In accordance with 15 A NCAC 02H .0506 (b)(1) the DWR shall evaluate if the proposed activity: has avoided and minimized impacts to surface waters and wetlands to ensure any remaining surface waters or wetlands, and any surface waters or wetlands downstream, continue to support existing uses during and after project completion. Good Morning As of 10/19/2023 your application is considered complete. Additionally, as I discussed on the phone, we will want some detailed information on how the connection of the RPW and the off -site wetlands will maintain its connection to downstream waters. Information on how the RPW will connect into the swell and travel to the downstream wetlands will be needed. Also, I would like the dissipator pad at the end of the swell to come right up to the wetland line and the top of the pad to match the elevation of the downstream wetlands. I would also like to see the final approved stormwater plan to that we can confirm that this connection will remain. This will be needed before the permit will be authorized and the permit will contain special conditions relating to this connection. If you have any questions, feel free to contact me. Thank you. Currently the application is considered incomplete due to missing impacts to aquatic resources (Condition 32). 1. Two Non -wetland waters are shown on the delineation and appear to be impacted. There are no impacts shown for these features. Additional Question: 1. What is the reason for requesting an 18 and 29 when it appears that just 18 would work bases on current plans. Please clarify. 2. Wetland impact 2A and 2B will need some more justification why these cannot be avoided. Can the building be built with out impact to these areas? If it is just to have a square lot and yard are then this would not be minimization or avoidance. 3. Wetland impact 3 needs justification. Why can the swell coming from the road not cross the wetland and stop before getting into the wetland.
