Description of projects area and activity: This verification authorizes the permanent impacts to 68 linear feet (0.003 acres) of intermittent streams and 198 linear feet (0.007 acres) of ephemeral streams associated with the installation of a French drain to create buildable space for the residential development. This verification also authorizes 0.002 acres of permanent wetland impacts associated with filling to create buildable space for the residential development and 0.007 acres of temporary wetland impacts to connect the development to an existing sewer line. SPECIAL CONDITIONS: a) Tree clearing must occur between October 15 and March 31, during the inactive season of federally listed bat species. b) To reduce visual impacts, a 20ft vegetative buffer should be retained along the shared parcel boundary with the National Register -listed Mary Mills Coxe House (HN0054). If the existing vegetation cannot remain or is not continuous and thus does not provide sufficient screening, a staggered double -row of mixed evergreen species should be installed and maintained. NOTE: Per the attached letter from the North Carolina Wildlife Resources Commission (NCWRC) dated October 9, 2023, the trout moratorium has been waived for this proiect. Please consider the NCWRC recommendations to further reduce effects to fish and wildlife resources. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.
