Hi Joey,  

I just spoke with Shannon Healy and she suggested I reply to your email in regards to the 2 items I failed to address in my 
application. 
She said I need to know the amount of seawall that when the lake is at its normal (highest) level, will be touched by the 
water.  I need to know the length of what is touched and the height.  Seawall will be 165 ft. in length and 5 ft in height. 

In regards to the riprap, I know DEFINITELY, we are putting in riprap.  I spoke with the contractor and I think I most likely 
misworded it as us filling in behind the seawall and never mentioned riprap. 

I just hung up with him and he said DEFINITELY, riprap will go behind seawall as well as in front at base of seawall, 
coming out about 3 ft.  That is what Shannon said is needed. 

Also, the water will not come up any higher than 2‐3 ft when lake is at its normal height, and I don't believe the water 
will touch either end of seawall as there is a beach on one side. Possibly the right end it may touch. 

In your email you mentioned as did Shannon something about a Permit 30.  Is that something you can fill out for me 
with the information I provided here or do I need to fill it out?

On September 28, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water 
Quality Certification from the Division for the subject project. The Division has determined that your application is 
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:  

1. The application states that there will be no impacts below the water level of Lake Glenville. A 401 water quality 
certification is only required when impacts will occur to jurisdictional waters. Please verify whether 
jurisdictional impacts will occur and provide dimensions for those impacts. The US Army Corps of Engineers 
determines the extent of jurisdictional features and can assist, if needed. The Corps contact for Jackson County

2. Activity Specific Condition 1 of General Certification 4502 requires that riprap be installed waterward of seawalls 
to ensure protection of aquatic habitat. The application and project plans don’t include riprap; please clarify 
whether riprap will be installed. Please note, riprap is also typically required by the US Army Corps of Engineers 
for eligibility under Regional General Permit 30. Please also indicate whether the Corps has waived this 
requirement. [15A NCAC 02H .0502(a)(4); 15A NCAC 02H .0506(b)(3)] 

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the 
proper consideration of the application. Please provide your response by November 17, 2023. If all of the requested 
information is not received, the Division will be unable to approve the application and it will be denied as incomplete. 
The denial of this project will necessitate reapplication to the Division for approval, including a complete application 
package and appropriate fee.
