Pierce, Director MEMORANDUM February 14, 2005 1•• ~~~ E NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO: Doug Huggett, DCM Major Permits Processing Coordinator FROM: Lees Sabo for Patti Fowler Shellfish Sanitation and Recreational Water Quality Section SUBJECT: David Greer/ Sloop Point Plantation The applicant proposes to construct two 10-slip dockage facilities over open shellfishing waters adjacent the AIWW in Topsail Sound near the mouth of Virginia Creek, Pender County. The Division of Coastal Management has already issued CAMA permit # 82-01 to A.C. Skinner for the construction of a 10- slip dockage facility on a lot between the two docks proposed in the subject application. The cumulative impacts of the three adjacent 10-slip docks along 750 feet of shoreline is considered to pose the same threat to open shellfishing waters as would a 30 slip marina. In accordance with 15A NCAC 18A.0911 MARINAS: DOCKING FACILITIES: OTHER MOORING AREAS, Section (5) Areas, other than marinas, where boats are moored or docked maybe considered on a case- by-case basis with respect to sanitary significance relative to actual or potential contamination and classification shall be made as necessary, if the three referenced 10-slip docks are constructed with no limitation to vessel length or characteristics, ashellfish harvesting closure of 150' beyond all boat slips, docks and docking facilities will be recommended.
