DWR has expressed to the applicants that resolution of resource agencies' concerns were necessary to ensure the project will not violate 15A NCAC 02B .0201 Antidegradation Policy and 15A NCAC 02B .0222 Tidal Salt Water Quality Standards for Class SB Waters. The NMFS's designation of the shoal as a Essential Fish Habitat in addition to DMF's comments on the area's critical value to important fish species, demonstrate the biological significance of Frying Pan Shoals. It's notable that this would be the first use of this area so appropriate study and monitoring are necessary to ensure the biological integrity would not be degraded. However, the attached letters note inadequacies in the applicant's biological sampling plan and objections the project. Therefore, the information provided and sampling plan is still insufficient to adequately assess the impacts of this project on aquatic species and alleviate DWR's concerns that the project would violate water quality standards and our antidegradation policy.
