The applicant, John Core of Wilmington Industrial Partners LLC, is requesting approval
of the enclosed nationwide permit 39 verification package. Atlas Environmental staff
completed the delineation of aquatic resources on October 12t", 13t", and 18t" 2022.
Features were field verified by David Bailey on May 24, 2023. A previous Approved
Jurisdictional Determination had been issued for a portion of the review area under
Action ID SAW-2019-00226 which expires April 08, 2025. A delineation concurrence
was issued for the remainder of the review area via email by David Bailey on July 05,
2023. The AJD area included one isolated impoundment as Pond 1. Due to the
existing AJD and recent regulatory changes the isolated pond has not been identified as
an impact.
The site has been designed and engineered to avoid and minimize impacts to the
greatest extent possible. Impacts include three permanent stream impacts, seven
temporary stream impacts, and three permanent wetland impacts. The permanent
stream impacts include one perennial channel (S1: 94 LF, 0.007 Ac) and two
intermittent channels (S2: 50 LF, 0.003 Ac and S3: 19 LF, 0.001 Ac). Three temporary
impacts are associated with trenching for sewer line installation and four temporary
stream impacts are to establish a dewatered area using a pump around system to
prevent flowing water in the work area. One wetland impact, identified as W1, is
associated with the road crossing. Impacts W2 and W3 are fill related to the sewer line
installation.
Avoidance and minimization has occurred through the site design including the size,
orientation, and positioning of the proposed buildings, stormwater control measures,
parking, and additional infrastructure. Retaining walls are proposed at the road crossing
to minimize proposed impacts and avoid additional impacts. The retaining walls at the
road crossing are 247 linear feet and 144 linear feet. The walls vary in height but
approximate 20 feet at the highest point. Without these retaining walls and assuming

2:1 slopes the road crossing would be lengthened by approximately 80 feet (40 feet on
both sides) and would impact over 175 feet of CH 100, all of CH 2O0, all of WL 2000,
and a portion of WL 1500. An additional retaining wall of 745 linear feet, varying in
height from approximately 20-30 feet, is being proposed Southwest of Building A to
avoid greater impacts to CH 100 and entirely avoid wetlands WL 1400 and WL 1500.
This wall also creates a wider buffer and tree save area along channel CH 100.
The road alignment at the stream crossing has been dictated by the City of Garner for
an eventual connection with Cook Street. The Western region of the property is zoned
as residential. Any future development and the continuation of the road to Cook Street
will be a separate and complete project to be completed by others and will be unrelated
to the proposed industrial project.

Buffer impacts are proposed as part of the development including one road crossing,
three sewer line crossings, additional sewer impacts within the buffer, and grading
within the buffer. No mitigation is required for the road crossing as impacts are less
than 1/3 acre. The sewer line has a required permanent easement of 40-feet, due to
this required width, all impacts within zone 1 are being mitigated at a 3:1 rate. No
impacts within zone 2 require mitigation. A summary of buffer impacts is located in
Table 2. A Statement of Availability has been attached for purchasing buffer mitigation
credits from a private mitigation bank.

2023-00044 Delineation Map.pdf
The updated map for the above referenced site (SAW-2023-00044) appears to reflect the delineation of aquatic
resources revised and verified during our site visit on 5/24/2023.
By copy of this e-mail, we are confirming that the aquatic resources delineation has been verified by the Corps to be
sufficiently accurate and reliable for permitting actions and the determination of compensatory mitigation
requirements. The boundaries of these aquatic resources are shown on the attached delineation map labeled "Aquatic
Resources Sketch Map" (Figures la -If, Pages 1-6), dated 5/25/2023. Note that the area covered by this delineation
concurrence is the area within the red -outlined "PJD Review Area", and does not include the area within the yellow -
outlined "AJD Review Area", which is covered by an Approved Jurisdictional Determination issued under a separate
Action ID (SAW-2019-00226, expires 4/8/2025).
Regulatory Guidance Letter (RGL) 16-01 provides guidance for Jurisdictional Determinations (JDs) and states "The Corps
generally does not issue a JD of any type where no JD has been requested". At this time we are only verifying the
delineation. This delineation may be relied upon for use in the permit evaluation process, including determining
compensatory mitigation. This delineation verification is not an Approved Jurisdictional Determination (AJD) and is not
an appealable action under the Regulatory Program Administrative Appeal Process (33 CFR Part 331). However, you may
request an AJD, which is an appealable action.
If you wish to receive a Preliminary Jurisdictional Determination (PJD), or an AJD please respond accordingly, otherwise
nothing further is required and we will not provide any additional documentation pertaining to this delineation.
Sincerely,
Dave Bailey

Self -Certification Letter
ProjectNameWilmington Road
Dear Applicant:
Thank you for using the U.S. Fish and Wildlife Service (Service) Raleigh Ecological
Services online project review process. By printing this letter in conjunction with your
project review package, you are certifying that you have completed the online project
review process for the project named above in accordance with all instructions
provided, using the best available information to reach your conclusions. This letter,
and the enclosed project review package, completes the review of your project in
accordance with the Endangered Species Act of 1973 (16 U.S.C. 1531-1544, 87 Stat.
884), as amended (ESA), and the Bald and Golden Eagle Protection Act (16 U.S.C.
668-668c, 54 Stat. 250), as amended (Eagle Act). This letter also provides
information for your project review under the National Environmental Policy Act of
1969 (P.L. 91-190, 42 U.S.C. 4321-4347, 83 Stat. 852), as amended. A copy of this
letter and the project review package must be submitted to this office for this
certification to be valid. This letter and the project review package will be maintained
in our records.
The species conclusions table in the enclosed project review package summarizes
your ESA and Eagle Act conclusions. Based on your analysis, mark all the
determinations that apply:
❑"no effect" determinations for proposed/listed species and/or
✓ proposed/designated critical habitat; and/or
❑ "may affect, not likely to adversely affect" determinations for proposed/listed
species and/or proposed/designated critical habitat; and/or
❑ "may affect, likely to adversely affect" determination for the Northern long-
eared bat (Myotis septentrionalis) and relying on the findings of the January 5,
2016, Programmatic Biological Opinion for the Final 4(d) Rule on the
Northern long-eared bat;
❑✓ "no Eagle Act permit required" determinations for eagles.
Applicant Page 2
We certify that use of the online project review process in strict accordance with the
instructions provided as documented in the enclosed project review package results in
reaching the appropriate determinations. Therefore, we concur with the "no effect" or
"not likely to adversely affect" determinations for proposed and listed species and
proposed and designated critical habitat; the "may affect" determination for Northern
long-eared bat; and/or the "no Eagle Act permit required" determinations for eagles.
Additional coordination with this office is not needed. Candidate species are not
legally protected pursuant to the ESA. However, the Service encourages consideration
of these species by avoiding adverse impacts to them. Please contact this office for
additional coordination if your project action area contains candidate species.
Should project plans change or if additional information on the distribution of
proposed or listed species, proposed or designated critical habitat, or bald eagles
becomes available, this determination may be reconsidered. This certification letter is
valid for 1 year. Information about the online project review process including
instructions, species information, and other information regarding project reviews
within North Carolina is available at our website http://www.fws.gov. If you have any
questions, you can write to us at Raleigh@fws.gov or please contact Leigh Mann of
this office at 919-856-4520, ext. 10.
