Proiect Summary: The applicant wishes to replace the existing non -conforming roof
structure over the existing boat slips (2,879 SF covered boat slip area) within the New
River for private use, Onslow County.

Narrative Description:
The property is located adjacent to the New River at 109 Shoreline Dr. in Jacksonville, Onslow
County. This property is currently developed with a driveway, single family residence, docking
facility, and a non -conforming covered boat slip area adjacent to the dock out in the river. The
adjacent riparian properties are developed with single family residence to the east and a community
boat ramp facility to the west.
The covered boat slip area is considered a water dependent use as per the NC Coastal Resources
Commission (CRC) rule, 15A NCAC 07H .0208(a)(6)(D), which depicts piers and docking facilities
as water dependent and limits boathouses to 400 square feet maximum. Therefore, the structure is
non -conforming to the existing rule which took effect on September 9, 1977. However, the structure
was built prior to 1977 based on historical aerial imagery, prior to the effective date of the rule to
which it is inconsistent.
The elevation of the high ground of the parcel is about 4' above the normal water level (nwl).
Vegetation on the parcel mainly consists of mature trees and shrubs. There are Coastal Wetlands
within the project area. There is an 88 linear foot area which contains 2' of spartina cynosuroides
(Salt Reed Grass) which has occurred since 2018, after the existing bulkhead failed and caused the
shoreline to erode, allowing for the growth of coastal wetland species. The 54,978 square foot parcel
has approximately 246' of continuous shoreline along the New River. Immediate offshore water
depths adjacent to the parcel range from —2' to —6.8' normal water level (NWL). The subaqueous
substrate is soft mud and silt without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 850' across at this location. These inland waters are classified as a Primary Nursery
Area. Submerged aquatic vegetation was not observed at this location. This area is closed to
shellfish harvest and is classified as SC; high quality, Nutrient Sensitive Waters. There is a defined
Federal Channel near the project area and the furthest extent of the docking facility is located 160'
from the 80' USACE Federal Channel Setback.
Proposed Development:
The applicant proposes to replace the existing non -conforming roof structure in the same footprint
(2,879 sf) that is within the New River, in Jacksonville. The proposed development would take place
at 109 Shoreline Dr., Onslow County. This proposal is for private residential use.
The applicant is asking to replace the existing 48.8 x 59' boathouse roof structure in the same
footprint (been in place since before 1977). There is a total of two boat slips currently with no other
slips proposed at this docking facility. No other work is proposed at this time. Past general permits
were authorized for the bulkhead and dock work.

Anticipated Impacts:
This proposal would not pose a hazard to navigation. The proposed non -conforming boathouse
structure would shade and incorporate approximately 2,879 square feet of Public Trust Area. The
structure cannot be enlarged beyond its original dimensions as per CRC rule 15A NCAC 07H
.0211 J. Therefore, there would not be any new impacts caused by its replacement.
Traditional marine construction methodology would be utilized during the construction of this
project. Traditional silt fencing would be used for sedimentation and erosion control. Turbidity
impacts are not anticipated during the construction activities in the Trent River.
There is not a cultural resource in the nearby vicinity of the project area. This project area is
within the White Oak River Basin. The waters of the Trent River are not classified as a Primary
Nursery Area and the presence of submerged aquatic vegetation was not observed. This area is
closed to shellfish harvest and is classified as SB; Sw; Nutrient Sensitive Waters. There is not a
defined Federal Channel near the project area.

Beginning at are iron stake in the southern right of way line of
Shoreline Drive, said stake being located North 67 degrees 34
minutes West 234.90 feet of the center line intersection of Court
Street and Shoreline Drive as measured along the right of way line
of Shoreline Drive, and running thence with the right of way of
Shoreline Drive North 67 degrees 34 minutes West 11 feet to a point
of curve; thence with the right of way of Shoreline Drive and a
curve having a radius of 275.89 feet an arc distance of 54 feet to
an iron stake; thence South 29 degrees 45 minutes West 211 feet to
an iron stake in the high water line of New River; thence with the
high water line of New River South 69 degrees 11 minutes East 110
feet to an iron stake in the high water line of New River; thence
North 17 degrees 03 minutes 204 feet to the beginning, said lot
being in Jacksonville, North Carolina.

Bounded by a line beginning at a point in the southern right of way

in Book 329, Page 75, Onslow County Registry; running thence with
the eastern boundary line of tract of land described in said deed
South 17 degrees 05 minutes West 204 feet to New River; thence with
New River South 66 degrees 02 minutes East 18 feet; thence leaving
New River and running North 22 degrees 26 minutes East 204.3 feet
