existing and future wastewater of the Development to be accepted and discharged into said governmental
system, and shall convey or transfer as much of the Disposal System and such necessary easements as the
governmental unit mayrequire as condition of accepting the Development's wastewater.
8. Recognizing that it would be contrary to the public interest and to the public health, safety and welfare for
the Association to enter into voluntary dissolution without having made adequate provision for the continued
proper maintenance, repair and operation of its Disposal System, the DEVELOPER shall provide in the
Association Bylaws that the Association shall not enter into voluntary dissolution without first having
transferred its said system and facilities to some person, corporation or other entity acceptable to and

Susan: Please find attached. Sorry we missed that. All LS will have backup generators.
I am attaching the Bill which was approved in the House and Senate on 9/22, The Governor vetoed it and then the
veto was overruled by the Senate on 10/10 (effective date).
If you determine there is any issue with not applying the lower flow rate; we are fine with using the current rates
in order to get the fast track permit processed. We can amend it later if need be.
At this point obtaining the permit is more important to our client given that Pulte Homes is waiting on the permit
approvals prior to closing on the property.
I am attaching FTA and FTSE with the prior flow rates that you can use should you determine the new flow rates
will slow the processing of the permit. Trying to cover all options
Thanks again for assisting us with the project.

Mark —just had a quick moment to look over the resubmittal. Would you correct/provide information on Part VIII.6
on power reliability for LS1? That info seems to be missing (was not checked).
I assume folks can use the 75 gpd/BR figure now? I'll double check on that to see when the effective date was.

In the nick of time! I was getting pressure to return this.
I'm confused about the increase in fees right now -that passed legislatively. Hopefully we're grandfathering that in,
but I'll keep you posted.

Hi Mark -
I've given this an initial review and have a few questions/comments.
1. Part VI.2. should be checked YES as you submitted a Developers agreement. And with that - please see the
updated agreement at the link and have Mr. Smith complete that (sorry the one attached does not have the
current Director's signature block). https://edocs.deq.nc.gov/WaterResources/DocView.aspx?
dbid=0&id=2250406&cr=1 New Dev form provided with Signature
2. The units will be 3 bedrooms? (for 360 gpd/unit?). We have changed to 4 bedroom and are using new
approved flow rate of 75 GPD/bedroom (300 GPD per lot).
3. 1 believe there is an error on part VI. 8. of the application - that should be 64, 920 gpd corresponding to the
flow in part VI.7.? Corrected
4. So there will be no high priority lines with this project? Just wanting to reconfirm that. Part IX.7. of the
application. Correct no high priority lines.
5. We'll need to have a flow tracking sheet completed for this project (FTSE 10-18), found here
httDS://www.dea.nc.Rov/about/divisions/water-resources/water-ouality-DermittinL/muniCiDal-nodes
pretreatment-and-collection-system/collection-systems/sewer-extension-permitting I realize this plant is
new, but this needs to be started with this project (and submitted with subsequent phases). FTSE added
with signature
Thanks much. Let me know if you have questions.
