There is currently an old bulkhead with a concrete pad in the northeast corner of the lot, along with pilings, an existing gravel driveway, and an old lift of some sort and some old machinery in the water. The applicant could not provide any past NCDWR or NCDEMLR permits. Quality Marine, LLC Field Report 202 Old Cherry Point Road Page 2 9. Project Description The existing 4.47-acre (194,713.2sgft) tract is located at 202 Old Cherry Point Road, New Bern, Craven County. The site is bordered by the Nuese River to the east and Northwest Creek to the north. The property is also boarder by DOT property to its west side. The property shoreline is partially stabilized with a bulkhead, has an elevation of 18' above NWL and has 610' of shoreline. The property shoreline is sandy beach for parts and other parts have black needlerush and bullrush shown by the survey done. The waters of the Neuse River adjacent to the project area are classified as "SC, Sw, NSW" by the Division of Water Resources. There are no nearby Primary Nursery Areas. According to the maps provided by the Shellfish Sanitation Section of the NC Division of Marine Fisheries, the water of the Neuse River adjacent to the property are predominately closed to shellfish harvesting. No SAV were observed within the project area. 10. Proposed Project The applicant is proposing to dredge a 1600' x 75' access channel, which would extend from the USACE's Neuse River maintained navigational channel line to the proposed turning basin, to an average depth of -10.5' below normal water level (BNWL). The bottom of the access channel would be as deep as the USACE's navigational channel, where the access channel intersects the USACE's Navigational Setback Line (i.e., -10.5' BNWL), and per the applicant would ensure that a berm between channels would not be created. Per the applicant dredging would also be necessary within the proposed 165' x 175' turning basin and would provide access and egress to/from the proposed travel lift basin. The travel lift basin, which would be constructed wholly within uplands, would be approximately 145' x 50', have a 3' cap, would have an average depth of -10.5' BNWL, would be contained by either a sheet pile or wooden bulkhead, and installed after the basin has been excavated. In order to stabilize the upland basin area, the applicant is proposing the construction of a 3' wide by 145' long bulkhead. The applicant would also install a temporary sheet pile coffer dam along the waterward side of the existing wooden bulkhead, as support during the excavation process. Both the coffer dam and existing bulkhead would be removed after the upland basin has been excavated and the new bulkhead has been installed, at which time water would slowly be introduced into the new upland basin area. Conventional dredging and excavation, such as a clam bucket and hydraulic pumping, are the anticipated work methods. Per the applicant, the estimated dredge volume is approximately 9538 cubic yards, which includes the Access channel and turning basin. Approximately 4629 CY of material would be excavated above NWL, to create the upland travel lift basin. This material would be used to create the spoil disposal basin. Quality Marine, LLC Field Report 202 Old Cherry Point Road Page 3 In order to contain dredge material onsite, a settling basin, with 8' berms and a series of silt fence baffles and an outfall structure, would be constructed. The berms are proposed to be initially constructed out of the travel lift basin material, and finished by using suitable dredge material, to meet the proposed 8' berm height. The basin would have a storage capacity of 8,293 CY and will maintain 2' of freeboard during the dredging process. Dredge material would be piped into the western end of the basin, where it will go through a series of baffles. The contractor will be managing the dredged material to expedite the drying process and calculating the volume of dredged material. All dredged material would be stored onsite. During the excavating within open waters, a turbidity/silt curtain would be used to minimize turbidity and contain fines within the work area. According to the applicant a sedimentation and erosion control permit would be secured, prior to undertaking any land disturbing activities. The Applicant is also proposing to utilize part of the existing driveway and is asking to expand it to 15' wide and construct a new rock driveway around the proposed settling basin. The proposed driveway would encompass approximately 14,000 SF and provides access to the travel lift, where a 50' x 50' rock pad would be constructed. No new built upon area is to take place within the 75' Estuarine Shoreline AEC. All existing built upon area would be removed with the construction of the settling basin and travel lift basin. In total, approximately 19,568 SF of built upon area would remain within the project limits after the work has been complete. A parking and/or boat storage area is not provided on the site. The vessels would be removed from the site as soon as they are taken out of the water. 11. Anticipated Impacts: The development would incorporate 148,875 of shallow bottom habitat during excavation within the Neuse River for the access channel and a turning basin. It would also incorporate 7,250 sf of high ground for the travel lift basin and 435 sf for the bulkhead installation with backfill. 47,350 sf of high ground would be filled and disturbed with the spoil placement and land disturbance during construction. There would be no impacts to wetlands, shellfish or SAV resources. The northern side of the project borders the confulence of Scott's Creek and the Neuse River and is contained by a large bulkhead, while the eastern side borders the Neuse River, where an old boat ramp can be found. Numerous pilings extend out into the Neuse from that point of the poperty. Lastly a man made ditch, on the right side of the access road, takes water from Old Cherry Point Road to the wetlands and eventually to the river. See Project Narrative for details of existing site conditions. g. Identify and describe the existing land uses adjacent to the proposed project site. However, there is a 50' vegetated buffer located between the NWL of the Neuse River and the existing developed area where there is no bulkhead. 5. Activities and Impacts a. Give a brief description of purpose, use, and daily operations of the project when complete. The purpose of this project is to install a 100 ton travel lift, with access dock, to hall larger vessels out of the water, within an area where the demand is high. Daily operations will typically be from sun up to sun down, but may be extended during storm events, when threat to property is immenant and time is of the essence. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Heavy equipment, such as a backhoe, front end loader and dump truck will be used to construct the settling and travel lift basins. The machinery will be stored on site, when not in use. Hydralic and mechanical dredging will be used to deepen the channel and turning basin. The vessel will be docked at the project site when not in use. A barge will used to install all the necessary pilings for the proposed dock and settling basin outfall pipe. The barge will be docked next to the bulkhead, when not in use. Prior to beginning excavation of the travel lift basin, a coffer dam will be installed on the waterward side of the existing bulkhead and at the proposed entrance of the basin. Next the travel lift basin will be excavated, from which the dirt will be used to form the berms of the settling basin. Once the settling basin has been constructed, a series of silt fence baffles, with outlets, will be installed within the interior of the basin. Lastly, the settling basin outfall box and pipe will be installed. The slopes of the settling basin will finished using dredge material and will be seeded upon completion. d. List all development activities you propose. The project consists of dredging an 835'x 75' channel, which will extend from the USACE's Neuse River maintained navigational channel line to the proposed turning basin. The basin will be approximately 170' x 174' and will provide access and egress from the proposed travel lift basin. The proposed travel lift basin will be constructed wholly within uplands, will be approximately 145' x 50' and contained by either wood or sheet pile bulkhead. (see Attachment 5) h) Shellfrshing Closure: The area is closed to shellfishing (see Attachment 6) 2) Site History and Existing Conditions: In 1998, this site was used as a lay down yard by the NC Department of Transportation (DOT), during construction of the NC Highways 17 and 55 bridge system (see Attachment 7). Prior to and after that period, it served as a boat landing and was used to store boats, etc. The site is bordered by NC Hwy 17 N and Old Cherry Point Road, to the west, Scott's Creek, to the north, where the creek meets the Neuse River, which borders the property, to the east. Residential development borders the property, to the south. An existing bulkhead extends along the northern property line and around the peninsula, where an old boat ramp can be found. Off of the same peninsula are several wood and metal dolphin pilings that extend out toward the USACE's navigational channel. South of the ramp is a sandy, vegetated shoreline, where outcrops of Giant Cordgrass (Spartina cynosuroides). A non -relatively permanent water (RPW or ditch) extends from the southwest corner of the property approximately 315 feet east, where it discharges into Section 404 wetlands. Within the uplands on the project site, remanent concrete pads, compacted rock parking areas and road beds (i.e., built upon area) have been surveyed and encompass approximately 23,480 SF/ 0.539 AC. Numerous dolphin piles, which were utilized during the DOT's construction of the bridge system, remain offshore of the peninsula and old access channel. Please see Attachment 8 for details of the existing conditions. SM&E performed a survey of the existing water depths within the area of the proposed dredging and used NAVD 1988 MLW Datum, where 0.00' MLW equals 2.57' NAVD 1988 (see Attachment 9). S&ME also conducted a geotechnical survey and identified the materials within the proposed dredge area as organic, silty, fine grained soils. Submerged aquatic vegetation was not observed within the project limits. Due to the size of the report, copies will only be furnished upon request. 3) Proposed Project: The project consists of dredging a 1600' x 75' access channel, which will extend from the USACE's Neuse River maintained navigational channel line to the proposed turning basin, to an average depth of -10.5' below normal water level (BNWL). The bottom of the access charnel will be as deep as the USACE's navigational channel, where the access channel intersects the USACE's Navigational Setback Line (i.e., -10.5' BNWL), so as not to create a berm between the two channels. Additionally, dredging will be necessary within the proposed 165' x 175' turning basin, which will provide access and egress to/from the proposed travel lift basin. The travel lift basin, which will be constructed wholly within uplands, will be approximately 145' x 50' and with a 3' cap, will have an average depth of -10.5' BNWL, and contained by either a sheet pile or wooden bulkhead, which will be installed after the basin has been excavated. A temporary sheet pile coffer dam will be installed on the waterward side of the existing wooden bulkhead, as support during the excavation process. Both the coffer dam and existing bulkhead will be removed after the upland basin has been excavated and the new bulkhead has been installed, at which time water will slowly be introduced into the new upland basin area. Conventional dredging and excavation, such as a clam bucket and hydraulic pumping, are the anticipated work methods. At this time, the estimated dredge volume is approximately 9538 cubic yards, which includes the Access channel and turning basin. Approximately 4629 CY of material will be excavated above NWL, to create the upland travel lift basin. This material will be used to create the spoil disposal basin, discussed below. Page 2 of 19 Quality Marine Travel Lift CAMA Major Permit PN S L Cl i To contain dredge material onsite, a settling basin, with 8' berms and a series of silt fence baffles and an outfall structure, will be constructed. As discussed supra, the berms will be initially constructed out of the travel lift basin material, and finished by using suitable dredge material, to meet the proposed 8' berm height. The basin will have a storage capacity of 8,293 CY and will maintain 2' of freeboard during the dredging process. Dredge material will be piped into the western end of the basin, where it will go through a series of baffles. The contractor will be managing the dredged material to expedite the drying process and calculating the volume of dredged material. All dredged material will be stored onsite. Please see Attachment 8 for details. When excavating within open waters, a turbidity/silt curtain will be used to minimize turbidity and contain fines within the work area. The Applicant intends to take all necessary action to ensure that sediment does not leave the approved project area and turbidity is kept to a minimum. Action may include but is not limited to installing silt fence along the wetland line, installing a construction entrance, etc. A S&EC permit will be secured, prior to undertaking any land disturbing activities. The Applicant will utilize part of the existing driveway but will need to expand it to 15' wide and construct a new rock driveway around the proposed settling basin. The proposed driveway will encompass approximately 14,000 SF and provides access to the travel lift, where a 50' x 50' rock pad will be constructed. No new built upon area is to take place within the 75' Estuarine Shoreline AEC. All existing built upon area will be removed with the construction of the settling basin and travel lift basin. In total, approximately 19,568 SF of built upon area will remain within the project limits after the work has been complete. Parking and/or boat storage area is not provided on the site. The vessels will be removed from the site as soon as they are taken out of the water. Please see Attachment 8 for details. Purpose and Need: The purpose of this project is to provide a 100 ton travel lift in New Bern, North Carolina, where this type of facility is in high demand. 4) Threatened and Endangered Species: SEGi consulted the US Fish and Wildlife Service's (FWS) Information for Planning and Consultation (IPaQ site to identify T&E species that may be effected by the proposed project (see Attachment 14). Of the listed species, only the West Indian Manatee (Trichechus manatus) is of concern. To ensure protection of the manatee, dredging work will be undertaken between November 1 and May 31. If this is not possible, the Applicant will adhere to the FWS guidance entitled "GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE, Precautionary Measures for Construction Activities in North Carolina Waters" (see Attachment 9). 5) Cultural and Historic Resources A review of the NC Historic Preservation Office's HPOWEB2.0 GIS Map revealed there are no known historic or cultural resources located within the project limits, and the project is not located within an area designated as a National Historic Place (see Attachment 10). 6) Submerged Aquatic Vegetation While SAV are mapped within close proximity to the limits of disturbance, SAV were not observed during the surveying work. It is anticipated the water depths are too deep, in the proposed work area, for adequate light penetration to support SAV propagation. 7) Section 404 and 10 Wetlands Section 404 and 10 wetlands exist within the property boundaries but are located outside the proposed limits of disturbance (see Attachment 8). 8) Adjacent Riparian Property Owner Notifications: In accordance with 15A NCAC 07J .0204(b)(5), the adjacent property owners (APO), as identified in the permit application, have been notified via certified return mail. Please see Attachment 11, for copies of the certified mail receipts. The manatee is also listed as endangered under the North Carolina Endangered Species Act of 1987 (Article 25 of Chapter 113 of the General Statutes). The U.S. Fish and Wildlife Service (Service) is the lead Federal agency responsible for the protection and recovery of the West Indian manatee under the provisions of the Endangered Species Act. Adult manatees average 10 feet long and weigh about 2,200 pounds, although some individuals have been recorded at lengths greater than 13 feet and weighing as much as 3,500 pounds. Manatees are commonly found in fresh, brackish, or marine water habitats, including shallow coastal bays, lagoons, estuaries, and inland rivers of varying salinity extremes. Manatees spend much of their time underwater or partly submerged, making them difficult to detect even in shallow water. While the manatee's principal stronghold in the United States is Florida, the species is considered a seasonal inhabitant of North Carolina with most occurrences reported from June through October. To protect manatees in North Carolina, the Service's Raleigh Field Office has prepared precautionary measures for general construction activities in waters used by the species. Implementation of these measure will allow in -water projects which do not require blasting to proceed without adverse impacts to manatees. In addition, inclusion of these guidelines as conservation measures in a Biological Assessment or Biological Evaluation, or as part of the determination of impacts on the manatee in an environmental document prepared pursuant to the National Environmental Policy Act, will expedite the Service's review of the document for the fulfillment of requirements under Section 7 of the Endangered Species Act. These measures include: 1. The project manager and/or contractor will inform all personnel associated with the project that manatees may be present in the project area, and the need to avoid any harm to these endangered mammals. The project manager will ensure that all construction personnel know the general appearance of the species and their habit of moving about completely or partially submerged in shallow water. All construction personnel will be informed that they are responsible for observing water -related activities for the presence of manatees. 2. The project manager and/or the contractor will advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act and the Endangered Species Act. 3. If a manatee is seen within 100 yards of the active construction and/or dredging operation or vessel movement, all appropriate precautions will be implemented to ensure protection of the manatee. These precautions will include the immediate shutdown of moving equipment if a manatee comes within 50 feet of the operational area of the equipment. Activities will not resume until the manatee has departed the project area on its own volition (i.e., it may not be herded or harassed from the area). 4. Any collision with and/or injury to a manatee will be reported immediately. The report must be made to the U.S. Fish and Wildlife Service (ph. 919.856.4520 ext. 16), the National Marine Fisheries Service (ph. 252.728.8762), and the North Carolina Wildlife Resources Commission (ph. 252.448.1546). 5. A sign will be posted in all vessels associated with the project where it is clearly visible to the vessel operator. The sign should state: CAUTION: The endangered manatee may occur in these waters during the warmer months, primarily from June through October. Idle speed is required if operating this vessel in shallow water during these months. All equipment must be shutdown if a manatee comes within 50 feet of the vessel or operating equipment. A collision with and/or injury to the manatee must be reported immediately to the U.S. Fish and Wildlife Service (919-856-4520 ext. 16), the National Marine Fisheries Service (252.728.8762), and the North Carolina Wildlife Resources Commission (252.448.1546). 6. The contractor will maintain a log detailing sightings, collisions, and/or injuries to manatees during project activities. Upon completion of the action, the project manager will prepare a report which summarizes all information on manatees encountered and submit the report to the Service's Raleigh Field Office. 7. All vessels associated with the construction project will operate at "no wake/idle" speeds at all times while in water where the draft of the vessel provides less than a four foot clearance from the bottom. All vessels will follow routes of deep water whenever possible. 8. If siltation barriers must be placed in shallow water, these barriers will be: (a) made of material in which manatees cannot become entangled; (b) secured in a manner that they cannot break free and entangle manatees; and, (c) regularly monitored to ensure that manatees have not become entangled. Barriers will be placed in a manner to allow manatees entry to or exit from essential habitat. The calculation is done in three steps: The probability of presence for each week is calculated as the number of survey events in the week where the species was detected divided by the total number of survey events for that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is 0.25. 2. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2. 3. The relative probability of presence calculated in the previous step undergoes a statistical conversion so that all possible values fall between 0 and 10, inclusive. Additional measures or permits may be advisable depending on the type of activity you are conducting and the type of infrastructure or bird species present on your project site. What does IPaC use to generate the list of migratory birds that potentially occur in my specified location? The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCQ and other species that may warrant special attention in your project location. The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding, and citizen science datasets and is queried and filtered to return a list of those birds reported as occurring in the 10km grid cell(s) which your project intersects, and that have been identified as warranting special attention because they are a BCC species in that area, an eagle (Eagle Act 05/31/2023 requirements may apply), or a species that has a particular vulnerability to offshore activities or development. Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds that may occur in your project area. Probability of presence data is continuously being updated as new and better information becomes available. How do I know if a bird is breeding, wintering or migrating in my area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the profiles provided for each bird in your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. Details about birds that are potentially affected by offshore projects 05/31/2023 For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your project area off the Atlantic Coast, please visit the Northeast Ocean Data Portal. Alternately, you may download the bird model results files underlying the portal maps through the NOAA NCCOS Integrative Statistical Modeling and Predictive MaDDinp- of Marine Bird Distributions and Abundance on the Atlantic Outer Continental Shelf project webpage. Bird tracking data can also provide additional details about occurrence and habitat use throughout the year, including migration. Models relying on survey data may not include this information. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to confirm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize potential impacts from your project activities, should presence be confirmed.
