentation relative to the COE position of not objection to the
subject project. Mr. Don M. Covil, P.E., of our office, has contacted the Corps
of Engineers several times by telephone regarding this project.
Enclosed is a copy of our response letter, dated August 3, 1990, to
comments received from DEM on July 7, 1990. You and Mr. Simpson were
copied on the August 3rd letter. The DEM request is prompted by
comments received from the CAMA review.
It is our understanding, from telephone conversations with you and Mr.
Simpson, that COE has no objection to the utilization of the dredge-spoil
easement fronting this property for a stormwatcr infiltration basin. We are
requesting that you provide documentation in the form of a letter to either
DEM or us as soon as possible since the burden of proof for non-objection by
COE has apparently fallen on our shoulders.
