Ms. Masterson,
On September 28, 2023, the Division of Water Resources (Division) received your applicaƟon requesƟng a 401 Water
Quality CerƟficaƟon from the Division for the subject project. The Division has determined that your applicaƟon is
incomplete and cannot be processed. The applicaƟon is on‐hold unƟl all of the following informaƟon is received:
1. The applicaƟon states that there will be no impacts below the water level of Lake Glenville. A 401 water quality
cerƟficaƟon is only required when impacts will occur to jurisdicƟonal waters. Please verify whether jurisdicƟonal
impacts will occur and provide dimensions for those impacts. The US Army Corps of Engineers determines the
extent of jurisdicƟonal features and can assist, if needed. The Corps contact for Jackson County is Shannon Healy

2. AcƟvity Specific CondiƟon 1 of General CerƟficaƟon 4502 requires that riprap be installed waterward of seawalls
to ensure protecƟon of aquaƟc habitat. The applicaƟon and project plans don’t include riprap; please clarify
whether riprap will be installed. Please note, riprap is also typically required by the US Army Corps of Engineers
for eligibility under Regional General Permit 30. Please also indicate whether the Corps has waived this

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested informaƟon for the
proper consideraƟon of the applicaƟon. Please provide your response by November 17, 2023. If all of the requested
informaƟon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
The denial of this project will necessitate reapplicaƟon to the Division for approval, including a complete applicaƟon
package and appropriate fee.
