This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007. The final permit includes the following changes from your draft permit: r The limit for Nickel was corrected to 75 Ng/1 as it was in the previous permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Continue to discharge up to 0.216 MGD of reject water from a reverse osmosis water treatment plant located at 3868 Albemarle Church Rd., Columbia, Tyrrell County, and 2. Discharge reject wastewater from an effluent diffuser system at the location specified on the attached map into Bull Bay which is classified SB waters in the Pasquotank River Basin. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from outfall(s) serial number 001- Reverse Osmosis Reject Water. ACUTE TOXICITY PASS/FAIL MONITORING (QRTRLY) The permittee shall conduct acute toxicity tests on a guarterlu basis using .protocols defined in the North Carolina Procedure Document entitled "Pass/ Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Mysidopsis bahia 24 hour static test. The effluent concentration defined as treatment two in the procedure document will be 90%. Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July, and October. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month.in which it was performed, using the parameter code TGE3E. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: Environmental Sciences Section North Carolina Division of Water Quality 1621 Mail Service Center Raleigh, N.C. 27699-1621 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a valid test is submitted. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A (3). DISCHARGE SPECIAL CONDITION The effluent diffuser must be designed to prevent surface turbulence and bottom scour. Should the location of the discharge cause visible turbulence within Bull Bay, the Division .may require that the discharge be relocated. The diffuser must be submerged during low tide conditions. INSTREAM MONITORING REQUIREMENTS The following parameters shall be monitored within Bull Bay (at the locations indicated) 2/month year round. Total Residual Chlorine Monitoring It is the Division of Water Quality's understanding that no residual chlorine will be in the reject water from the reverse osmosis process. Should this not be the case in the future, the Division of Water Quality, NPDES Unit, shall be notified immediately -and this permit may be reopened to include total residual chlorine monitoring and a limit. Tyrrell County — Tyrrell County Reverse Osmosis Water Treatment Plant, 108 South Water Street, Columbia, North Carolina 27925, has applied for renewal of its NPDES (NC0086924) permit discharging to Bull Bay in the Pasquotank River Basin. Some metals are water quality limited in this permit. This discharge may affect future dis- charges in this portion of the basin. Captain Neill's Seafood, Inc. (508 North Street Road, Columbia, NC) has applied for renewal of NPDES permit NC0088234, dis- charging seafood processing wastewaters to an unnamed tributary to the Albemade Sound in the Pasquotank River Basin. pH is water quality limited. This discharge may affect future allocations in this portion of the receiving stream. Mr. Willie Etheridge, III (P.O. Box 77, Wanchese, NO 27981) has applied for renewal of NPDES permit NCO048151 for the Etheridge Seafood Company WWiP in Dare County. The RO plant is designed to operate at 300 gallons per minute. A future expansion to 600 gallons per minute is part of the long term plan for the County with an ultimate discharge of RO concentrate of approximately 0.216 MGD. The permit was issued in November 2003 with an expiration date of December 31, 2007. The permit included extensive monitoring requirements for the effluent and the receiving waterbody. After collecting two years of data several parameters were deleted from the permit as they did not show reasonable potential to exceed the water quality limits. DMR DATA REVIEW: DMR Data was reviewed for the period of January 2005 to July 2007. A summary is presented in Table 1. Mercury, nickel and selenium are water quality limited. A review of the data shows that chromium, nickel, selenium, mercury, zinc and copper show reasonable potential to exceed the standards. Limits for mercury, nickel and selenium will remain in the permit. A daily maximum limit of 20 ug/1 for total chromium is included in the permit. Aluminum and Total Organic Carbon will be eliminated from the monitoring requirements, there is no standard or criteria for saltwater for these parameters. As per the current guidance for membrane systems they are not pollutants of concern. "l'yrWIT Co. RO IT NPDES Renewal Page 1 TOXICITY TESTING: Based on the ultimate reject flow of 0.216 MGD and current policy for RO plants, quarterly acute P/F monitoring at 90%, mysid 24 hour testing is required in the permit. The facility failed 6 quarterly tests since 2003. INSTREAM MONITORING: The permit requires surface and bottom monitoring at 8 instream locations. One is a background location, one at the discharge point and others surrounding the discharge point. All locations show similar values for DO, salinity, conductivity, temperature and pH, including the background location. Salinity ranged between 0.2 ppt and 7 ppt on most monitoring locations. The discharge point reported one high value of 15 ppt. DO ranges from 6 to 10.9 for all stations. Temperature and pH values were within normal conditions. Since data shows that there is no significant variability among the 6 stations the monitoring requirement will be modified to reduce the number of sampling locations to two locations, the background location and one closer to the discharge. The Division has an ambient monitoring station on the Albemarle Sound northeast of the discharge. Salinity values ranged from 0.03 ppt to 8.2 ppt and DO values ranged from 6.9 mg/1 to 13.2 mg/l. Basin Plan/303(d): Bull Bay is not rated on an evaluated basis in the aquatic life category due to the toxicity failures from the RO facility. Bull bay is not listed in the North Carolina 303(d) list. PROPOSED CHANGES: • Eliminate aluminum and TOC monitoring from permit. These parameters are not pollutants of concern. • Total chromium shows reasonable potential to exceed the water quality standard. A limit was implemented. • Instream monitoring requirements were modified based on the results of two years of monitoring. Instream sampling will be required for one background station and one station near the discharge point. We have some very valid concerns about this facilities failure rate on their aquatic toxicity tests. T believe they have failed six times in the last four years. Additionally Al Hodge was showing me a trending of their ammonia levels and they look very high on a consistent basis. We just want to make sure that there will be limits placed on this facility, in their new permit, to give us more oversight on this facility.
