Dear Mr.Ferris:
On September 27, 2023, a site inspection was conducted for the Albemarle City Municipal Solid Waste
Landfill facility located at 40592 B Stony Gap Rd, Stanly County,North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. Darren Preslar was also present during the inspection and his
time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is
covered by NPDES Stormwater General Permit NCG120000 under Certificate of Coverage NCG120074.
Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as
Jacob's Creek, class WS IV waters in the Yadkin Pee-Dee River Basin.
As a result of the inspection,the facility was found to be noncompliant with the conditions of the NCG120000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations
made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty
assessment of up to $25,000 per day for each violation. If you or your staff have any questions, comments,

Inspection Summary:
The Stormwater Pollution Prevention Plan (SWPPP)was available and complete, but the documentation was incomplete.
The facility has conducted qualitative and analytical monitoring, but the records were not available, and the samples are not
being taken quarterly. The facility has several outfalls,and most were overgrown which affects the pond capacity. The
facility has exceeded the benchmark limitations for fecal at most outfalls and COD at outfall 02. If you have questions,

Corrective Actions
1. Cut down woody vegetation in the ponds.
2. Follow the Tier responses outlined in the permit.
3. Submit all SWPPP documents missing during the inspection including employee training records and non-stormwater
inspection reports to the Mooresville regional office by December 15, 2023.
4. Immediately begin qualitative and analytical monitoring requirements and submit the reports to the Mooresville regional
office.
