Dear Mr. Luis:
The Division of Water Resources (Division) recently received a request from Urban Design Partners on
your behalf to modify the existing stormwater management plan (SMP) as previously approved by the
Division under the 401 certification #2018-1259 dated February 8, 2019 and a stormwater management
plan modification (version 2) approved on December 4, 2020.
The Division hereby approves the change of SCM#7 and SCM #9 from underground system to sand filters.
The Seasonal High Water Table (SHWT) shall be determined prior to construction of the sand
filter and that the minimum separation between the bottom of the sand filter and the SHWT shall
be met in accordance with the required Minimum Design Criteria [15A NCAC 02H .1056(1)].
Documentation on the SHWT determination shall be submitted to the Division prior to
construction of the sand filter. The maximum allowable drainage and built -upon areas for these two
SCMs remain unchanged and other aspects of the stormwater management plan shall continue as previously
approved by the Division (under Condition#6 of the 401 certification). Maintenance activities for
stormwater management device(s) shall be performed in accordance with the updated O&M agreements
signed by you (James Martin, AMH Rivercross Development TRS, LLC) on September 12, 2023.
