(for Occidental Chemical Corporation), Hart & Hickman, PC (H&H) is submitting the enclosed Groundwater Quality Monitoring: Compliance Report Forms (GW-59A and GW-59) and laboratory analytical report for groundwater samples collected during November 2022 in accordance with the Occidental Chemical Corporation Surface Disposal of Residuals (SDR) Permit No. WQ0001492 for the Elementis Chromium Castle Hayne Manufacturing Facility. Under the terms of the SDR permit, groundwater within an established Compliance Boundary (generally surrounding the Quarry as depicted in Figure 1) is monitored on a semi-annual basis (during July and November) for chloride, total chromium, total iron, total nickel, pH, and total dissolved solids (TDS). Background Information The facility is currently operating under a 1999 Corrective Action Plan (I -CAP) for remediation of compounds of concern (COCs) in groundwater above standards by processes of natural attenuation pursuant to 15A NCAC 2L .0106(1). The COCs addressed by the 1-CAP include chlorides, iron, pH, and TDS. The objective of the I -CAP is to reduce COC concentrations which exceed groundwater standards at or outside of the compliance boundary established in the SDR permit by natural attenuation. The target cleanup concentrations for the COCs except total iron are the 2L standards. For total iron, the target cleanup concentrations are background levels established under a now -expired Special Order by Consent (SOC) agreement. Annual natural attenuation groundwater monitoring reports are submitted to the NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR) to satisfy the 1-CAP monitoring reporting requirements. 2923 South Tryon Street, Suite 100 3921 Sunset Ridge Rd, Suite 301 Charlotte, NC 28203 Raleigh, NC 27607 www.harthickman.com 704.586.0007 main 919.847.4241 main N Division of Water Quality December 27, 2022 Page 2 The results of the November 2022 monitoring indicated COCs above 2L standards or background. Immediate notification of elevated iron, chloride, and TDS concentrations and pH levels outside the 2L standard range was not made to DWR after receipt of the November 2022 analytical results because these conditions are already known to DWR and are addressed under the 1-CAP. Immediate notification of elevated chromium in well MW-24/CPW-4D was not made after receipt of the November 2022 analytical results because this condition is attributable to the Plant Process Area (PPA) of the site and is already known to DEQ. Chromium impacts associated with the PPA are being managed under an Administrative Agreement (AA) for Voluntary Assessment and Remedial Action under the Inactive Hazardous Sites Branch (IHSB) Registered Environmental Consultant (REC) Program, DEQ ID NCD057454670. Because chromium and nickel are not COCs in the 1-CAP, if chromium and/or nickel concentrations are detected above the 2L standards in the compliance wells (other than chromium in well MW-24/CPW-4D), notification is made to DEQ in accordance with the SDR permit. November pH Values Based on initial review of the November 2022 and prior pH data, pH levels below the 2L standard range were measured in significantly more wells during November 2022 than during previous SDR permit compliance monitoring events, and the November 2022 average of measured pH levels for the sampled wells (5.75 s.u.) was approximately 1.5 s.u. lower than the average of measured pH levels for the wells during each compliance monitoring event completed in the period between July 2020 and July 2022 (when averages for each event ranged from 7.05 to 7.86 s.u.). Equipment used to measure pH in the field was properly calibrated by sampling personnel using multiple pH standard solutions (pH 4.0, 7.0, and 10.0 s.u.) prior to the start of sampling on each day of the event. Based on historical data, it appears that pH levels measured during the November 2022 event are artificially low. H&H discussed this issue with the vendor (Eastern Solutions, LLC of Charlotte, NC) who supplied the rental equipment used by H&H sampling personnel to measure pH in the field. Eastern Solutions indicated they had recently been notified by other customers of similarly apparent low field -measured pH values, and that they completed in-house testing of calibration solutions from multiple suppliers. Based on the testing performed by Eastern Solutions, elevated pH levels (approximately 1 s.u. high) were measured in a batch of 4.0 s.u. calibration solution which was distributed with rented water quality meters. Based on the information presented above, the November 2022 pH data reported in the GW-59 forms and the attached table for each well were adjusted by adding 1.25 s.u. to the field -measured pH value. This correction results in an average pH level of 7.00 s.u. for the wells during November 2022, and is slightly lower than the lowest average of measured pH levels for the wells during a compliance monitoring event completed in the period between July 2020 and July 2022 (7.05 s.u. during November 2021). November 2022 Non -Compliance Summary Results of analysis of the November 2022 SDR compliance monitoring event indicate total chromium was detected above the 2L standard of 10 micrograms per liter (µg/1) in compliance monitoring well MW-19/CPW-9S (31.7 µg/1). Total chromium is not a COC which is being addressed by the 1-CAP (discussed above). (H&H received the analytical laboratory report after business hours on December 7, 2022.) In addition, a non-compliance notification report was submitted to the DWR Wilmington Regional Office on December 12, 2022. As shown in Figure 1, MW-19/CPW-9S is located along the northwestern perimeter of Quarry Section 1. Residual solids generated by the Elementis Chromium Castle Hayne Manufacturing Facility's wastewater treatment plant (WWTP) are currently disposed in Quarry Section 2, and therefore not in the area of well MW-19/CPW-9S. Prior to November 2022, total chromium was most recently detected above the 2L standard in MW-19/CPW-9S during November 2008 (12 µg/1). Based on the low frequency of total chromium detections above the 2L standard in samples collected from well MW-19/CPW-9S prior to November 2022 and the long period of time since total chromium was previously detected above the 2L standard in the well, the November 2022 detection of chromium above the 2L standard in MW-19/CPW-9S is an anomalous occurrence, and a likely/potential source of the detection is not known. Therefore, the non-compliance report submitted to DWR recommended no additional assessment of the anomalous detection prior to the next SDR Permit -required sampling event in July 2023. Future detections (if any) of total chromium in SDR Permit compliance samples collected from the well will be addressed in accordance with Conditions I.1 and I.2 of the current SDR Permit.
